In accordance with paragraph 2 of Article 50 federal law"On Fishing and Conservation of Aquatic Biological Resources" Government Russian Federation decides:
1. Approve the attached approvals by the Federal Agency for Fisheries for the construction and reconstruction of facilities capital construction, the introduction of new technological processes and the implementation of other activities that affect water biological resources and their habitat.
2. Recognize as invalid Decree of the Government of the Russian Federation dated July 28, 2008 No. 569 "On approval of the Rules for approving the placement of economic and other facilities, as well as the introduction of new technological processes that affect the state of aquatic biological resources and their habitat" (Collection of Legislation of the Russian Federation, 2008, No. 31, item 3740).
3. The implementation of the powers provided for by this resolution is carried out within the limits established by the Government Russian Federation of the maximum number and wage fund of employees central office Federal Agency for Fisheries and its territorial bodies.
1. These Rules establish the procedure for approval by the Federal Fisheries Agency (its territorial bodies) of the construction and reconstruction of capital construction projects, the introduction of new technological processes and the implementation of other activities that affect aquatic biological resources and their habitat (hereinafter referred to as other activities).
2. The Federal Fisheries Agency coordinates:
a) construction and reconstruction of capital construction facilities in the internal sea waters of the Russian Federation, in the territorial sea of the Russian Federation, on the continental shelf of the Russian Federation, in the exclusive economic zone of the Russian Federation, the design documentation of which is the subject of state environmental expertise;
b) the introduction of new technological processes and the implementation of other activities in the internal sea waters of the Russian Federation, in the territorial sea of the Russian Federation, on the continental shelf of the Russian Federation, in the exclusive economic zone of the Russian Federation, as well as in the case of the introduction of these processes and the implementation of other activities in the territory of two and more subjects of the Russian Federation and in transboundary water bodies.
3. Territorial bodies of the Federal Agency for Fisheries coordinate:
a) construction and reconstruction of capital construction objects - in the case of construction and reconstruction of these objects on the territory of one subject of the Russian Federation;
b) the introduction of new technological processes and the implementation of other activities - in the case of the introduction of these processes and the implementation of other activities in the territory of one subject of the Russian Federation.
4. Legal entities and individuals, including individual entrepreneurs (hereinafter referred to as applicants), in order to coordinate the construction and reconstruction of capital construction projects, introduce new technological processes and carry out other activities, submit to the Federal Agency for Fisheries (its territorial bodies) an application for approval ( hereinafter referred to as the application), in which the following information is indicated:
a) about the applicant:
full and abbreviated (if any) names legal entity, its legal form and location;
surname, name, patronymic and place of residence individual (individual entrepreneur);
b) about the documentation attached to the application.
5. The following documentation is attached to the application:
a) upon approval of the construction and reconstruction of capital construction facilities in accordance with and these Rules - a copy of the sections project documentation, provided for in paragraphs 10, 12, 17, 18, 22-25 (for capital construction facilities of industrial and non-production purpose, except for linear facilities) and paragraphs 34-40 (for linear facilities) of the Regulations on the composition of sections of project documentation and the requirements for their content, approved by Decree of the Government of the Russian Federation dated February 16, 2008 No. 87;
b) when agreeing on the introduction of new technological processes and the implementation of other activities in accordance with and these Rules - a copy of the project documentation or a program of planned work justifying the introduction of new technological processes and the implementation of other activities, as well as a document containing information on the planned measures for the conservation of aquatic biological resources and their habitat.
6. The application and the documentation attached to it specified in these Rules (hereinafter referred to as the documentation) are submitted by the applicant to the Federal Fisheries Agency (its territorial bodies) directly or sent by mail with a list of attachments or in the form of an electronic document signed by an enhanced qualified electronic signature, using public information and telecommunication networks, including federal state information system"Single portal of state and municipal services (functions)".
Application form sent to in electronic format, and the procedure for its submission are established by the Ministry Agriculture Russian Federation.
7. The application and documentation received by the Federal Agency for Fisheries (its territorial bodies) are registered on the day they are received.
8. The Federal Agency for Fisheries (its territorial bodies) considers the application and documentation and makes a decision on approval (on refusal to approve) the construction and reconstruction of capital construction facilities, the introduction of new technological processes and the implementation of other activities (hereinafter referred to as activities) on time, not exceeding 30 calendar days from the date of receipt by the Federal Agency for Fisheries (its territorial bodies) of the application and documentation.
9. The decision to approve (refuse to approve) activities is drawn up in the form of a conclusion, which is signed by the head or authorized deputy head of the Federal Agency for Fisheries (its territorial body) and contains the following information:
a) short description activities and characteristics of its impact on aquatic biological resources and their habitat;
b) measures for the conservation of aquatic biological resources and their habitat, planned in accordance with the documentation;
c) conditions and restrictions necessary to prevent or reduce the negative impact of activities on aquatic biological resources and their habitat (conditions for water intake and diversion Wastewater, conditions of work in the water protection and fish protection zones, the coastal protective zone of the water body and the fishery reserve zone, restrictions on the timing and methods of work in the water area and other conditions);
d) conclusions about the admissibility of the impact of activities on the state of aquatic biological resources and their habitat;
e) a decision to approve (refuse to approve) the implementation of activities;
10. The decision to approve (refuse to approve) the implementation of activities is communicated to the applicant in the form in which the application and documentation were submitted (by post or in the form of an electronic document signed with an enhanced qualified electronic signature of an authorized official of the Federal Agency for Fisheries (his territorial authority).
11. The decision of the Federal Agency for Fisheries (its territorial body) to refuse to coordinate the implementation of activities must contain the grounds for refusal.
12. The grounds for refusal to approve the implementation of activities are:
a) submission to the Federal Agency for Fisheries (its territorial bodies) incomplete documentation;
b) non-compliance of the documentation with the requirements of the legislation on fishery and conservation of aquatic biological resources, water legislation, as well as legislation in the field of environmental protection on the conservation of aquatic biological resources and their habitat.
13. In case of refusal to approve activities, applicants may re-submit the application and documentation to the Federal Agency for Fisheries (its territorial bodies), subject to the revision of the documentation, taking into account the comments and recommendations provided for in the decision to refuse to approve activities.
The Rules for approval by the Federal Agency for Fishery of the construction and reconstruction of capital construction facilities, the introduction of new technological processes and the implementation of other activities affecting aquatic biological resources and their habitat.
Firstly, we are talking about the construction and reconstruction in inland sea waters, in the territorial sea, on the continental shelf, in the exclusive economic zone of Russia of objects, the design documentation of which is the object of environmental state expertise.
Secondly, about activities in the named areas, on the territory of 2 or more regions and in transboundary water bodies.
During the construction, reconstruction, implementation of activities in the territory of one region, the coordination is carried out by territorial bodies, in other cases - by the Agency itself.
Applications for approval are considered within a period of not more than 30 days.
The Decree of the Government of the Russian Federation on the approval of the Rules for coordinating the placement of economic and other facilities, as well as the introduction of new technological processes that affect the state of aquatic biological resources and their habitat, has been declared invalid.

The Rules were approved by Decree of the Government of the Russian Federation of April 30, 2013 No. 384 in accordance with Part 2 of Article 50 of the Federal Law "On Fishing and Conservation of Aquatic Biological Resources".
Rosrybolovstvo coordinates:
a) construction and reconstruction of capital construction facilities in the internal sea waters of the Russian Federation, in the territorial sea of the Russian Federation, on the continental shelf of the Russian Federation, in the exclusive economic zone of the Russian Federation, the design documentation of which is the subject of state environmental expertise;
b) the introduction of new technological processes and the implementation of other activities in the internal sea waters of the Russian Federation, in the territorial sea of the Russian Federation, on the continental shelf of the Russian Federation, in the exclusive economic zone of the Russian Federation, as well as in the case of the introduction of these processes and the implementation of other activities on the territory of two or more constituent entities of the Russian Federation and in transboundary water bodies.
Territorial bodies of the Federal Agency for Fisheries coordinate:
a) construction and reconstruction of capital construction objects - in the case of construction and reconstruction of these objects on the territory of one subject of the Russian Federation;
b) the introduction of new technological processes and the implementation of other activities - in the case of the introduction of these processes and the implementation of other activities on the territory of one subject of the Russian Federation.
Legal entities and individuals, including individual entrepreneurs, for approval, submit an application to the above-mentioned bodies with the application of the documentation established by the Rulesare carried out in accordance with the procedure established in accordance with Part 2 of Article 44 of the Federal Law "On Fishing and Conservation of Aquatic Biological Resources".

These Rules establish the procedure for approval by the Federal Fisheries Agency (its territorial bodies) of the construction and reconstruction of capital construction projects, the introduction of new technological processes and the implementation of other activities that affect aquatic biological resources and their habitat (hereinafter referred to as other activities).
2. The Federal Fisheries Agency coordinates:
a) construction and reconstruction of capital construction facilities in the internal sea waters of the Russian Federation, in the territorial sea of the Russian Federation, on the continental shelf of the Russian Federation, in the exclusive economic zone of the Russian Federation, the design documentation of which is the subject of state environmental expertise;
b) the introduction of new technological processes and the implementation of other activities in the internal sea waters of the Russian Federation, in the territorial sea of the Russian Federation, on the continental shelf of the Russian Federation, in the exclusive economic zone of the Russian Federation, as well as in the case of the introduction of these processes and the implementation of other activities in the territory of two and more subjects of the Russian Federation and in transboundary water bodies.
3. Territorial bodies of the Federal Agency for Fisheries coordinate:
a) construction and reconstruction of capital construction objects - in the case of construction and reconstruction of these objects on the territory of one subject of the Russian Federation;
b) the introduction of new technological processes and the implementation of other activities - in the case of the introduction of these processes and the implementation of other activities in the territory of one subject of the Russian Federation.
4. Legal entities and individuals, including individual entrepreneurs (hereinafter referred to as applicants), in order to coordinate the construction and reconstruction of capital construction projects, introduce new technological processes and carry out other activities, submit to the Federal Agency for Fisheries (its territorial bodies) an application for approval ( hereinafter referred to as the application), in which the following information is indicated:
a) about the applicant:
full and abbreviated (if any) name of the legal entity, its legal form and location;
surname, name, patronymic and place of residence of an individual (individual entrepreneur);
b) about the documentation attached to the application.
5. The following documentation is attached to the application:
a) upon approval of the construction and reconstruction of capital construction facilities in accordance with paragraphs 2 and 3 of these Rules - a copy of the sections of the design documentation provided for in paragraphs 10, 12, 17, 18, 22 - 25 (for capital construction facilities for industrial and non-industrial purposes, with the exception of linear facilities) and paragraphs 34 - 40 (for linear facilities) of the Regulation on the composition of sections of project documentation and the requirements for their content, approved by Decree of the Government of the Russian Federation of February 16, 2008 N 87;
b) when agreeing on the introduction of new technological processes and the implementation of other activities in accordance with paragraphs 2 and 3 of these Rules - a copy of the design documentation or a program of planned work justifying the introduction of new technological processes and the implementation of other activities, as well as a document containing information on the planned measures to conservation of aquatic biological resources and their habitat.
6. The application and the documentation attached to it, specified in paragraph 5 of these Rules (hereinafter referred to as the documentation), are submitted by the applicant to the Federal Fisheries Agency (its territorial bodies) directly or sent by mail with a list of attachments or in the form of an electronic document signed by an enhanced qualified electronic signature, using public information and telecommunication networks, including the federal state information system "Unified Portal of State and Municipal Services (Functions)".
The form of the application sent in electronic form and the procedure for its submission are established by the Ministry of Agriculture of the Russian Federation.
7. The application and documentation received by the Federal Agency for Fisheries (its territorial bodies) are registered on the day they are received.
8. The Federal Agency for Fisheries (its territorial bodies) considers the application and documentation and makes a decision on approval (on refusal to approve) the construction and reconstruction of capital construction facilities, the introduction of new technological processes and the implementation of other activities (hereinafter referred to as activities) on time, not exceeding 30 calendar days from the date of receipt by the Federal Agency for Fisheries (its territorial bodies) of the application and documentation.
9. The decision to approve (refuse to approve) activities is drawn up in the form of a conclusion, which is signed by the head or authorized deputy head of the Federal Agency for Fisheries (its territorial body) and contains the following information:
a) a brief description of the activity and a description of its impact on aquatic biological resources and their habitat;
b) measures for the conservation of aquatic biological resources and their habitat, planned in accordance with the documentation;
c) conditions and restrictions necessary to prevent or reduce the negative impact of activities on aquatic biological resources and their habitat (conditions for water intake and wastewater disposal, working conditions in the water protection and fish protection zones, the coastal protective zone of a water body and the fishery reserve zone, restrictions on the timing and methods of work in the water area and other conditions);
d) conclusions about the admissibility of the impact of activities on the state of aquatic biological resources and their habitat;
e) a decision to approve (refuse to approve) the implementation of activities;
f) comments and recommendations on the finalization of the documentation (if necessary, its revision in terms of the planned measures for the conservation of aquatic biological resources and their habitats).
10. The decision to approve (refuse to approve) the implementation of activities is communicated to the applicant in the form in which the application and documentation were submitted (by post or in the form of an electronic document signed with an enhanced qualified electronic signature of an authorized official of the Federal Agency for Fisheries (his territorial authority).
11. The decision of the Federal Agency for Fisheries (its territorial body) to refuse to coordinate the implementation of activities must contain the grounds for refusal.
12. The grounds for refusal to approve the implementation of activities are:
a) submission to the Federal Agency for Fisheries (its territorial bodies) incomplete documentation;
b) non-compliance of the documentation with the requirements of the legislation on fishery and conservation of aquatic biological resources, water legislation, as well as legislation in the field of environmental protection on the conservation of aquatic biological resources and their habitat.
13. In case of refusal to approve activities, applicants may re-submit the application and documentation to the Federal Agency for Fisheries (its territorial bodies), subject to the revision of the documentation, taking into account the comments and recommendations provided for in the decision to refuse to approve activities.
