What the law says

In paragraph 1.10 of the Rules compulsory insurance civil liability vehicle owners are as follows:

“... Changes to an insurance policy issued in the form of an electronic document in the manner prescribed by these Rules may be made in in electronic format or by reissuing a compulsory insurance policy on paper. In the latter case, the policyholder is issued a reissued (new) compulsory insurance policy on paper.

That is, in fact, the law does not prohibit insurance companies from making changes to the electronic OSAGO policy in electronic form. In practice, companies do not use this opportunity. And they demand to come to the nearest sales office to issue a new policy in paper form.

Important! The cost of the OSAGO policy is calculated based on the place of residence of the owner of the car - article 9 of the law on OSAGO No. 40-FZ. Therefore, it is possible that the new owner will have to pay an additional insurance premium under the policy. For example, if the former owner lived in the Ryazan region - there the territory coefficient is 0.9, and the new owner lives in Moscow - here Km = 2.0.

When do I need to make changes to OSAGO

According to Art. 15 Part 8 No. 40-FZ, the insured must notify the IC in writing of a change in the data specified in the application when concluding the contract. Thus, it is necessary to inform the company that issued the policy in the following cases:

  • change of full name, passport data of the insurance holder;
  • changing of the living place;
  • registration of a new TCP;
  • replacement of registration plates;
  • when changing rights;
  • transfer of ownership to another person;
  • expansion of the list of drivers admitted to driving;
  • use of the car outside the period specified in the policy;
  • when changing the purpose of using the vehicle.

You cannot change the following data specified in OSAGO:

  • make/model of car;
  • the insured;
  • contract time.

If you change any of the data indicated in the last list, you will need to terminate the current contract and take out new insurance.

What happens if you don't make changes

Provisions No. 40-FZ, in particular Art. 15 hours 8 oblige the insured to promptly inform the UK about all changes in order to amend the OSAGO policy. At the same time, the legislation does not imply any punishment for failure to comply with this requirement.

In addition, the existing regulatory legal acts and provisions on OSAGO do not consider failure to make changes to the “autocitizen” as a reason for refusing payments or a basis for recourse.

The only trouble that can await a driver who has not informed the insurer about the changes is a meeting with a traffic police inspector. When checking the policy, he will reveal a discrepancy between the data specified in the OSAGO and the information indicated in other documents.

These discrepancies can cause a traffic inspector to question the validity of the insurance. On these grounds, he has the right to impose a fine on the motorist under Art. 12.37 h. 2 of the Code of Administrative Offenses of the Russian Federation for driving a vehicle without issuing an OSAGO policy. The recovery is unlawful, it can be challenged in court, but this will take time and effort.

How to make changes to the policy

All amendments are made by an employee of the insurance company that issued the policy, on the basis of a written application from the OSAGO holder or his representative (you will need to issue a notarized power of attorney in his name). To make changes, it is not necessary to contact the branch where the contract was concluded. You can visit any office of the company.

To make changes to OSAGO, you must perform a number of actions:

  • prepare the necessary documents;
  • contact the office of the insurer and write a statement;
  • wait for the SC's decision.

Often, drivers ask themselves the question: how much does it cost to correct the data in the "autocitizen". Adjustments are made free of charge, if these changes do not entail an increase in the insurance premium.

The company has 3 working days from the receipt of the application to complete the procedure. In practice, amendments are made on the day the driver applies.

Required documents

To change the data in the policy, you must provide the following documentation package to the UK:

  • original OSAGO policy;

Expansion of the list of drivers admitted to driving

One of the most common reasons for changing data in OSAGO is the need to add a new driver to the policy. Such adjustments, in most cases, require an additional fee. To make such changes, a passport and the rights of a citizen included in the insurance should be attached to the designated list of documents.

Extension of the period of use

If, at the conclusion of the contract, the policyholder indicated the period of use of the vehicle less than the validity period of the policy, and then decided to increase it, you will need to indicate this change in the form.

Based on clause 1.9 of the OSAGO Rules, this must be done before the end of the period specified in the policy.

Driver's license replacement

How to make changes to e-insurance

In 2019, drivers have the opportunity to purchase "autocitizenship" online. This does not require visiting the office of the insurer. If it is necessary to make changes to the electronic OSAGO policy, it will not be possible to avoid a visit to the UK.

The point is that, according to Art. 15 h. 8 No. 40-FZ, an application for changing data must be submitted in writing. At the moment, the legislator does not distinguish between the classic "autocitizen" and e-OSAGO.

If during the validity of the insurance contract any data specified in the application changes, you will need to inform the IC employees about this. The agent will make adjustments to OSAGO and issue a new form to the driver. This procedure does not take much time and does not require the collection of a large package of documents.

Each policyholder has the legal right to make permissible changes to the auto insurance e-policy using a personal account on the official web resource of the insurer company. To be able to correct the data, you must log in to your personal account by entering your E-mail and password. Go to the "Personal Account" and select the "Policies" subsection. If you have several electronic policies issued to you, then search required document by individual number. In the policy displayed in your personal account, you can make the necessary changes.   • Name of the driver.
  • Driver's license details.

In cases where you need to change something that is not presented in the above paragraphs, then most likely it is not technically possible to do so. And this means that you will have to visit the office of the insurance company to make changes. It is also possible to ask someone to visit the office and make changes, but this will require a notarized power of attorney from the policy owner.

Important information: It is possible to terminate the electronic auto insurance policy after its entry into legal force only by personally contacting the office of the insurer. It is impossible to terminate the insurance contract online!

How do you prepare to make changes?

In cases where a personal presence at the office of the insurer company is necessary to correct personal data in the auto insurance e-policy, you should take care of the availability of the necessary documents.

  • When changing your last name, first name or patronymic, be sure to take your passport or other documents confirming the changes with you.

In order to add a new car owner to the insurance policy, in addition to the identity documents of the new owner, the presence of the old owner with a passport is required, as well as an agreement on the alienation of the vehicle.

It is possible to change the type of insurance, for example, to unlimited. To do this, you must complete an application and pay the claimed amount of money.

To save time, take care of the availability of the above documents in advance, write statements of the established form and hand everything over personally to the insurance worker. After adjusting the data in the database, you will be printed out an updated OSAGO policy on the government letterhead, while its number and validity period will remain unchanged.

Changes to the electronic OSAGO policy are made by going to the Personal Account on the page of the insurance company where it was issued. If the Internet resource of the insurance company has special restrictions, then it is possible to make changes to the electronic policy only at the office of one of the company's branches. The basis for the amendments is a statement in which the clients prescribe all the desired adjustments regarding the already concluded contract. If the application is submitted by direct communication in the office, it must be in paper form, and if the submission is via Personal account on the site, an electronic application is submitted. This operation is authorized only by such a person who is the insured, respectively, he is indicated in the mandatory insurance policy OSAGO in the first paragraph.

How to make changes to the electronic OSAGO policy

When an appropriate application is received by the insurance company, the company registers it directly on the day of the application or on one of two working days. They record your claims on the so-called "Special Marks" of the insurance, and also indicate the date and time of the change.
