The effect of the commented Regulation applies to cases of temporary disability, pregnancy and childbirth that occurred from July 11, 2013 - the date the document came into force. This means that if an employee submitted a temporary disability certificate due to a general illness, issued for the period from July 10 to July 19, 2013, then the procedure for assigning benefits for all days of disability remains the same (in accordance with the law). · either from average earnings saved for the employee in the billing period in accordance with the law (for periods of labor leave, maternity leave, temporary disability and in other cases).

Temporary disability benefit due to an illness or injury caused by alcohol consumption is not granted for the first 6 calendar days of temporary disability. Starting from the 7th calendar day of temporary disability, the allowance is assigned in the amount of 50% of the calculated average daily earnings.

Example

The employee submitted a certificate of incapacity for work due to a general illness caused by alcohol consumption, issued for the period from July 22 to August 8, 2013 (18 calendar days). The average daily earnings for the period from January 1 to June 30, 2013 amounted to 106,500 rubles.

In this case, temporary disability benefits:

Making a sick leave

Which days are included in the billing period and which are not?

  • the employee loses the right to payment due to temporary incapacity for work

  • periods of temporary disability
  • labor and social leave

If the number of calendar days of the billing period less than 30, the allowance is calculated on the basis of tariff rate established on the day the right to benefits arises.

Temporary disability benefit must be granted within 10 days from the moment the employee provides a temporary disability certificate.
