4 General provisions

4.1 The construction of buildings and structures is carried out in the presence of a building permit obtained in accordance with the legislation on urban planning.

Lists of buildings and structures for the construction of which a building permit is not required are established by the legislation on urban planning.

4.2 The actions of the construction participants, the work performed during the construction process, their results, including buildings and structures completed by construction, must meet the requirements of the current legislation, design and working documentation, town planning plans land plots.

4.4 The basic functions of the developer are:

obtaining a building permit;

obtaining the right to limited use of neighboring land plots (servitudes) for the duration of construction;

involvement of a contractor (general contractor) to carry out works on the construction of a building or structure as a person carrying out the construction, in the event that work is performed under the contract;

providing construction with project documentation that has passed the examination and approved in the prescribed manner;

ensuring the stakeout of building regulation lines and the creation of a geodetic staking base;

involvement in accordance with 7.4 of the author's supervision of the person who carried out the preparation project documentation, for the construction of the facility;

notification of the commencement of any work on construction site body of state construction supervision, which controls this object;

ensuring construction control of the developer (customer);

acceptance of the completed construction object in case of performance of work under the contract;

organization of adjustment and testing of equipment, trial production of products and other measures to prepare the facility for operation;

making decisions on the start, suspension, conservation, termination of construction, on the commissioning of a completed property;

presentation of the construction object completed by the construction to the bodies of state construction supervision and environmental supervision (in cases provided for by the legislation on urban planning activities);

presentation of the completed construction object to the authorized body for commissioning;

acquisition, storage and transfer of executive and operational documentation to the relevant organizations.

4.5 The developer, in order to carry out its functions, may, in accordance with applicable law, engage a technical customer - individual acting on a professional basis, or a legal entity.

The technical customer authorized by the developer, on his behalf, concludes contracts for the implementation engineering surveys, preparation of project documentation, construction, reconstruction, overhaul objects capital construction, prepares technical specifications for the performance of these types of work, approves project documentation, signs the documents necessary to obtain permission to put the capital construction facility into operation, and performs other functions provided for by current legislation.

4.6 When construction is carried out on the basis of a contract, the basic organizational functions of the contractor (general contractor) as a person carrying out construction are:

execution of works, arrangement of structures, systems of engineering and technical support of the construction object in accordance with the design and working documentation;

development and application of organizational and technological documentation;

implementation of construction control of the person carrying out the construction, including control over the compliance of the applicable building materials and products to the requirements of technical regulations, design and working documentation;

maintenance of executive documentation;

ensuring labor safety at the construction site, safety of construction work for the environment and the population;

construction site management, including ensuring the protection of the construction site and the safety of the facility until it is accepted by the developer (customer);

compliance with the requirements of the local administration, acting within its competence, to maintain order in the territory adjacent to the construction site.

4.7 The basic function of the person who prepared the design documentation (hereinafter referred to as the designer) during the construction process is to introduce changes in the design estimate and working documentation in case of change after the start of construction of the urban plan land plot or existing normative documents(performed as an additional work).

Additional organizational functions of the designer during the construction process, performed in accordance with agreements between construction participants, are:

making changes to design and estimate documentation in connection with the need to take into account the technological capabilities of the contractor;

development of additional design solutions in connection with the need to ensure production;

coordination of the allowed deviations from the working documentation, including the adoption of decisions on the possibility of using non-conforming products.

4.8 Construction in accordance with current legislation, is carried out under control federal bodies executive authorities, executive authorities of the constituent entities of the Russian Federation, local governments and state supervision. To ensure this possibility, the mentioned authorities must be notified in advance by the developer (customer) about the start of work at the construction site, about the suspension, conservation and (or) termination of construction, about the readiness of the facility for commissioning.

4.9 Upon completion of the construction of a building or structure, its compliance with the requirements of the current legislation, technical regulations, design and working documentation, its acceptance during construction on the basis of a contract, as well as the commissioning of the completed building or structure are carried out.

4.10 Construction control carried out by construction participants must be carried out in accordance with the use of measuring instruments of an approved type that have been tested according to certified measurement procedures (methods) when necessary. Routine tests and measurements must be carried out by qualified personnel.

5 Construction preparation

5.1 In order to carry out construction on the basis of a contract, the developer (technical customer) engages a contractor (general contractor) to perform work in accordance with the current legislation as a person carrying out construction.

5.2 Construction participants (legal entities) by their administrative documents (orders) appoint officials personally responsible for the construction:

developer (technical customer) - a responsible representative of the construction control of the developer (technical customer);

the person carrying out the construction (contractor, general contractor) - the responsible work producer;

the person who prepared the project documentation (designer) - the responsible representative of architectural supervision in cases where architectural supervision is carried out.

These officials must be qualified in accordance with the requirements of the current legislation.

During the construction of a building or structure by a legal entity performing the functions of a developer (technical customer) and a person carrying out construction (contractor), these officials are appointed by the head of this organization. At the same time, the combination of the functions of the responsible work foreman and the responsible representative of the construction control of the developer (technical customer) by one unit or official of this organization is unacceptable.

5.3 The person carrying out the construction, in accordance with the current legislation, must have certificates issued by a self-regulatory organization on admission to the types of work that affect the safety of the building or structure being erected.

5.4 Design and working documentation is transmitted in two copies on electronic and paper media and must be accepted for work by the developer (technical customer) with the signature of the responsible person by putting a stamp on each sheet. The composition and content of sections of the project documentation (including the construction organization project) transferred to the person carrying out the construction must comply with the requirements established by the Government Russian Federation . The transferred project documentation must contain the assurance of the designer that this documentation has been developed in accordance with the design assignment and the requirements of the Federal Law of December 30, 2009 N 384-FZ "Technical Regulations on the Safety of Buildings and Structures".

5.5 The person carrying out the construction performs the input control of the working documentation transferred to him for execution, transfers to the developer (customer) a list of the shortcomings identified in it, checks their elimination. The term for the implementation of the input control of project documentation is established in the contract.

At the same time, the person carrying out the construction can check the feasibility of implementing the project using known methods, determining, if necessary, the need to develop new technological methods and equipment, as well as the possibility of acquiring materials, products and equipment, the use of which is provided for by the project documentation, and the compliance of the actual location indicated in design documentation of places and conditions for connecting temporary engineering communications (networks) to external networks of engineering and technical support to provide the construction site with electricity, water, heat, steam.

It also checks for instructions on conducting construction control, including requirements for the actual accuracy of controlled parameters, tolerances for the dimensions of products and structures, their installation in the design position, instructions on methods and equipment for performing the necessary tests and changes with reference to regulatory documents.

5.6 Before starting work at the facility, the construction contractor:

concludes an agreement with the developer (technical customer) building contract) for construction;

receives from the developer (technical customer) a notarized copy of the building permit;

receives from the developer (technical customer) design and working documentation for the entire facility or part of it, for certain types of work or a one-time amount of work;

accepts a site for construction;

coordinates the composition of subcontractors with the developer (technical customer), concludes contracts with them for the performance of various types of work and coordinates their activities;

concludes contracts for the supply of material and technical resources;

enters into contracts with accredited laboratories to perform types of tests that cannot be performed on their own;

draws up an act of admission on the possible combination of work during the reconstruction of the capital construction object of an existing enterprise;

develops organizational and technological documentation.

5.7 Project preparation organization of construction and development of organizational and technological documentation

5.7.1 Solutions for the organization of construction for industrial and non-production purpose are developed in projects for the organization of construction and projects for the organization of work on the demolition or dismantling of capital construction projects. Solutions for the organization of construction for linear facilities are developed in projects for the organization of construction and projects for the organization of work on the demolition (dismantling) of a linear facility. Projects for the organization of construction, projects for the organization of work for the demolition or dismantling of capital construction projects, projects for the organization of work for the demolition (dismantling) of a linear facility (hereinafter referred to as construction organization projects, POS) are an integral and integral part project documentation. Construction organization projects are binding document for the developer (customer), contractors, as well as organizations providing financing and logistics.

The choice of decisions on the organization of construction should be carried out on the basis of variant study with the wide use of criteria-based assessment methods, modeling methods and modern computer systems.

5.7.1.1 The construction organization shall: Ensure efficient distribution capital investments and volumes of construction installation work by buildings, structures and periods of construction; eliminate wasteful spending energy resources; provide for modern services production and sanitary services for those working directly at the facilities.

5.7.2 Organizational and technological documentation includes projects for the production of work, schemes and instructions for the production of work, quality control schemes, flow schedules, basic provisions for the production of construction and installation works as part of the working documentation standard projects mass application, as well as other documents that contain decisions on the organization construction industry and technologies of construction and installation works, drawn up, agreed, approved and registered in accordance with the rules in force in organizations developing, approving and coordinating these documents.

5.7.2.1 The project for the production of works (PPP) is developed for the construction of a building or structure as a whole, for the construction of their individual parts (underground and above-ground parts, section, span, floor, tier, etc.), for the performance of individual construction, installation and special building work.

5.7.3 The project for the production of works for the construction of a building or structure as a whole, the erection of their individual parts, is approved by the head of the organization performing the work.

The project for the production of works for the type of subcontracting work is approved by the head of this organization in agreement with the general contractor.

5.7.4 The project for the production of works in full must be developed:

during any construction in the urban area;

during any construction on the territory of an operating enterprise;

during construction in difficult natural and geological conditions, as well as technically especially complex objects - at the request of the authority issuing a permit for construction or for the performance of construction, installation and special works.

In other cases, the PPR is developed by decision of the person carrying out the construction in an incomplete volume.

5.7.5 The project for the production of works in full includes:

schedule for the production of works on the object;

calendar plan for the production of works on the object;

arrival schedule building structures, products, materials and equipment;

the schedule of the movement of workers on the object;

main traffic schedule construction machines by object;

technological maps for the performance of types of work;

an explanatory note containing decisions on the production geodetic works, solutions for laying temporary networks of water, heat, power supply and lighting of the construction site and workplaces; justification and measures for the use of mobile forms of work organization, work and rest regimes; work decisions, including winter time; the need for energy resources; the need and binding of camps of builders and mobile (inventory) buildings; measures to ensure the safety of materials, products, structures and equipment at the construction site; environmental protection measures; measures for labor protection and safety in construction; technical and economic indicators.

The project for the production of works in an incomplete scope includes:

building general plan;

technological maps for the performance of certain types of work (as agreed with the customer);

layouts of geodetic signs;

an explanatory note containing the main decisions, environmental measures; measures for labor protection and safety in construction.

5.7.6 The starting materials for the development of projects for the production of works are:

task for the development issued by the construction organization as the customer of the project for the production of works, with the rationale for the need to develop it for the building (structure) as a whole, its part or type of work and indicating the development time;

construction organization project;

necessary working documentation;

terms of delivery of structures, finished products, materials and equipment, use of construction machines and Vehicle, providing workers for builders in the main professions, using a team contract for the performance of work, production and technological equipment and transportation of building materials, and, if necessary, conditions for organizing construction and performing work on a rotational basis;

materials and results of technical inspection of existing enterprises, buildings and structures during their reconstruction, as well as requirements for the implementation of construction, installation and special construction works in the conditions of existing production.

5.7.7 Solutions for work execution projects should ensure the achievement of the safety of capital construction projects.

In the project for the production of works, deviations from the decisions of the construction organization project without the consent of the organizations that developed and approved it are not allowed.

5.7.8 In the event that a WEP for the construction of this facility is not developed, decisions on labor safety are drawn up in the form of a separate document (documents).

5.7.9 The project for the production of works, developed for the performance of work on the territory of the operating enterprise, must be agreed with the organization operating it.

5.7.10 The project for the production of works using mining, blasting and other potentially hazardous work must also be agreed with the Rostekhnadzor body.

5.7.11 Organizational and technological documentation is subject to archival storage in the prescribed manner.

5.8 The builder (technical customer) must ensure that the geodetic stakeout base is taken to the site by a person who has a certificate issued by a self-regulatory organization for admission to work on the creation of geodetic reference networks.

5.8.1 The accepted signs of the geodetic marking base during the construction process are monitored for safety and are instrumentally checked at least twice a year (in the spring and autumn-winter periods) by the person carrying out the construction.

5.10 The person carrying out the construction should, on the basis of the design documentation, prepare layouts for the axes of buildings and structures that are broken in nature, signs for fixing these axes and mounting landmarks, as well as layouts for structures and their elements relative to these axes and landmarks. Schemes are developed based on the condition that the axes and landmarks, broken in kind, should be technologically accessible for observation while monitoring the accuracy of the position of structural elements at all stages of construction. At the same time, if necessary, it is necessary to correct the existing one or develop a methodology for performing and controlling the accuracy of geodetic marking work, rules for applying and fixing mounting landmarks.

5.12 When preparing for construction and installation work on the territory of existing production facilities, the administration of the developer and the person carrying out the construction appoint a person responsible for the operational management of the work and determine the procedure for coordinated actions. At the same time, they determine and agree on:

volumes, technological sequence, terms of construction and installation works, as well as the conditions for their combination with the work of production shops and sections of the enterprise being reconstructed;

the order of operational management, including the actions of builders and operators, in case of emergency;

the sequence of disassembly of structures, as well as disassembly or transfer engineering networks, places and conditions for connecting temporary networks of water supply, electricity, etc., places of execution executive filming;

recovery order pavement after completion of work related to the need to open it;

the procedure for the use by builders of the services of the enterprise and its technical means;

conditions for organizing the complete and priority supply of equipment and materials, transportation, storage of goods and movement of construction equipment on the territory of the enterprise, as well as the placement of temporary buildings and structures and (or) the use of buildings, structures and premises of an existing production enterprise for the needs of construction.

5.13 Measures to close streets, restrict traffic, change traffic public transport, provided for by the construction plan and agreed upon during its development, before the start of work, they are finally agreed by the developer (customer) with the State Inspectorate for Road Safety of the Internal Affairs Bodies and the institutions of transport and communication of the local government. Once the need for restrictions has ceased, these authorities should be notified.

6 Construction work

6.1 Construction work must be carried out by the person carrying out the construction, in accordance with applicable law, design, working and organizational and technological documentation.

6.2 Site organization

6.2.1 The boundaries of the construction site, the location of permanent and under construction buildings, structures and temporary construction infrastructure are indicated on the construction general plan and situational plan, and for linear objects - in the situational plan and plan of the right of way.

6.2.2 In addition to the land plot owned by the developer, the construction site, if necessary, may additionally include the territories of other (including neighboring) land plots. In such cases, the developer, prior to obtaining a building permit, must obtain the consent of the owners of additional territories for their use, or the necessary easements must be established.

6.2.3 Protection of the construction site, compliance with the requirements for labor protection at the construction site, environmental protection, safety of construction work for the surrounding territory and the population, as well as the fulfillment of various administrative requirements established by this set of rules, other applicable regulatory documents or the local authority self-government, provides the builder. If construction is carried out on the basis of a contract during the entire construction period, the above obligations in accordance with the work contract are performed by the contractor (general contractor).

6.2.5 In the case of construction on the basis of a contract, the developer (technical customer) transfers the construction site to the contractor (general contractor) as the person carrying out the construction, according to the act. The area and condition of the construction site must comply with the terms of the contract. The developer (technical customer) in accordance with applicable law in the cases and in the manner stipulated by the agreement, must transfer to the use of the contractor (general contractor) the buildings and structures necessary for the implementation of work, ensure the transportation of goods to his address, temporary connection of power supply networks, water and steam pipelines.

6.2.5.1 Placement of temporary construction infrastructure on the construction site should provide for:

minimizing temporary construction by maximizing the use of permanent buildings, roads and utility networks;

maximum use of mobile (inventory) buildings and structures to create normal production and living conditions for workers;

the maximum possible laying of all types of temporary networks of engineering and technical support along permanent routes;

optimization of schemes for the delivery of material and technical resources with a minimum amount of reloading work.

6.2.6 The person carrying out the construction must ensure the cleaning of the construction site and the five-meter adjacent area. Household and construction waste, as well as snow, must be removed in a timely manner, on time and in the manner established by the local government.

If it is necessary to temporarily use certain territories not included in the construction site for construction needs that do not pose a danger to the population and the environment, the mode of use, protection (if necessary) and cleaning of these territories is determined by an agreement with the owners of these territories (for public territories - with local government).

6.2.7 If necessary, at the request of the local government, the person carrying out the construction must equip the construction site overlooking the city territory with cleaning or washing points for vehicle wheels at the exits, as well as devices or bins for collecting garbage, and at linear objects - in places specified by the local government.

The suitability of washing points for operation is determined by its compliance with GOST R, and the sanitary and epidemiological conclusion of the Rospotrebnadzor, as well as the act of acceptance into operation at the stage of completion of the preparatory work.

6.2.8 Before the start of any work, the contractor carrying out the construction must fence off the allocated territory of the construction site, the allocated separate territories for the accommodation of builders' camps, areas with hazardous and harmful production factors, areas with material values construction organization(if necessary).

Dangerous zones for workers are allocated on the territory of the construction site with the installation of safety guards and safety signs.

6.2.8.1 At the entrance to the site, information boards should be installed indicating the name of the facility, the name of the developer (technical customer) of the performer of work (contractor, general contractor), names, positions and telephone numbers of the responsible foreman of work on the facility and a representative of the state construction supervision authority (in cases where supervision is carried out) or the local government in charge of construction, the start and end dates of work, the layout of the facility.

The name and telephone number of the performer of the work are also applied on the inventory fencing panels of work places outside the construction site, mobile buildings and structures, large-sized equipment items, cable drums, etc.

At the entrance to the construction site, a fire protection stand is installed indicating the construction, demolition and auxiliary buildings and structures, entrances, entrances, traffic patterns, location of water sources, fire extinguishing equipment.

6.2.9 If the operation of existing and abandoned buildings and structures at the construction site is terminated, the developer must take measures to prevent harm to the population and the environment (communications are turned off, existing containers are emptied, hazardous or toxic substances are removed, etc.). The person carrying out the construction must take measures to prevent unauthorized access to the building by people and animals.

6.2.10 Onsite preparatory work should provide for the acceptance of a geodetic staking base for construction, the release of a construction site for construction and installation works (clearing the territory, demolition of buildings, etc.), planning the territory, artificially lowering (if necessary) the level of groundwater, re-laying existing ones and laying new ones networks of engineering and technical support, arrangement of permanent and temporary roads, inventory temporary fencing of the construction site with the organization, if necessary, of a checkpoint, placement of mobile (inventory) buildings and structures, arrangement of storage areas, organization of communications for operational dispatch control of the production of works, providing the construction site with fire-fighting water supply and inventory, lighting and signaling facilities.

During the preparatory period, permanent buildings and structures for the needs of construction may be erected, or existing ones adapted for these purposes.

On-site preparatory work must be completed before the commencement of construction and installation works.

6.2.11 During the entire period of construction, the person carrying out the construction must provide access to the construction site and the building (structure) under construction for representatives of the construction control of the developer (customer), architectural supervision and state supervision bodies.

6.2.12 The work must be carried out by methods (methods) that do not lead to the emergence of new and (or) intensification of existing hazardous natural processes and phenomena and exclude the threat of harm to human life or health, property of individuals or legal entities, state or municipal property, environment, life and health of animals and plants.

6.2.13 The mechanization of construction, installation and special construction works during the construction of the facility must be comprehensive and carried out with sets of construction machines, equipment, small-scale mechanization, necessary assembly equipment, inventory and fixtures.

The types, characteristics and number of leading and component machines should be adopted in the construction organization project and work production projects based on the design and space-planning solutions of the buildings and structures being erected, the scope of work, the pace and conditions of work (northern and southern regions, mountainous terrain, tightness of the site, etc.), taking into account the existing fleet of machines and the accepted mode of their work at the construction site.

Means of small-scale mechanization, including construction and finishing machines, equipment, tools, technological equipment necessary for the performance of concrete, assembly, stone, plastering, sanitary, waterproofing, painting, glass and other construction works, must be completed in standard sets in accordance with work technology.

The mechanization of construction and installation works during the reconstruction of existing enterprises in cramped conditions should be carried out by using construction machines that have small dimensions and high maneuverability, and in enclosed spaces - an additional electric drive.

6.3 Types of construction and reconstruction work that affect the safety of the capital construction object should be carried out only individual entrepreneurs or legal entities who have certificates of admission to such types of work issued by self-regulatory organizations.

6.4 The person carrying out the construction, reconstruction, organizes and coordinates the work, ensures compliance with the requirements of design and working documentation, technical regulations and safety precautions in the process of performing such work.

6.5 The developer (technical customer) is obliged, when carrying out construction, reconstruction, to ensure that buildings and structures comply with the requirements of energy efficiency and the requirements for equipping them with metering devices for the energy resources used.

6.6 Temporary buildings and structures

6.6.1 Temporary buildings and structures for the needs of construction are erected (installed) at the construction site or in the right of way of linear facilities by the person carrying out the construction, specifically to ensure the construction and after its completion are subject to liquidation. Temporary buildings and structures should basically be mobile (inventory).

Buildings, structures or premises used for the needs of construction, which are part of the construction object, do not belong to temporary ones.

6.6.2 If it is necessary to temporarily use certain territories not included in the construction site for the placement of temporary buildings and structures, the mode of use, protection (if necessary) and cleaning of these territories is determined by agreement with the owners of these territories (for public territories - with the local government) .

6.6.3 Temporary buildings and structures, as well as separate premises in existing buildings and structures adapted for use for construction needs must comply with the requirements of technical regulations and current construction, fire, sanitary and epidemiological norms and rules for domestic, industrial, administrative and residential buildings, structures and premises.

Residential camps of builders, walkways and places of rest for workers should be located outside the danger zones in compliance with the relevant sanitary norms and rules.

During the operation of residential camps, it is necessary to monitor the condition of structures and elements of buildings and utility networks, carry out their maintenance and repair, observe safety regulations and fire safety and hygiene requirements.

During the heating season, the person carrying out the construction is obliged to carry out actions aimed at regulating the consumption of thermal energy in the residential camps of builders, in mobile (inventory) buildings and structures in order to save it.

6.6.4 Temporary buildings and structures located on the construction site or on the territory used by the developer in agreement with its owner are put into operation by the decision of the person carrying out the construction. Commissioning is formalized by an act or an entry in the work log.

6.6.5 Responsibility for the safety of temporary buildings and structures, as well as individual premises in existing buildings and structures adapted for use for the needs of construction, for their technical operation shall be borne by the person carrying out the construction.

6.7 Temporary settlements created for the needs of the construction of the facility are located on the territory of the developer or on the territory used by the developer by agreement with its owner. The project of a temporary settlement should include a master plan tied to the area, the composition of temporary buildings, structures and (or) premises, schemes for electricity, water, heat supply and sewerage, a scheme of access roads for all types of transport used, solutions for ensuring communication. The project of a temporary settlement should also include its demolition, land reclamation, cost estimates for these works.

6.8 In cases where the developer provides for the subsequent transfer of temporary settlements, buildings and structures for permanent operation, projects of temporary settlements, buildings and structures are developed, agreed and approved in the manner established for the design of settlements, buildings and structures intended for permanent use for their intended purpose. The commissioning of such settlements, buildings and structures is carried out in accordance with the procedure established by the legislation on urban planning.

6.9 Disposal (demolition, dismantling) of buildings and structures

6.9.1 Works on recycling (demolition, dismantling) of buildings and structures must be carried out in accordance with the project for the organization of demolition or dismantling, which includes a list of buildings and structures to be demolished, as well as the necessary demolition technical solutions that ensure the safety of builders, population, natural environment and engineering infrastructure, including existing underground utilities.

6.9.2 Recycled buildings and structures from the moment of their decommissioning until the moment of their disposal must be brought into a safe state, excluding accidental harm to the population and the environment (communications must be turned off, existing containers emptied, hazardous or toxic substances removed, fixed or collapsed unstable structures, etc.). Measures must be taken to prevent unauthorized access to these buildings (structures) of people and animals.

6.9.3 All those on the construction site, as well as the organization operating the adjacent territory, must be notified about the moment of explosion, burning or collapse of the demolished building or structure. If necessary, a cordon should be set up.

Prior to the demolition of the facility, technological and special equipment, instrumentation and automation, engineering systems, engineering equipment, sanitary networks, power supply, communications, radio and television systems, as well as finishing elements are dismantled.

6.9.4 The fact of liquidation or demolition of a building or structure must be notified to the relevant accounting and administrative authorities. 6.9.5 The person admitted to the disposal of the object must:

obtain permission from the technical customer for the disposal of the object;

receive from the technical customer documents certifying the disconnection of communications;

issue an organization order that determines the procedure for performing work at the construction site in each shift;

appoint persons responsible for the production of works, fire safety, electrical safety.

A plate with the names of responsible persons is hung out at the construction site in a conspicuous place at the work site.

Corresponding orders must be issued by subcontractors involved in the performance of work.

6.9.6 Prior to the dismantling of buildings and structures, a survey is carried out technical condition structures of the object to establish the danger of collapse of structures, the possibility of reusing structures, the safe production of dismantling works.

6.10 Warehousing and storage of used (purchased and manufactured on our own) materials, products and structures in accordance with the requirements of standards and specifications for these materials, products and structures provides the person carrying out the construction.

If violations of the established rules for warehousing and storage are revealed, the person carrying out the construction must immediately eliminate them. The use of improperly stored and stored materials and products by the person carrying out the construction should be suspended until the issue of the possibility of their use without compromising the quality of construction by the developer (customer) is resolved, with the involvement, if necessary, of representatives of the designer and the state construction supervision body. This decision must be documented.

6.11 When performing work related to the arrangement of temporary excavations and other obstacles on the territory of the existing development, the person carrying out the construction provides the passage of vehicles and access to the facilities by constructing bridges, footbridges with handrails, ladders in agreement with the owner of the territory. After completion of the work, these devices must be removed from the territory, and the landscaping of the territory must be restored.

Places of work must be fenced to prevent unauthorized entry of people and animals.

Places of work, as well as temporary passages and passages should be lit.

Organizational and technological solutions should be focused on minimizing the inconvenience caused by construction work population. To this end, the laying of communications in the urban area along the streets and roads should be carried out according to a schedule that takes into account their simultaneous laying; restoration of landscaping should be carried out on plots with a length, as a rule, no more than one block; restoration work should be carried out in two or three shifts; asphalt concrete waste, construction debris should be removed in a timely manner and in the manner prescribed by the local government.

6.12 Works at the locations of existing underground utilities

6.12.1 Work related to the opening of the surface at the locations of existing underground utilities and structures must be carried out in compliance with the special rules established by the ministries and departments operating these communications, as well as the following additional rules.

6.12.2 In accordance with current rules protection of underground utilities, the responsible work foreman must, no later than three working days, call to the place of work representatives of organizations operating existing underground utilities and structures, and in their absence, representatives of organizations that have agreed on project documentation.

In the absence of communications and structures operated by them at the specified place of work, the relevant organizations are obliged to officially notify the person carrying out the construction about this.

6.12.3 Arriving at the site, representatives of operating organizations are presented with design and working documentation and the axes or dimensions of the intended excavation made in nature. Together with the operating organization, the actual position of existing underground utilities and structures is determined on site (by drilling or otherwise), marked on the ground and applied to the working drawings. Representatives of the operating organizations shall hand over to the person carrying out the construction instructions on measures to ensure the safety of existing underground utilities and structures and on the need to call them to inspect hidden work and at the time of backfilling of the excavations.

Organizations that did not appear and did not notify of the absence of communications and facilities operated by them at the place of work are called again the day before with simultaneous notification of local governments that decide on next steps in case of repeated non-appearance of representatives of these organizations. No work can be started until a decision has been made.

The responsible work foreman is obliged to instruct the driver of the earth-moving machine on the procedure for excavation and to designate, with signs clearly visible from the cab, the boundaries of the zone within which mechanized excavation is allowed. The remaining mass of soil, directly adjacent to the underground structure, is developed manually.

6.13 The person carrying out the construction, in accordance with the legislation on urban planning, must maintain executive documentation:

certificates of examination of the geodetic center base of the capital construction object;

acts of breakdown of the axes of the capital construction object on the ground;

certificates of examination of hidden works;

certificates of examination of critical structures;

certificates of examination of sections of engineering and technical support networks;

a set of working drawings with inscriptions on the compliance of the work performed in kind with these drawings or on the changes made to them in agreement with the designer, made by persons responsible for the construction and installation works;

executive geodetic schemes and drawings;

executive diagrams and profiles of sections of engineering and technical support networks;

acts of testing and testing of technical devices;

the results of examinations, examinations, laboratory and other tests of the work performed, carried out in the process of construction control;

documents confirming the quality control of the building materials (products) used;

other documents reflecting the actual execution of design decisions.

Requirements for the preparation and procedure for maintaining executive documentation are established Federal Service for Environmental, Technological and Nuclear Supervision.

Executive documentation is subject to permanent storage with the developer (technical customer). At the time of the final inspection, the executive documentation is transferred to the state construction supervision body.

6.14 As soon as the works and structures are ready, the quality indicators of which affect the safety of the building (structure), and if, in accordance with the construction technology, these indicators cannot be controlled after the completion of subsequent work, the person carrying out the construction, within the agreed time, but no later than than three working days notify the developer (customer), representatives of authorities state control(supervision) and architectural supervision on the timing of the implementation of the relevant conformity assessment procedure.

The shortcomings identified by such a procedure must be eliminated with the preparation of appropriate acts.

Until the identified deficiencies are eliminated and the relevant acts are drawn up, further work is unacceptable.

6.15 Termination of construction and conservation of the facility

6.15.1 If it is necessary to stop work on the construction of the facility or suspend it for a period of more than 6 months. conservation of the object should be carried out - bringing the object and the territory used for construction to a state that ensures the strength, stability and safety of the main structures and the safety of the object for the population and the environment.

6.15.2 The decision to stop or suspend construction is made by the builder and notifies decision a person carrying out construction (when carrying out construction on the basis of a contract), a local self-government body, as well as the relevant state supervision bodies. The developer is responsible for the safety of the facility, the construction of which has been terminated or suspended.

6.15.3 The fact of termination or suspension of construction within three days must be notified, if necessary, to the traffic police of the internal affairs bodies in order to cancel the previously imposed restrictions on the movement of vehicles and pedestrians, as well as the owners of territories included in the territory of the construction site.

When carrying out construction on the basis of a contract, the developer (customer) and the person carrying out construction when carrying out construction on the basis of a contract, no later than a month later, draw up an act of acceptance of the completed part of the object with a description of the state of the object, indicating the volume and cost of work performed, a list of applied (mounted ) at the facility of equipment, materials and structures, a list of unused and subject to storage equipment, materials and structures, a list of works necessary for the safety of the facility and unused equipment, materials and structures.

6.15.4 If necessary, the designer, under an agreement with the developer (customer), develops working documentation and an estimate for the conservation of the object, and the person carrying out the construction performs the work provided for by these working documentation and estimates.

6.15.5 The mothballed object and the construction site during the construction on the basis of the contract are transferred under the act to the developer ( technical customer). The act is accompanied by as-built documentation, work logs, as well as documents on surveys, inspections, control tests, measurements carried out during construction, documents of suppliers confirming the compliance of materials, works, structures, process equipment and engineering systems object to the project and the requirements of regulatory documents.

7 Construction control and construction supervision

7.1 Construction participants - the person carrying out the construction, the developer (customer), the designer - must exercise construction control, provided for by the legislation of the Russian Federation on urban planning, in order to assess the compliance of construction and installation works, structures being erected, systems and networks of engineering and technical support of the building or constructions to the requirements of technical regulations, design and working documentation.

The person carrying out construction, as part of construction control, performs:

input control of project documentation provided by the developer (customer);

survey of the geodetic center base of the capital construction object;

input control of applied building materials, products, structures and equipment;

operational control during and after completion of construction and installation operations;

examination of the work performed, the results of which become unavailable for control after the start of the subsequent work;

examination of critical building structures and sections of engineering and technical support systems;

testing and testing of technical devices.

Construction control of the developer (customer) in accordance with applicable law is carried out in the form of control and supervision of the customer over the performance of work under a construction contract according to 7.3.

7.1.7 To perform operational quality control, documents containing:

a list of operations or processes that are subject to verification in terms of quality indicators;

drawings of structures indicating the allowable deviations in dimensions, the required measurement accuracy, as well as the materials used;

places of control, their frequency, methods, performers, measuring instruments and forms for recording results.

7.2 During the construction process, an assessment should be made of the work performed, the results of which affect the safety of the facility, but, in accordance with the accepted technology, become inaccessible for control after the start of the subsequent work, as well as the completed building structures and sections of engineering and technical support networks, the elimination of defects of which, identified by control, it is impossible without disassembly or damage to subsequent structures and sections of engineering networks. In the indicated control procedures representatives of the relevant state supervision bodies, architectural supervision, as well as, if necessary, independent experts may participate. The person carrying out the construction, within the terms agreed, but no later than three working days, notifies the other participants of the terms of the specified procedures.

7.2.1 The results of the survey of work hidden by subsequent work, in accordance with the requirements of the design and regulatory documentation, are documented in certificates of survey of hidden work,. The developer (technical customer) may require a re-examination after the identified defects have been eliminated.

7.2.2 To the procedure for assessing the conformity of individual structures, tiers of structures (floors), the person carrying out the construction must submit certificates of survey of all hidden works that are part of these structures, geodetic executive schemes, as well as test reports for structures in cases provided for by the design documentation and (or) a building contract. The developer (technical customer) can perform verification of the reliability of the executive geodetic schemes submitted by the contractor. For this purpose, the person carrying out the construction must keep the stakeout axes and installation landmarks fixed in kind until the acceptance is completed.

The results of the survey of individual structures should be documented in certificates of survey of critical structures.

7.2.3 Testing sections of engineering networks and installed engineering equipment are carried out in accordance with the requirements of the relevant regulatory documents and are drawn up by the relevant acts.

7.2.4 If, as a result of construction control, defects in works, structures, sections of engineering and technical support networks are detected, the relevant acts should be drawn up only after the identified defects have been eliminated.

In cases where subsequent work must begin after a break of more than six months from the moment the phased acceptance is completed, these procedures should be repeated before the resumption of work with the execution of the relevant acts.

7.3 Construction control of the customer is performed by:

verification that the person carrying out the construction has quality documents (certificates in established cases) for the materials, structural products and equipment used by him, documented results of input control and laboratory tests;

monitoring compliance by the person carrying out the construction with the rules for warehousing and storage of materials used, structural products and equipment; upon detection of violations of these rules, a representative of the construction control of the developer (customer) may prohibit the use of improperly stored and stored materials;

control of compliance of the person carrying out the construction with operational control with the requirements of 7.1.6;

control of the availability and correctness of the maintenance by the person carrying out the construction of as-built documentation, including the assessment of the reliability of geodesic executive schemes of the completed structures with selective control of the accuracy of the position of the elements;

control over the elimination of defects in the design documentation identified during the construction process, documented return of defective documentation to the designer, control and documented acceptance of the corrected documentation, its transfer to the person carrying out the construction;

control over the execution by the person carrying out the construction of the instructions of state supervision bodies and local self-government;

notification of state supervision authorities of all cases of emergency at the construction site;

assessment (together with the person carrying out the construction) of the compliance of the work performed, structures, sections of engineering and technical support networks, signing of bilateral acts confirming compliance; control over the fulfillment by the person carrying out the construction of the requirement on the inadmissibility of performing subsequent work before the signing of these acts;

final assessment (together with the person carrying out the construction) of the compliance of the completed facility with the requirements of the legislation, design and regulatory documentation.

7.3.1 Mandatory assessment of the conformity of buildings and structures, as well as the processes of design (including surveys), construction, installation, adjustment and disposal (demolition, dismantling) related to buildings and structures, is carried out in the form of:

statements on the compliance of project documentation with the requirements;

state examination of the results of engineering surveys and project documentation;

construction control;

state construction supervision;

statements on the conformity of the constructed, reconstructed or repaired building or structures with the design documentation;

statements on the conformity of the constructed, reconstructed or repaired building or structure with the requirements;

putting the object into operation.

7.4 During the construction of hazardous production facilities, as well as especially dangerous technically complex and unique facilities, the designer's supervision is carried out. In other cases, it is carried out at the discretion of the developer (customer). The procedure for implementation and functions of architectural supervision are established by SP 246.1325800.

7.5 The comments of the representatives of the building control of the developer (customer) are documented in the general and special journals of work, the comments of the representatives of architectural supervision - in the journal of architectural supervision. The facts of elimination of defects according to the comments of these representatives are documented with their participation.

7.6 Architectural supervision of the architect is carried out by the author-architect on an initiative basis, regardless of the decision of the developer (technical customer) and the existence of a construction supervision agreement. The territorial authority for architecture and urban planning, at the request of the author, having verified his authorship, may issue an order to the developer (technical customer) to ensure the author's admission to the construction site, the possibility of making entries in the author's supervision journal. The claims of the author-architect regarding the implementation of architectural design solutions may be considered by the urban planning and architecture authority, whose decision is binding on the developer (technical customer).

7.7 State construction supervision is carried out in the cases provided for by the legislation on urban planning activities in accordance with the legislation of the Russian Federation on urban planning activities and other regulatory legal acts , .

State construction supervision authorities assess the compliance of the construction process of a particular facility upon receipt of a notice from the developer (customer) about the start of construction work.

7.8 In order to limit the adverse impact of construction and installation works on the population and the territory in the zone of influence of ongoing construction, local governments or organizations authorized by them (administrative inspections, etc.) in the manner prescribed by current legislation conduct administrative control over construction.

Administrative control consists in preliminary setting the conditions for construction (the size of the construction site fence, temporary work schedule, garbage removal, maintaining order in the adjacent territory, etc.) and monitoring compliance with these conditions during construction. The builder is responsible to the local self-government body, unless otherwise provided by the contracts.

The conditions for conducting construction are established in the form of an order or other document issued by the local administration or organizations authorized by it in accordance with the regulatory legal acts of the constituent entities of the Russian Federation.

This set of rules applies to the construction of new, reconstruction and demolition of existing buildings and structures (hereinafter referred to as construction), erected on the basis of a building permit obtained in the prescribed manner, as well as to landscaping and engineering training territories.

During the construction of linear structures, power lines, communications, pipelines and other technical infrastructure facilities, as well as in the right-of-way railways, in the right of way of motor roads and other transport routes, the requirements of the current regulatory documents must be additionally taken into account.

With regard to the objects of the military infrastructure of the Armed Forces of the Russian Federation, objects, information about which constitutes a state secret, objects of production, processing, storage of radioactive and explosive substances and materials, objects for the storage and destruction of chemical weapons and explosives, other objects for which requirements are established related to ensuring nuclear and radiation safety in the field of the use of atomic energy, the requirements established by government customers, federal executive authorities authorized in the field of ensuring the security of these facilities, and government contracts(contracts).

The document does not apply to buildings and structures, the construction of which, in accordance with the legislation on urban planning, can be carried out without a building permit, as well as to objects of individual housing construction, erected by developers (individuals) on their own, including with the involvement of hired workers, on their land plots.

The document also does not apply to the production of materials, products and structures at the enterprises of the construction industry and the building materials industry.

3 Terms and definitions

This set of rules mainly adopts the terms and definitions of the Technical Regulations on the safety of buildings and structures.

4 General provisions

4.1 The construction of buildings and structures is carried out in the presence of a construction permit obtained in accordance with the legislation on urban planning.

Lists of buildings and structures for the construction of which a building permit is not required are established by the legislation on urban planning.

4.2 The actions of the construction participants, the work performed during the construction process, their results, including buildings and structures completed by construction, must meet the requirements of the current legislation, design and working documentation, town planning plans for land plots.

4.3 The developer must ensure the performance of all functions specified in 4.4, 4.6 and not assigned by contracts to other participants in the construction.

4.4 The basic functions of the developer are:

obtaining a building permit;

obtaining the right to limited use of neighboring land plots (servitudes) for the duration of construction;

engagement of a contractor (general contractor) for the implementation of works on the construction of a building or structure as a person carrying out the construction, in the event that work is carried out under the contract;

providing construction with project documentation that has passed the examination and approved in the prescribed manner;

ensuring the stakeout of building regulation lines and the creation of a geodetic staking base;

notification of the start of any work at the construction site of the state construction supervision body, which controls this object;

ensuring construction control of the developer (customer);

acceptance of the completed construction object in the event of work under the contract;

organization of adjustment and testing of equipment, trial production of products and other measures to prepare the facility for operation;

making decisions on the start, suspension, conservation, termination of construction, on the commissioning of a completed property;

presentation of the construction object completed by the construction to the bodies of state construction supervision and environmental supervision (in cases provided for by the legislation on urban planning activities);

presentation of the completed construction object to the authorized body for commissioning;

acquisition, storage and transfer of executive and operational documentation to the relevant organizations.

4.5 The developer to perform its functions to ensure the construction of project documentation that has passed the examination and approved in the prescribed manner, upon obtaining a construction permit, its functions of the customer in the construction on the basis of the contract, to perform construction control of the customer, as well as to interact with state supervision authorities and local self-government may involve, in accordance with the current legislation, a specialized organization or a specialist of the appropriate qualification.

The transfer by the developer of its functions to an involved organization or specialist is formalized by an agreement between them.

4.6 When construction is carried out on the basis of a contract, the basic organizational functions of the contractor (general contractor) as a person carrying out construction are:

performance of works, structures, systems of engineering and technical support of the construction object in accordance with the design and working documentation;

development and application of organizational and technological documentation;

implementation of construction control of the person carrying out the construction, including control over the compliance of the building materials and products used with the requirements of technical regulations, design and working documentation;

maintenance of executive documentation;

ensuring labor safety at the construction site, safety of construction work for the environment and the population;

construction site management, including ensuring the protection of the construction site and the safety of the facility until it is accepted by the developer (customer);

compliance with the requirements of the local administration, acting within its competence, to maintain order in the territory adjacent to the construction site.

4.7 The basic function of the person who prepared the project documentation (hereinafter referred to as the designer) during the construction process is to make changes in the established order to the design estimates and working documentation in the event of a change after the start of construction of the urban planning plan of the land plot or existing regulatory documents (performed as an additional work).

Additional organizational functions of the designer during the construction process, performed in accordance with agreements between construction participants, are:

making changes to the design and estimate documentation in connection with the need to take into account the technological capabilities of the contractor;

development of additional design solutions in connection with the need to ensure production;

coordination of the allowed deviations from the working documentation, including the adoption of decisions on the possibility of using non-conforming products.

4.8 Construction in accordance with the current legislation is carried out under the control of local governments and state construction supervision. To ensure this possibility, the said authorities must be notified in advance by the developer (customer) about the timing of the start of work at the construction site, about the suspension, conservation and (or) termination of construction, about the readiness of the facility for commissioning.

4.9 Upon completion of the construction of a building or structure, its compliance with the requirements of the current legislation, technical regulations, design and working documentation, its acceptance during construction on the basis of a contract, as well as the commissioning of the completed building or structure are carried out.

4.10 Construction control carried out by construction participants must be carried out in accordance with the Federal Law of June 26, 2008 N 102-FZ "On Ensuring the Uniformity of Measurements" using measuring instruments of an approved type that have been tested, according to certified procedures (methods) when necessary measurements. Routine tests and measurements must be carried out by qualified personnel.

5 Construction preparation

5.1 In order to carry out construction on the basis of a contract, the developer (customer) engages a contractor (general contractor) to perform work in accordance with the current legislation as a person carrying out construction.

5.2 Construction participants (legal entities) by their administrative documents (orders) appoint officials personally responsible for the construction:

developer (customer) - a responsible representative of the construction control of the developer (customer);

the person carrying out the construction (contractor, general contractor) - the responsible work producer;

the person who prepared the project documentation (designer) - the responsible representative of architectural supervision in cases where architectural supervision is carried out.

These officials must be qualified in accordance with the requirements of the current legislation.

During the construction of a building or structure by a legal entity performing the functions of a developer (customer) and a person carrying out construction (contractor), these officials are appointed by the head of this organization. At the same time, the combination of the functions of the responsible work foreman and the responsible representative of the construction control of the developer (customer) by one unit or official of this organization is unacceptable.

5.3 The person carrying out the construction, in accordance with the current legislation, must have certificates issued by a self-regulatory organization on admission to the types of work that affect the safety of the building or structure being erected.

5.4 When carrying out construction on the basis of a contract, the developer (customer) transfers to the person carrying out the construction the project documentation approved by him, as well as working documentation for the entire facility or for certain stages of work in two copies on electronic and paper media. The design and working documentation must be approved for work by the developer (customer) with the signature of the responsible person by putting a stamp on each sheet. The composition and content of sections of project documentation (including a construction organization project) transferred to a person carrying out construction must comply with the requirements established by the Government of the Russian Federation (Appendix A). The transferred design documentation must contain the assurance of the designer that this documentation has been developed in accordance with the design assignment and the requirements of the Federal Law of December 30, 2009 N 384-FZ "Technical Regulations on the Safety of Buildings and Structures".

5.5 The person carrying out the construction performs the input control of the working documentation transferred to him for execution, transfers to the developer (customer) a list of the shortcomings identified in it, checks their elimination. The term for the implementation of the input control of project documentation is established in the contract.

At the same time, the person carrying out the construction can check the feasibility of implementing the project using known methods, determining, if necessary, the need to develop new technological methods and equipment, as well as the possibility of acquiring materials, products and equipment, the use of which is provided for by the project documentation, and the compliance of the actual location indicated in design documentation of places and conditions for connecting temporary engineering communications (networks) to external networks of engineering and technical support to provide the construction site with electricity, water, heat, steam.

5.6 The conditions for fulfillment in the process of construction of the requirements of legislation on the protection of labor, the environment and the population, as well as the possibility of performing all types of control necessary to assess the compliance of the work performed with the requirements of design, regulatory documentation and (or) the terms of the contract, are established by the projects of the organization of construction and organizational and technological documentation.

5.7 Design preparation of construction organization and organizational and technological documentation

5.7.1 Solutions for the organization of construction for industrial and non-industrial facilities are developed in projects for the organization of construction and projects for the organization of work for the demolition or dismantling of capital construction projects. Solutions for the organization of construction for linear facilities are developed in projects for the organization of construction and projects for the organization of work on the demolition (dismantling) of a linear facility. Projects for the organization of construction, projects for the organization of work on the demolition or dismantling of capital construction projects, projects for the organization of work on the demolition (dismantling) of a linear facility (hereinafter referred to as construction organization projects, POS) are an integral and integral part of the project documentation. Construction organization projects are a mandatory document for the developer (customer), contractors, as well as organizations providing financing and logistics.

The choice of decisions on the organization of construction should be carried out on the basis of variant study with the wide use of criteria-based assessment methods, modeling methods and modern computer systems.

5.7.2 Organizational and technological documentation includes a project for the production of works, as well as other documents that contain decisions on the organization of construction production and the technology of construction and installation works, drawn up, agreed, approved and registered in accordance with the rules in force in organizations developing approving and coordinating these documents.

5.7.4 The project for the production of works in full must be developed:

during any construction in the urban area;

during any construction on the territory of an operating enterprise;

during construction in difficult natural and geological conditions, as well as technically especially complex objects - at the request of the authority issuing a permit for construction or for the performance of construction, installation and special works.

In other cases, the PPR is developed by decision of the person carrying out the construction in an incomplete volume.

5.7.5 The project for the production of works in full includes:

calendar plan for the production of works on the object;

the schedule for the receipt of building structures, products, materials and equipment at the facility;

the schedule of the movement of workers on the object;

the schedule of movement of the main construction machines around the facility;

technological maps for the performance of types of work;

an explanatory note containing decisions on the production of geodetic works, decisions on the laying of temporary networks of water, heat, power supply and lighting of the construction site and workplaces; justification and measures for the use of mobile forms of work organization, work and rest regimes; work decisions, including winter time; the need for energy resources; the need and binding of camps of builders and mobile (inventory) buildings; measures to ensure the safety of materials, products, structures and equipment at the construction site; environmental protection measures; measures for labor protection and safety in construction; technical and economic indicators.

The project for the production of works in an incomplete scope includes:

building master plan;

technological maps for the performance of certain types of work (as agreed with the customer);

layouts of geodetic signs;

an explanatory note containing the main decisions, environmental measures; measures for labor protection and safety in construction.

5.7.6 The starting materials for the development of projects for the production of works are:

task for the development issued by the construction organization as the customer of the project for the production of works, with the rationale for the need to develop it for the building (structure) as a whole, its part or type of work and indicating the development time;

construction organization project;

necessary working documentation;

conditions for the supply of structures, finished products, materials and equipment, the use of construction machines and vehicles, the provision of workers for builders in the main professions, the use of a team contract for the performance of work, production and technological equipment and transportation of building materials, and, if necessary, also the conditions for organizing construction and performance of work on a rotational basis;

materials and results of technical inspection of existing enterprises, buildings and structures during their reconstruction, as well as requirements for the implementation of construction, installation and special construction works in the conditions of existing production.

5.7.7 Solutions for work execution projects should ensure the achievement of the safety of capital construction projects.

In the project for the production of works, deviations from the decisions of the construction organization project without the consent of the organizations that developed and approved it are not allowed.

5.7.8 If the WEP for the construction of this facility is not developed, safety decisions are drawn up in the form of a separate document (documents).

5.7.9 The project for the production of works on the territory of the operating enterprise must be agreed with the organization operating it.

5.7.10 The project for the production of works using mining, blasting and other potentially hazardous work must also be agreed with the Rostekhnadzor body.

5.8 The builder (customer) must ensure the removal of the geodetic staking base to the site by a person who has a certificate issued by a self-regulatory organization for admission to work on the creation of geodetic reference networks.

5.9 The person carrying out the construction should check whether the organizational and technological documentation used by him contains instructions on conducting construction control.

5.10 The person carrying out the construction should, on the basis of the design documentation, prepare layouts for the axes of buildings and structures that are broken in nature, signs for fixing these axes and mounting landmarks, as well as layouts for structures and their elements relative to these axes and landmarks. Schemes are developed based on the condition that the axes and landmarks, broken in kind, should be technologically accessible for observation while monitoring the accuracy of the position of structural elements at all stages of construction. At the same time, if necessary, it is necessary to correct the existing one or develop a methodology for performing and controlling the accuracy of geodetic marking work, rules for applying and fixing mounting landmarks.

5.11 The person carrying out the construction, if necessary, should train the personnel, as well as conclude contracts with accredited laboratories for the performance of those types of tests that the contractor cannot perform on his own.

5.12 When preparing for construction and installation work on the territory of existing production facilities, the administration of the developer and the person carrying out the construction appoint a person responsible for the operational management of the work and determine the procedure for coordinated actions. At the same time, they determine and agree on:

volumes, technological sequence, terms of construction and installation works, as well as the conditions for their combination with the work of production shops and sections of the enterprise being reconstructed;

the order of operational management, including the actions of builders and operators, in case of emergency;

the sequence of disassembly of structures, as well as the dismantling or transfer of engineering networks, places and conditions for connecting temporary networks of water supply, electricity, etc., places for performing executive surveys;

the procedure for the use by builders of the services of the enterprise and its technical means;

conditions for organizing the complete and priority supply of equipment and materials, transportation, storage of goods and movement of construction equipment on the territory of the enterprise, as well as the placement of temporary buildings and structures and (or) the use of buildings, structures and premises of an existing production enterprise for the needs of construction.

5.13 Measures to close streets, restrict traffic, change the movement of public transport, provided for by the construction plan and agreed upon during its development, before starting work, are finally agreed by the developer (customer) with the State Inspectorate for Road Safety of the internal affairs bodies and transport and communication institutions of the local government. Once the need for restrictions has ceased, these authorities should be notified.

6 Construction work

6.1 Construction work must be carried out by the person carrying out the construction, in accordance with applicable law, design, working and organizational and technological documentation.

6.2 Construction site

6.2.1 The boundaries of the construction site must be indicated on the building plan and situational plan, and for linear objects - indicated in the form of the width of the right of way.

6.2.2 In addition to the land plot owned by the developer, the construction site, if necessary, may additionally include the territories of other (including neighboring) land plots. In such cases, the developer, prior to obtaining a building permit, must obtain the consent of the owners of additional territories for their use, or the necessary easements must be established.

6.2.3 Protection of the construction site, compliance with the requirements for labor protection at the construction site, environmental protection, safety of construction work for the surrounding territory and the population, as well as the fulfillment of various administrative requirements established by these standards, other applicable regulatory documents or local government provided by the developer.

6.2.4 In the case of construction on the basis of a contract, during the entire construction period, the obligations stipulated in 6.2.3 in accordance with the work contract are performed by the contractor (general contractor).

6.2.5 In the case of construction on the basis of a contract, the developer (customer) transfers the construction site to the contractor (general contractor) as the person carrying out the construction, according to the act. The area and condition of the construction site must comply with the terms of the contract. The developer (customer), in accordance with applicable law, in the cases and in the manner prescribed by the contract, must transfer to the contractor (general contractor) the buildings and structures necessary for the implementation of work, ensure the transportation of goods to his address, temporary supply of power supply networks, water and steam pipeline.

6.2.6 The person carrying out the construction must ensure the cleaning of the construction site and the five-meter adjacent area. Household and construction waste, as well as snow, must be removed in a timely manner, on time and in the manner established by the local government.

6.2.7 If necessary, at the request of the local government, the person carrying out the construction must equip the construction site overlooking the city territory with cleaning or washing points for vehicle wheels at the exits, as well as devices or bins for collecting garbage, and at linear objects - in places specified by the local government.

If it is necessary to temporarily use certain territories not included in the construction site for construction needs that do not pose a danger to the population and the environment, the mode of use, protection (if necessary) and cleaning of these territories is determined by an agreement with the owners of these territories (for public territories - with local government).

6.2.8 The person carrying out the construction, before the start of any work, must enclose the construction site and hazardous areas of work outside it in accordance with the requirements of regulatory documents.

At the entrance to the site, information boards should be installed indicating the name of the object, the name of the developer (customer), the performer of the work (contractor, general contractor), the names, positions and telephone numbers of the responsible foreman of work on the facility and the representative of the state construction supervision authority (in cases where supervision is carried out) or local government in charge of construction, the start and end dates of work, the scheme of the object.

The name and telephone number of the performer of the work are also applied on the inventory fencing panels of work places outside the construction site, mobile buildings and structures, large-sized equipment items, cable drums, etc.

6.2.9 If the operation of existing and abandoned buildings and structures at the construction site is terminated, the developer must take measures to prevent harm to the population and the environment (communications are turned off, existing containers are emptied, hazardous or toxic substances are removed, etc.). The person carrying out the construction must take measures to prevent unauthorized access to the building by people and animals.

6.2.10 On-site preparatory work must be completed prior to the commencement of construction and installation works in accordance with the work execution plan.

6.2.11 During the entire period of construction, the person carrying out the construction must provide access to the construction site and the building (structure) under construction for representatives of the construction control of the developer (customer), architectural supervision and state supervision bodies.

6.3 In cases where construction is carried out on a territory exposed to adverse natural phenomena and geological processes (mudflows, avalanches, landslides, landslides, waterlogging, flooding, etc.), before the commencement of construction work on special projects carry out priority measures and work to protect the territory from these processes.

6.4 Co-development natural resources can be conducted in the presence of the appropriate agreed and duly approved documentation.

6.5 In the event that objects of historical, cultural or other value are discovered during the work, the person carrying out the construction suspends the ongoing work and notifies the institutions and authorities provided for by law about the discovered objects.

6.6 Temporary buildings and structures

6.6.1 Temporary buildings and structures for the needs of construction are erected (installed) at the construction site or in the right of way of linear facilities by the person carrying out the construction, specifically to ensure the construction and after its completion are subject to liquidation. Temporary buildings and structures should mainly be inventory.

Buildings, structures or premises used for the needs of construction, which are part of the construction object, do not belong to temporary ones.

6.6.2 If it is necessary to temporarily use certain territories not included in the construction site for the placement of temporary buildings and structures, the mode of use, protection (if necessary) and cleaning of these territories is determined by agreement with the owners of these territories (for public territories - with the local government) .

6.6.3 Temporary buildings and structures, as well as individual premises in existing buildings and structures adapted for use for construction needs, must comply with the requirements of technical regulations and applicable construction, fire, sanitary and epidemiological standards and rules for household, industrial, administrative and residential buildings, structures and premises.

6.6.4 Temporary buildings and structures located on the construction site or on the territory used by the developer in agreement with its owner are put into operation by the decision of the person carrying out the construction. Commissioning is formalized by an act or an entry in the work log.

6.6.5 Responsibility for the safety of temporary buildings and structures, as well as individual premises in existing buildings and structures adapted for use for the needs of construction, for their technical operation shall be borne by the person carrying out the construction.

6.7 Temporary settlements created for the needs of the construction of the facility are located on the territory of the developer or on the territory used by the developer by agreement with its owner. The project of a temporary settlement should include a master plan tied to the area, the composition of temporary buildings, structures and (or) premises, schemes for electricity, water, heat supply and sewerage, a scheme of access roads for all types of transport used, solutions for ensuring communication. The project of a temporary settlement should also include its demolition, land reclamation, cost estimates for these works.

6.8 In cases where the developer provides for the subsequent transfer of temporary settlements, buildings and structures for permanent operation, projects of temporary settlements, buildings and structures are developed, agreed and approved in the manner established for the design of settlements, buildings and structures intended for permanent use for their intended purpose. The commissioning of such settlements, buildings and structures is carried out in accordance with the procedure established by the legislation on urban planning.

6.9 Liquidation and demolition of buildings and structures

6.9.1 Work on the liquidation and demolition of buildings and structures must be carried out in accordance with the project for the organization of work on demolition or dismantling, which includes a list of buildings and structures to be demolished, as well as the necessary technical demolition solutions that ensure the safety of builders, the public, the environment natural environment and engineering infrastructure, including existing underground utilities.

6.9.2 Liquidated buildings and structures from the moment of their decommissioning until the moment of their liquidation (demolition) must be brought to a safe state, excluding accidental harm to the population and the environment (communications must be turned off, existing containers emptied, dangerous or poisonous substances, unstable structures are fixed or collapsed, etc.). Measures must be taken to prevent unauthorized access to these buildings (structures) of people and animals.

6.9.3 All those on the construction site, as well as the organization operating the adjacent territory, must be notified about the moment of explosion, burning or collapse of the demolished building or structure. If necessary, a cordon should be set up.

6.9.4 The fact of liquidation or demolition of a building or structure must be notified to the relevant accounting and administrative authorities. At the same time, the bodies - holders of territorial geofunds, in the manner established by them, must be notified of the communications, premises, structures and structures remaining in the land.

6.10 Warehousing and storage of materials, products and structures used (purchased and manufactured on their own) in accordance with the requirements of standards and specifications for these materials, products and structures shall be provided by the person carrying out the construction.

If violations of the established rules for warehousing and storage are revealed, the person carrying out the construction must immediately eliminate them. The use of improperly stored and stored materials and products by the person carrying out the construction should be suspended until the issue of the possibility of their use without compromising the quality of construction by the developer (customer) is resolved, with the involvement, if necessary, of representatives of the designer and the state construction supervision body. This decision must be documented.

6.11 When carrying out work related to the arrangement of temporary excavations and other obstacles on the territory of the existing building, the person carrying out the construction provides the passage of vehicles and access to houses by constructing bridges, footbridges with handrails, ladders in agreement with the owner of the territory. After completion of the work, these devices must be removed from the territory, and the landscaping of the territory must be restored.

Places of work must be fenced to prevent unauthorized entry of people and animals.

Places of work, as well as temporary passages and passages should be lit.

Organizational and technological solutions should be focused on minimizing the inconvenience caused by construction work to the population. To this end, the laying of communications in the urban area along the streets and roads should be carried out according to a schedule that takes into account their simultaneous laying; restoration of landscaping should be carried out on plots with a length, as a rule, no more than one block; restoration work should be carried out in two or three shifts; asphalt concrete waste, construction debris should be removed in a timely manner and in the manner prescribed by the local government.

6.12 Works at the locations of existing underground utilities

6.12.1 Work related to the opening of the surface at the locations of existing underground utilities and structures must be carried out in compliance with the special rules established by the ministries and departments operating these communications, as well as the following additional rules.

6.12.2 In accordance with the current rules for the protection of underground utilities, the responsible work foreman must, no later than three working days, call to the place of work representatives of organizations operating existing underground utilities and structures, and in their absence, representatives of organizations that have agreed on project documentation.

In the absence of communications and structures operated by them at the specified place of work, the relevant organizations are obliged to officially notify the person carrying out the construction about this.

6.12.3 Arriving at the site, representatives of operating organizations are presented with design and working documentation and the axes or dimensions of the intended excavation made in nature. Together with the operating organization, the actual position of existing underground utilities and structures is determined on site (by drilling or otherwise), marked on the ground and applied to the working drawings. Representatives of the operating organizations shall hand over to the person carrying out the construction instructions on measures to ensure the safety of existing underground utilities and structures and on the need to call them to inspect hidden work and at the time of backfilling of the excavations.

Organizations that did not appear and did not notify of the absence of communications and facilities operated by them at the work site are called again a day in advance with simultaneous notification of local authorities, which decide on further actions in case of repeated failure of representatives of these organizations. No work can be started until a decision has been made.

The responsible work foreman is obliged to instruct the driver of the earth-moving machine on the procedure for excavation and to designate, with signs clearly visible from the cab, the boundaries of the zone within which mechanized excavation is allowed. The remaining mass of soil, directly adjacent to the underground structure, is developed manually.

6.13 The person carrying out the construction, in accordance with the legislation on urban planning, must maintain executive documentation:

certificates of examination of the geodetic center base of the capital construction object;

acts of breakdown of the axes of the capital construction object on the ground;

certificates of examination of hidden works;

certificates of examination of critical structures;

certificates of examination of sections of engineering and technical support networks;

a set of working drawings with inscriptions on the compliance of the work performed in kind with these drawings or on the changes made to them in agreement with the designer, made by persons responsible for the construction and installation works;

executive geodetic schemes and drawings;

executive diagrams and profiles of sections of engineering and technical support networks;

acts of testing and testing of technical devices;

the results of examinations, examinations, laboratory and other tests of the work performed, carried out in the process of construction control;

documents confirming the quality control of the building materials (products) used;

other documents reflecting the actual execution of design decisions.

Requirements for the preparation and maintenance of as-built documentation are established by the Federal Service for Environmental, Technological and Nuclear Supervision.

6.14 As soon as the works and structures are ready, the quality indicators of which affect the safety of the building (structure), and if, in accordance with the construction technology, these indicators cannot be controlled after the completion of subsequent work, the person carrying out the construction, within the agreed time, but no later than than three working days notify the developer (customer), representatives of state control (supervision) and architectural supervision of the timing of the implementation of the relevant conformity assessment procedure.

The shortcomings identified by such a procedure must be eliminated with the preparation of appropriate acts.

Until the identified deficiencies are eliminated and the relevant acts are drawn up, further work is unacceptable.

6.15 Termination of construction and conservation of the facility

6.15.1 If it is necessary to stop construction of the facility or suspend it for a period of more than 6 months, conservation of the facility should be carried out - bringing the facility and the territory used for construction to a state that ensures the strength, stability and safety of the main structures and the safety of the facility for the population and the environment environment.

6.15.2 The decision to stop or suspend construction is made by the builder and notifies the person carrying out the construction (when construction is carried out on the basis of a contract), the local government body, as well as the relevant state supervision bodies about the decision. The developer is responsible for the safety of the facility, the construction of which has been terminated or suspended.

6.15.3 The fact of termination or suspension of construction within three days must be notified, if necessary, to the traffic police of the internal affairs bodies in order to cancel the previously imposed restrictions on the movement of vehicles and pedestrians, as well as the owners of territories included in the territory of the construction site in accordance with approved and approved building plan.

When carrying out construction on the basis of a contract, the developer (customer) and the person carrying out construction when carrying out construction on the basis of a contract, no later than a month later, draw up an act of acceptance of the completed part of the object with a description of the state of the object, indicating the volume and cost of work performed, a list of applied (mounted ) at the facility of equipment, materials and structures, a list of unused and subject to storage equipment, materials and structures, a list of works necessary for the safety of the facility and unused equipment, materials and structures.

6.15.4 If necessary, the designer, under an agreement with the developer (customer), develops working drawings and estimates for the conservation of the object, and the person carrying out the construction performs the work provided for by these working drawings and estimates.

6.15.5 The mothballed object and the construction site during the construction on the basis of the contract are transferred under the act to the developer (customer). The act is accompanied by as-built documentation, work logs, as well as documents on inspections, inspections, control tests, measurements carried out during construction, documents of suppliers confirming the compliance of materials, works, structures, process equipment and engineering systems of the facility with the project and the requirements of regulatory documents.

7 Construction quality control. Supervision of construction

7.1 Construction participants - the person carrying out the construction, the developer (customer), the designer - must exercise construction control, provided for by the legislation of the Russian Federation on urban planning, in order to assess the compliance of construction and installation works, structures being erected and engineering and technical support systems for a building or structure with the requirements technical regulations, design and working documentation.

The person carrying out construction, as part of construction control, performs:

input control of project documentation provided by the developer (customer);

survey of the geodetic center base of the capital construction object;

input control of applied building materials, products, structures and equipment;

operational control during and after completion of construction and installation operations;

examination of the work performed, the results of which become unavailable for control after the start of the subsequent work;

examination of critical building structures and sections of engineering and technical support systems;

testing and testing of technical devices.

Construction control of the developer (customer) in accordance with the current legislation is carried out in the form of control and supervision of the customer over the performance of work under a construction contract according to 7.3.

In the cases provided for in 7.4, as part of construction control, architectural supervision of the person who prepared the project documentation (designer) is carried out.

7.1.1 During the input control of project documentation, all submitted documentation, including the POS and working documentation, should be analyzed, while checking:

its completeness;

compliance with the design axial dimensions and the geodetic base;

availability of approvals and approvals;

availability of references to normative documents on materials and products;

compliance of the boundaries of the construction site on the building plan with the established servitudes;

availability of requirements for the actual accuracy of controlled parameters;

availability of instructions on methods of control and measurements, including in the form of references to the relevant regulatory documents.

If deficiencies are found, the relevant documentation is returned for revision within the time period specified in the contract.

7.1.2 The person carrying out the construction shall accept the geodetic marking base provided to him by the developer (customer), check its compliance with the established requirements for accuracy, reliability of fixing signs on the ground; for this purpose, it is possible to involve independent experts who have a certificate of admission issued by a self-regulatory organization to work on the creation of reference geodetic networks.

Acceptance of the geodetic staking base from the developer (customer) should be formalized by the relevant act.

7.1.3 The input control checks the compliance of the quality indicators of the purchased (received) materials, products and equipment with the requirements of the standards, specifications or technical certificates for them specified in the project documentation and (or) the contract.

At the same time, the presence and content of the accompanying documents of the supplier (manufacturer) confirming the quality of the specified materials, products and equipment are checked.

If necessary, control measurements and tests of the above indicators can be performed. Methods and means of these measurements and tests must comply with the requirements of national standards. The results of the input control must be documented in the logs of the input control and (or) laboratory tests.

7.1.4 In the case of control and testing by the involved laboratories, it is necessary to check the compliance of the control and test methods used by them with the established national standards.

7.1.5 Materials, products, equipment, the non-compliance of which with the established requirements is revealed by the input control, should be separated from suitable ones and marked. Work with the use of these materials, products and equipment should be suspended. The developer (customer) must be notified of the suspension of work and its reasons.

One of three decisions can be made in accordance with the law:

the supplier replaces non-conforming materials, products, equipment with appropriate ones;

nonconforming products are improved;

non-conforming materials, products can be used after mandatory agreement with the developer (customer), designer and state control (supervision) body within its competence.

7.1.6 By operational control, the person carrying out the construction checks:

compliance of the sequence and composition of the technological operations performed with the technological and regulatory documentation applicable to these technological operations;

compliance with technological regimes established by technological maps and regulations;

compliance of the quality indicators of the performance of operations and their results with the requirements of the design and technological documentation, as well as the regulatory documentation applicable to these technological operations.

Places for performing control operations, their frequency, performers, methods and measuring instruments, forms for recording results, decision-making procedures in case of identifying non-compliance with established requirements must comply with the requirements of design, technological and regulatory documentation.

The results of operational control should be documented in work logs.

7.2 During the construction process, an assessment should be made of the work performed, the results of which affect the safety of the facility, but, in accordance with the accepted technology, become inaccessible for control after the start of the subsequent work, as well as the completed building structures and sections of engineering networks, the elimination of defects of which, identified by the control, impossible without dismantling or damaging subsequent structures and sections of engineering networks. Representatives of the relevant bodies of state supervision, architectural supervision, as well as, if necessary, independent experts may participate in these control procedures. The person carrying out the construction, within the terms agreed, but no later than three working days, notifies the other participants of the terms of the specified procedures.

7.2.1 The results of the survey of work hidden by subsequent work, in accordance with the requirements of the design and regulatory documentation, are documented in certificates of survey of hidden work. The builder (customer) may require a re-examination after the elimination of the identified defects.

7.2.2 To the procedure for assessing the conformity of individual structures, tiers of structures (floors), the person carrying out the construction must submit certificates of survey of all hidden works that are part of these structures, geodetic executive schemes, as well as test reports for structures in cases provided for by the design documentation and (or) a building contract. The developer (customer) can perform verification of the reliability of the executive geodetic schemes submitted by the contractor. For this purpose, the person carrying out the construction must keep the stakeout axes and installation landmarks fixed in kind until the acceptance is completed.

The results of the survey of individual structures should be documented in certificates of survey of critical structures.

7.2.3 Tests of sections of engineering networks and mounted engineering equipment are carried out in accordance with the requirements of the relevant regulatory documents and are drawn up by the relevant acts.

7.2.4 If, as a result of construction control, defects in works, structures, sections of engineering networks are detected, the relevant acts should be drawn up only after the identified defects have been eliminated.

In cases where subsequent work must begin after a break of more than six months from the moment the phased acceptance is completed, these procedures should be repeated before the resumption of work with the execution of the relevant acts.

7.3 Construction control of the customer is performed by:

verification that the person carrying out the construction has quality documents (certificates in established cases) for the materials, products and equipment used by him, documented results of input control and laboratory tests;

monitoring compliance by the person carrying out construction with the rules for warehousing and storage of materials, products and equipment used; upon detection of violations of these rules, a representative of the construction control of the developer (customer) may prohibit the use of improperly stored and stored materials;

control of compliance of the operational control performed by the person carrying out the construction with the requirements of 7.1.6;

control of the availability and correctness of the maintenance by the person carrying out the construction of as-built documentation, including the assessment of the reliability of geodesic executive schemes of the completed structures with selective control of the accuracy of the position of the elements;

control over the elimination of defects in the design documentation identified during the construction process, documented return of defective documentation to the designer, control and documented acceptance of the corrected documentation, its transfer to the person carrying out the construction;

control over the execution by the person carrying out the construction of the instructions of state supervision bodies and local self-government;

notification of state supervision authorities of all cases of emergency at the construction site;

assessment (together with the person carrying out the construction) of the compliance of the work performed, structures, sections of engineering networks, signing of bilateral acts confirming compliance; control over the fulfillment by the person carrying out the construction of the requirement on the inadmissibility of performing subsequent work before the signing of these acts;

final assessment (together with the person carrying out the construction) of the compliance of the completed facility with the requirements of the legislation, design and regulatory documentation.

7.4 During the construction of hazardous production facilities, as well as especially dangerous technically complex and unique facilities, the designer's supervision is carried out. In other cases, it is carried out at the discretion of the developer (customer). The procedure for implementation and functions of architectural supervision are established by the relevant documents.

7.5 The comments of the representatives of the building control of the developer (customer) are documented in the general and special journals of work, the comments of the representatives of architectural supervision - in the journal of architectural supervision. The facts of elimination of defects according to the comments of these representatives are documented with their participation.

7.6 Architectural supervision of the architect is carried out by the author-architect on an initiative basis, regardless of the decision of the developer (customer) and the existence of a contract for architectural supervision of the object. The territorial body for architecture and urban planning, at the request of the author, having verified his authorship, may issue an order to the developer (customer) to ensure the author's admission to the construction site, the possibility of making entries in the author's supervision journal. The claims of the author-architect regarding the implementation of architectural design solutions may be considered by the urban planning and architecture authority, whose decision is binding on the developer (customer).

7.7 State construction supervision is carried out in the cases provided for by the legislation on urban planning activities in accordance with the legislation of the Russian Federation on urban planning activities and other regulatory legal acts (Appendix A).

State construction supervision authorities assess the compliance of the construction process of a particular facility upon receipt of a notice from the developer (customer) about the start of construction work.

7.8 In order to limit the adverse impact of construction and installation works on the population and the territory in the zone of influence of ongoing construction, local governments or organizations authorized by them (administrative inspections, etc.) in the manner prescribed by current legislation conduct administrative control over construction.

Administrative control consists in preliminary setting the conditions for construction (the size of the construction site fence, temporary work schedule, garbage removal, maintaining order in the adjacent territory, etc.) and monitoring compliance with these conditions during construction. The builder is responsible to the local self-government body, unless otherwise provided by the contracts.

CODE OF RULES Foreword

The goals and principles of standardization in the Russian Federation are established by the Federal Law of December 27, 2002 N 184-FZ "On technical regulation", and the development rules - by the Decree of the Government of the Russian Federation of November 19, 2008 N 858 "On the procedure for developing and approving sets of rules ".

1 area of ​​use

This set of rules applies to the construction of new, reconstruction and demolition of existing buildings and structures (hereinafter referred to as construction), erected on the basis of a building permit obtained in the prescribed manner, as well as to landscaping and engineering preparation of territories.

During the construction of linear structures, power transmission lines, communications, pipelines and other technical infrastructure facilities, as well as in the right of way of railways, in the right of way of roads and other transport routes, the requirements of current regulatory documents must be additionally taken into account.

With regard to the objects of the military infrastructure of the Armed Forces of the Russian Federation, objects, information about which constitutes a state secret, objects of production, processing, storage of radioactive and explosive substances and materials, objects for the storage and destruction of chemical weapons and explosives, other objects for which requirements are established related to ensuring nuclear and radiation safety in the field of the use of atomic energy, the requirements established by state customers, federal executive bodies authorized in the field of ensuring the safety of these facilities, and state contracts (contracts) must be observed.

The document does not apply to buildings and structures, the construction of which, in accordance with the legislation on urban planning, can be carried out without a building permit, as well as to individual housing construction objects built by developers (individuals) on their own, including with the involvement of hired workers, on the land they own.

The document also does not apply to the production of materials, products and structures at the enterprises of the construction industry and the building materials industry.

2. Normative references 3. Terms and definitions

This set of rules mainly adopts the terms and definitions of the Technical Regulations on the safety of buildings and structures.

4. General provisions

4.1. The construction of buildings and structures is carried out in the presence of a building permit obtained in accordance with the legislation on urban planning.

Lists of buildings and structures for the construction of which a building permit is not required are established by the legislation on urban planning.

4.2. The actions of the construction participants, the work performed during the construction process, their results, including buildings and structures completed by construction, must meet the requirements of the current legislation, design and working documentation, town planning plans for land plots.

4.3. The developer must ensure the performance of all functions specified in 4.4, 4.6 and not assigned by contracts to other participants in the construction.

4.4. The basic functions of the developer are:

obtaining a building permit;

obtaining the right to limited use of neighboring land plots (servitudes) for the duration of construction;

Engaging a contractor (general contractor) to carry out work on the construction of a building or structure as a person carrying out the construction, in the case of work under the contract;

providing construction with project documentation that has passed the examination and approved in the prescribed manner;

Ensuring the stakeout of building regulation lines and the creation of a geodetic staking base;

notification of the start of any work at the construction site of the state construction supervision body, which controls this object;

ensuring construction control of the developer (customer);

Acceptance of the completed construction object in the event of work under the contract;

Organization of adjustment and testing of equipment, trial production of products and other measures to prepare the facility for operation;

making decisions on the start, suspension, conservation, termination of construction, on the commissioning of a completed property;

presentation of the construction object completed by the construction to the bodies of state construction supervision and environmental supervision (in cases provided for by the legislation on urban planning activities);

Presentation of the completed construction object to the authorized body for commissioning;

Acquisition, storage and transfer of executive and operational documentation to the relevant organizations.

4.5. The developer to perform its functions of providing construction with project documentation that has passed the examination and approved in the prescribed manner, upon receipt of a construction permit, its functions as a customer in the construction on the basis of a contract, to carry out construction control of the customer, as well as to interact with state supervisory authorities and local self-government may involve, in accordance with the current legislation, a specialized organization or a specialist of the appropriate qualification.

The transfer by the developer of its functions to an involved organization or specialist is formalized by an agreement between them.

4.6. When carrying out construction on the basis of a contract, the basic organizational functions of the contractor (general contractor) as a person carrying out construction are:

Performance of works, structures, systems of engineering and technical support of the construction object in accordance with the design and working documentation;

Development and application of organizational and technological documentation;

implementation of construction control of the person carrying out the construction, including control over the compliance of the building materials and products used with the requirements of technical regulations, design and working documentation;

maintenance of executive documentation;

ensuring labor safety at the construction site, safety of construction work for the environment and the population;

Construction site management, including ensuring the protection of the construction site and the safety of the facility until it is accepted by the developer (customer);

compliance with the requirements of the local administration, acting within its competence, to maintain order in the territory adjacent to the construction site.

4.7. The basic function of the person who prepared the project documentation (hereinafter referred to as the designer) during the construction process is to make changes in the prescribed manner to the design estimates and working documentation in the event of a change after the start of construction of the urban planning plan of the land plot or existing regulatory documents (performed as additional work ).

Additional organizational functions of the designer during the construction process, performed in accordance with agreements between construction participants, are:

making changes to the design and estimate documentation in connection with the need to take into account the technological capabilities of the contractor;

development of additional design solutions in connection with the need to ensure production;

coordination of the allowed deviations from the working documentation, including the adoption of decisions on the possibility of using non-conforming products.

4.8. Construction in accordance with the current legislation is carried out under the control of local governments and state construction supervision. To ensure this possibility, the mentioned authorities must be notified in advance by the developer (customer) about the start of work at the construction site, about the suspension, conservation and (or) termination of construction, about the readiness of the facility for commissioning.

4.9. Upon completion of the construction of a building or structure, an assessment is made of its compliance with the requirements of the current legislation, technical regulations, design and working documentation, its acceptance during construction on the basis of a contract, as well as the commissioning of the completed building or structure.

4.10. Construction control carried out by construction participants must be carried out in accordance with the Federal Law of June 26, 2008 N 102-FZ "On Ensuring the Uniformity of Measurements" using measuring instruments of an approved type that have been tested, according to certified measurement methods (methods) when necessary . Routine tests and measurements must be carried out by qualified personnel.

5. Preparation for construction

5.1. In order to carry out construction on the basis of a contract, the developer (customer) engages a contractor (general contractor) to perform work in accordance with the current legislation as a person carrying out construction.

5.2. Construction participants (legal entities) by their administrative documents (orders) appoint officials personally responsible for the construction:

developer (customer) - a responsible representative of the construction control of the developer (customer);

the person carrying out the construction (contractor, general contractor) - the responsible work producer;

The person who prepared the design documentation (designer) is the responsible representative of architectural supervision in cases where architectural supervision is carried out.

These officials must be qualified in accordance with the requirements of the current legislation.

During the construction of a building or structure by a legal entity performing the functions of a developer (customer) and a person carrying out construction (contractor), these officials are appointed by the head of this organization. At the same time, the combination of the functions of the responsible work foreman and the responsible representative of the construction control of the developer (customer) by one unit or official of this organization is unacceptable.

5.3. A person carrying out construction, in accordance with the current legislation, must have certificates issued by a self-regulatory organization on admission to the types of work that affect the safety of the building or structure being erected.

5.4. When carrying out construction on the basis of a contract, the developer (customer) transfers to the person carrying out the construction the project documentation approved by him, as well as working documentation for the entire facility or for certain stages of work in two copies on electronic and paper media. The design and working documentation must be approved for work by the developer (customer) with the signature of the responsible person by putting a stamp on each sheet. The composition and content of sections of project documentation (including a construction organization project) transferred to a person carrying out construction must comply with the requirements established by the Government of the Russian Federation (Appendix A). The transferred project documentation must contain the assurance of the designer that this documentation has been developed in accordance with the design assignment and the requirements of the Federal Law of December 30, 2009 N 384-FZ "Technical Regulations on the Safety of Buildings and Structures".

5.5. The person carrying out the construction performs the input control of the working documentation transferred to him for execution, transfers to the developer (customer) a list of the shortcomings identified in it, checks their elimination. The term for the implementation of the input control of project documentation is established in the contract.

At the same time, the person carrying out the construction can check the feasibility of implementing the project using known methods, determining, if necessary, the need to develop new technological methods and equipment, as well as the possibility of acquiring materials, products and equipment, the use of which is provided for by the project documentation, and the compliance of the actual location indicated in design documentation of places and conditions for connecting temporary engineering communications (networks) to external networks of engineering and technical support to provide the construction site with electricity, water, heat, steam.

5.6. The conditions for fulfilling the requirements of legislation on the protection of labor, the environment and the population during the construction process, as well as the possibility of performing all types of control necessary to assess the compliance of the work performed with the requirements of design, regulatory documentation and (or) the terms of the contract, are established by the projects of the construction organization and organizational and technological documentation.

5.7. Design preparation of construction organization and organizational and technological documentation

5.7.1. Solutions for the organization of construction for industrial and non-industrial facilities are developed in projects for the organization of construction and projects for the organization of work on the demolition or dismantling of capital construction projects. Solutions for the organization of construction for linear facilities are developed in projects for the organization of construction and projects for the organization of work on the demolition (dismantling) of a linear facility. Projects for the organization of construction, projects for the organization of work on the demolition or dismantling of capital construction projects, projects for the organization of work on the demolition (dismantling) of a linear facility (hereinafter referred to as construction organization projects, POS) are an integral and integral part of the project documentation. Construction organization projects are a mandatory document for the developer (customer), contractors, as well as organizations providing financing and logistics.

The choice of decisions on the organization of construction should be carried out on the basis of variant study with the wide use of criteria-based assessment methods, modeling methods and modern computer systems.

5.7.2. Organizational and technological documentation includes a project for the production of works, as well as other documents that contain decisions on the organization of construction production and the technology of construction and installation works, drawn up, agreed, approved and registered in accordance with the rules in force in organizations developing, approving and coordinating these documents.

5.7.4. The project for the production of works in full must be developed:

during any construction in the urban area;

during any construction on the territory of an operating enterprise;

During construction in difficult natural and geological conditions, as well as technically especially complex objects - at the request of the authority issuing a permit for construction or for the performance of construction, installation and special works.

In other cases, the PPR is developed by decision of the person carrying out the construction in an incomplete volume.

5.7.5. The project for the production of works in full includes:

calendar plan for the production of works on the object;

the schedule for the receipt of building structures, products, materials and equipment at the facility;

the schedule of the movement of workers on the object;

the schedule of movement of the main construction machines around the facility;

technological maps for the performance of types of work;

An explanatory note containing solutions for the production of geodetic works, solutions for laying temporary networks of water, heat, power supply and lighting of the construction site and workplaces; justification and measures for the use of mobile forms of work organization, work and rest regimes; work decisions, including winter time; the need for energy resources; the need and binding of camps of builders and mobile (inventory) buildings; measures to ensure the safety of materials, products, structures and equipment at the construction site; environmental protection measures; measures for labor protection and safety in construction; technical and economic indicators.

The project for the production of works in an incomplete scope includes:

building master plan;

technological maps for the performance of certain types of work (as agreed with the customer);

layouts of geodetic signs;

An explanatory note containing the main decisions, environmental measures; measures for labor protection and safety in construction.

5.7.6. The starting materials for the development of projects for the production of works are:

A development assignment issued by a construction organization as a customer of a project for the production of works, with a justification for the need to develop it for the building (structure) as a whole, its part or type of work and indicating the development time;

construction organization project;

necessary working documentation;

conditions for the supply of structures, finished products, materials and equipment, the use of construction machines and vehicles, the provision of workers for builders in the main professions, the use of a team contract for the performance of work, production and technological equipment and transportation of building materials, and, if necessary, also the conditions for organizing construction and performance of work on a rotational basis;

materials and results of technical inspection of existing enterprises, buildings and structures during their reconstruction, as well as requirements for the implementation of construction, installation and special construction works in the conditions of existing production.

5.7.7. Solutions of projects for the production of works should ensure the achievement of the safety of capital construction projects.

In the project for the production of works, deviations from the decisions of the construction organization project without the consent of the organizations that developed and approved it are not allowed.

5.7.8. In the event that a WEP for the construction of this facility is not developed, safety decisions are drawn up in the form of a separate document (documents).

5.7.9. The project for the production of works on the territory of an operating enterprise must be agreed with the organization operating it.

5.7.10. The project for the production of works using mining, blasting and other potentially hazardous work must also be agreed with the Rostekhnadzor body.

5.8. The builder (customer) must ensure the removal of the geodetic staking base to the site by a person who has a certificate issued by a self-regulatory organization for admission to work on the creation of geodetic reference networks.

5.9. The person carrying out the construction should check whether the organizational and technological documentation used by him contains instructions on conducting construction control.

5.10. The person carrying out the construction should, on the basis of the design documentation, prepare layouts for the axes of buildings and structures that are broken in nature, signs for fixing these axes and mounting landmarks, as well as layouts for structures and their elements relative to these axes and landmarks. Schemes are developed based on the condition that the axes and landmarks, broken in kind, should be technologically accessible for observation while monitoring the accuracy of the position of structural elements at all stages of construction. At the same time, if necessary, it is necessary to correct the existing one or develop a methodology for performing and controlling the accuracy of geodetic marking work, rules for applying and fixing mounting landmarks.

5.11. The person carrying out the construction, if necessary, should carry out personnel training, as well as conclude contracts with accredited laboratories to perform those types of tests that the contractor cannot perform on his own.

5.12. When preparing for construction and installation work on the territory of existing production facilities, the administration of the developer and the person carrying out the construction appoint a person responsible for the operational management of the work and determine the procedure for coordinated actions. At the same time, they determine and agree on:

Volumes, technological sequence, terms of construction and installation works, as well as the conditions for their combination with the work of production shops and sections of the reconstructed enterprise;

the order of operational management, including the actions of builders and operators, in case of emergency;

the sequence of disassembly of structures, as well as the dismantling or transfer of engineering networks, places and conditions for connecting temporary networks of water supply, electricity, etc., places for performing executive surveys;

the procedure for the use by builders of the services of the enterprise and its technical means;

Conditions for organizing the complete and priority supply of equipment and materials, transportation, storage of goods and movement of construction equipment on the territory of the enterprise, as well as the placement of temporary buildings and structures and (or) the use of buildings, structures and premises of an existing production enterprise for the needs of construction.

5.13. Measures to close streets, restrict traffic, change public transport, provided for by the construction plan and agreed upon during its development, before starting work, are finally agreed by the developer (customer) with the State Traffic Safety Inspectorate of the internal affairs bodies and transport and communication institutions of the local government. Once the need for restrictions has ceased, these authorities should be notified.

6. Construction work

6.1. Construction work must be carried out by the person carrying out the construction, in accordance with applicable law, design, working and organizational and technological documentation.

6.2. Construction site

6.2.1. The boundaries of the construction site should be indicated on the construction general plan and situational plan, and for linear objects - indicated in the form of the width of the right of way.

6.2.2. In addition to the land plot owned by the developer, the construction site, if necessary, may additionally include the territories of other (including neighboring) land plots. In such cases, the developer, prior to obtaining a building permit, must obtain the consent of the owners of additional territories for their use, or the necessary easements must be established.

6.2.3. The security of the construction site, compliance with the requirements for labor protection at the construction site, environmental protection, safety of construction work for the surrounding territory and the population, as well as the fulfillment of various administrative requirements established by these standards, other applicable regulatory documents or local self-government bodies, are provided by the developer .

6.2.4. In the case of construction on the basis of a contract, during the entire construction period, the obligations provided for in 6.2.3 in accordance with the work contract are performed by the contractor (general contractor).

6.2.5. In the case of construction on the basis of a contract, the developer (customer) transfers the construction site to the contractor (general contractor) as the person carrying out the construction, according to the act. The area and condition of the construction site must comply with the terms of the contract. The developer (customer), in accordance with applicable law, in the cases and in the manner prescribed by the contract, must transfer to the contractor (general contractor) the buildings and structures necessary for the implementation of work, ensure the transportation of goods to his address, temporary supply of power supply networks, water and steam pipeline.

6.2.6. The person carrying out the construction must ensure the cleaning of the construction site and the five-meter adjacent area. Household and construction waste, as well as snow, must be removed in a timely manner within the time frame and in the manner established by the local government.

6.2.7. If necessary, at the request of the local self-government body, the person carrying out the construction must equip the construction site overlooking the city territory with cleaning or washing points for vehicle wheels at exits, as well as devices or bins for collecting garbage, and at linear objects - in places specified by the local government.

If it is necessary to temporarily use certain territories not included in the construction site for construction needs that do not pose a danger to the population and the environment, the mode of use, protection (if necessary) and cleaning of these territories is determined by an agreement with the owners of these territories (for public territories - with local government).

6.2.8. The person carrying out the construction, prior to the commencement of any work, must enclose the construction site and hazardous work zones outside it in accordance with the requirements of regulatory documents.

At the entrance to the site, information boards should be installed indicating the name of the object, the name of the developer (customer), the performer of the work (contractor, general contractor), the names, positions and telephone numbers of the responsible foreman of work on the facility and the representative of the state construction supervision authority (in cases where supervision is carried out) or local government in charge of construction, the start and end dates of work, the scheme of the object.

The name and telephone number of the performer of the work are also applied on the inventory fencing panels of work places outside the construction site, mobile buildings and structures, large-sized equipment items, cable drums, etc.

6.2.9. If the operation of existing and abandoned buildings and structures at the construction site is terminated, the developer must take measures to prevent harm to the population and the environment (communications are turned off, existing containers are emptied, hazardous or toxic substances are removed, etc.). The person carrying out the construction must take measures to prevent unauthorized access to the building by people and animals.

6.2.10. On-site preparatory work must be completed before the commencement of construction and installation works in accordance with the project for the production of works.

6.2.11. During the entire period of construction, the person carrying out the construction must provide access to the construction site and the building (structure) under construction for representatives of the construction control of the developer (customer), architectural supervision and state supervision bodies.

6.3. In cases where construction is carried out on a territory exposed to adverse natural phenomena and geological processes (mudflows, avalanches, landslides, landslides, waterlogging, flooding, etc.), prior to the start of construction work on special projects, priority measures and protection work are carried out territory from these processes.

6.4. Associated development of natural resources can be carried out if there is appropriate documentation agreed and approved in the prescribed manner.

6.5. In the event that objects of historical, cultural or other value are discovered during the work, the person carrying out the construction suspends the ongoing work and notifies the institutions and authorities provided for by law about the discovered objects.

6.6. Temporary buildings and structures

6.6.1. Temporary buildings and structures for the needs of construction are erected (installed) at the construction site or in the right of way of linear facilities by the person carrying out the construction, specifically to ensure the construction and after its completion are subject to liquidation. Temporary buildings and structures should mainly be inventory.

Buildings, structures or premises used for the needs of construction, which are part of the construction object, do not belong to temporary ones.

6.6.2. If it is necessary to temporarily use certain territories not included in the construction site for the placement of temporary buildings and structures, the mode of use, protection (if necessary) and cleaning of these territories is determined by agreement with the owners of these territories (for public territories - with the local government).

6.6.3. Temporary buildings and structures, as well as individual premises in existing buildings and structures, adapted for use for construction needs, must comply with the requirements of technical regulations and applicable construction, fire, sanitary and epidemiological norms and rules for domestic, industrial, administrative and residential buildings , buildings and premises.

6.6.4. Temporary buildings and structures located on the construction site or on the territory used by the developer in agreement with its owner are put into operation by the decision of the person carrying out the construction. Commissioning is formalized by an act or an entry in the work log.

6.6.5. Responsibility for the safety of temporary buildings and structures, as well as individual premises in existing buildings and structures adapted for use for the needs of construction, for their technical operation shall be borne by the person carrying out the construction.

6.7. Temporary settlements created for the needs of the construction of the facility are located on the territory of the developer or on the territory used by the developer by agreement with its owner. The project of a temporary settlement should include a master plan tied to the area, the composition of temporary buildings, structures and (or) premises, schemes for electricity, water, heat supply and sewerage, a scheme of access roads for all types of transport used, solutions for ensuring communication. The project of a temporary settlement should also include its demolition, land reclamation, cost estimates for these works.

6.8. In cases where the developer provides for the subsequent transfer of temporary settlements, buildings and structures for permanent operation, projects of temporary settlements, buildings and structures are developed, agreed and approved in the manner established for the design of settlements, buildings and structures intended for permanent use for their intended purpose. The commissioning of such settlements, buildings and structures is carried out in accordance with the procedure established by the legislation on urban planning.

6.9. Liquidation and demolition of buildings and structures

6.9.1. Works on the liquidation and demolition of buildings and structures must be carried out in accordance with the project for the organization of demolition or dismantling, which includes a list of buildings and structures to be demolished, as well as the necessary demolition technical solutions that ensure the safety of builders, the population, the environment and engineering infrastructure, including existing underground utilities.

6.9.2. Liquidated buildings and structures from the moment of their decommissioning until the moment of their liquidation (demolition) must be brought into a safe state, excluding accidental harm to the population and the environment (communications must be turned off, existing containers emptied, hazardous or toxic substances removed, fixed or collapsed unstable structures, etc.). Measures must be taken to prevent unauthorized access to these buildings (structures) of people and animals.

6.9.3. Everyone on the construction site, as well as the organization operating the adjacent territory, must be notified about the moment of explosion, burning or collapse of a demolished building or structure. If necessary, a cordon should be set up.

6.9.4. The fact of liquidation or demolition of a building or structure must be notified to the relevant accounting and administrative authorities. At the same time, the bodies - holders of territorial geofunds, in the manner established by them, must be notified of the communications, premises, structures and structures remaining in the land.

6.10. Warehousing and storage of materials, products and structures used (purchased and manufactured on their own) in accordance with the requirements of standards and specifications for these materials, products and structures shall be provided by the person carrying out the construction.

If violations of the established rules for warehousing and storage are revealed, the person carrying out the construction must immediately eliminate them. The use of improperly stored and stored materials and products by the person carrying out the construction should be suspended until the issue of the possibility of their use without compromising the quality of construction by the developer (customer) is resolved, with the involvement, if necessary, of representatives of the designer and the state construction supervision body. This decision must be documented.

6.11. When performing work related to the arrangement of temporary excavations and other obstacles in the territory of the existing building, the person carrying out the construction provides the passage of vehicles and access to houses by constructing bridges, footbridges with handrails, ladders in agreement with the owner of the territory. After completion of the work, these devices must be removed from the territory, and the landscaping of the territory must be restored.

Places of work must be fenced to prevent unauthorized entry of people and animals.

Places of work, as well as temporary passages and passages should be lit.

Organizational and technological solutions should be focused on minimizing the inconvenience caused by construction work to the population. To this end, the laying of communications in the urban area along the streets and roads should be carried out according to a schedule that takes into account their simultaneous laying; restoration of landscaping should be carried out on plots with a length, as a rule, no more than one block; restoration work should be carried out in two or three shifts; asphalt concrete waste, construction debris should be removed in a timely manner within the time frame and in the manner established by the local government.

6.12. Works at the locations of existing underground utilities

6.12.1. Work related to the opening of the surface at the locations of existing underground utilities and structures must be carried out in compliance with the special rules established by the ministries and departments operating these communications, as well as the following additional rules.

6.12.2. In accordance with the current rules for the protection of underground utilities, the responsible work foreman must, no later than three working days, call to the place of work representatives of organizations operating existing underground utilities and structures, and in their absence, representatives of organizations that have agreed on project documentation.

In the absence of communications and structures operated by them at the specified place of work, the relevant organizations are obliged to officially notify the person carrying out the construction about this.

6.12.3. Representatives of operating organizations arriving at the site are presented with design and working documentation and the axes or dimensions of the intended excavation made in nature. Together with the operating organization, the actual position of existing underground utilities and structures is determined on site (by drilling or otherwise), marked on the ground and applied to the working drawings. Representatives of the operating organizations shall hand over to the person carrying out the construction instructions on measures to ensure the safety of existing underground utilities and structures and on the need to call them to inspect hidden work and at the time of backfilling of the excavations.

Organizations that did not appear and did not notify of the absence of communications and facilities operated by them at the work site are called again a day in advance with simultaneous notification of local authorities, which decide on further actions in case of repeated failure of representatives of these organizations. No work can be started until a decision has been made.

The responsible work foreman is obliged to instruct the driver of the earth-moving machine on the procedure for excavation and to designate, with signs clearly visible from the cab, the boundaries of the zone within which mechanized excavation is allowed. The remaining mass of soil, directly adjacent to the underground structure, is developed manually.

6.13. The person carrying out the construction, in accordance with the legislation on urban planning activities, must maintain executive documentation:

certificates of examination of the geodetic center base of the capital construction object;

acts of breakdown of the axes of the capital construction object on the ground;

certificates of examination of hidden works;

certificates of examination of critical structures;

certificates of examination of sections of engineering and technical support networks;

A set of working drawings with inscriptions on the compliance of the work performed in kind with these drawings or on the changes made to them in agreement with the designer, made by persons responsible for the construction and installation works;

executive geodetic schemes and drawings;

executive diagrams and profiles of sections of engineering and technical support networks;

acts of testing and testing of technical devices;

the results of examinations, examinations, laboratory and other tests of the work performed, carried out in the process of construction control;

documents confirming the quality control of the building materials (products) used;

Other documents reflecting the actual execution of design decisions.

Requirements for the preparation and maintenance of as-built documentation are established by the Federal Service for Environmental, Technological and Nuclear Supervision.

6.14. As soon as the works and structures are ready, the quality indicators of which affect the safety of the building (structure), and if, in accordance with the construction technology, these indicators cannot be controlled after the completion of subsequent works, the person carrying out the construction, within the agreed time, but no later than notifies the developer (customer), representatives of the state control (supervision) and architectural supervision bodies about the deadlines for the implementation of the relevant conformity assessment procedure within three working days.

The shortcomings identified by such a procedure must be eliminated with the preparation of appropriate acts.

Until the identified deficiencies are eliminated and the relevant acts are drawn up, further work is unacceptable.

6.15. Termination of construction and conservation of the facility

6.15.1. If it is necessary to stop work on the construction of the facility or suspend it for a period of more than 6 months. conservation of the object should be carried out - bringing the object and the territory used for construction to a state that ensures the strength, stability and safety of the main structures and the safety of the object for the population and the environment.

6.15.2. The decision to stop or suspend construction is made by the builder and notifies the person carrying out the construction (when construction is carried out on the basis of a contract), the local government body, as well as the relevant state supervision bodies of the decision. The developer is responsible for the safety of the facility, the construction of which has been terminated or suspended.

6.15.3. The fact of termination or suspension of construction within three days must be notified, if necessary, to the traffic police of the internal affairs bodies in order to cancel the previously imposed restrictions on the movement of vehicles and pedestrians, as well as the owners of territories included in the territory of the construction site in accordance with the approved and agreed construction plan.

When carrying out construction on the basis of a contract, the developer (customer) and the person carrying out construction when carrying out construction on the basis of a contract, no later than a month later, draw up an act of acceptance of the completed part of the object with a description of the state of the object, indicating the volume and cost of work performed, a list of applied (mounted ) at the facility of equipment, materials and structures, a list of unused and subject to storage equipment, materials and structures, a list of works necessary for the safety of the facility and unused equipment, materials and structures.

6.15.4. If necessary, the designer, under an agreement with the developer (customer), develops working drawings and estimates for the conservation of the facility, and the person carrying out the construction performs the work provided for by these working drawings and estimates.

6.15.5. The mothballed object and the construction site during the construction on the basis of the contract are transferred under the act to the developer (customer). The act is accompanied by as-built documentation, work logs, as well as documents on inspections, inspections, control tests, measurements carried out during construction, documents of suppliers confirming the compliance of materials, works, structures, process equipment and engineering systems of the facility with the project and the requirements of regulatory documents.

7. Construction quality control. Supervision of construction

7.1. Construction participants - a person carrying out construction, a developer (customer), a designer - must exercise construction control, provided for by the legislation of the Russian Federation on urban planning, in order to assess the compliance of construction and installation works, structures being erected and engineering and technical support systems of a building or structure with technical requirements regulations, design and working documentation.

The person carrying out construction, as part of construction control, performs:

input control of project documentation provided by the developer (customer);

survey of the geodetic center base of the capital construction object;

input control of applied building materials, products, structures and equipment;

Operational control during and after completion of construction and installation operations;

Examination of the work performed, the results of which become inaccessible for control after the start of the subsequent work;

examination of critical building structures and sections of engineering and technical support systems;

testing and testing of technical devices.

Construction control of the developer (customer) in accordance with the current legislation is carried out in the form of control and supervision of the customer over the performance of work under a construction contract according to 7.3.

In the cases provided for in 7.4, as part of construction control, architectural supervision of the person who prepared the project documentation (designer) is carried out.

7.1.1. During the input control of project documentation, all submitted documentation, including the POS and working documentation, should be analyzed, while checking:

its completeness;

compliance with the design axial dimensions and the geodetic base;

availability of approvals and approvals;

availability of references to normative documents on materials and products;

Compliance of the boundaries of the construction site on the construction general plan with the established easements;

availability of requirements for the actual accuracy of controlled parameters;

Availability of instructions on methods of control and measurements, including in the form of references to the relevant regulatory documents.

If deficiencies are found, the relevant documentation is returned for revision within the time period specified in the contract.

7.1.2. The person carrying out the construction carries out the acceptance of the geodetic marking base provided to him by the developer (customer), checks its compliance with the established requirements for accuracy, reliability of fixing signs on the ground; for this purpose, it is possible to involve independent experts who have a certificate of admission issued by a self-regulatory organization to work on the creation of reference geodetic networks.

Acceptance of the geodetic staking base from the developer (customer) should be formalized by the relevant act.

7.1.3. The input control checks the compliance of the quality indicators of the purchased (received) materials, products and equipment with the requirements of the standards, specifications or technical certificates for them specified in the design documentation and (or) the contract.

At the same time, the presence and content of the accompanying documents of the supplier (manufacturer) confirming the quality of the specified materials, products and equipment are checked.

If necessary, control measurements and tests of the above indicators can be performed. Methods and means of these measurements and tests must comply with the requirements of national standards. The results of the input control must be documented in the logs of the input control and (or) laboratory tests.

7.1.4. In the case of inspection and testing by the involved laboratories, it is necessary to check the compliance of the methods of inspection and testing used by them with the established national standards.

7.1.5. Materials, products, equipment, the non-compliance of which with the established requirements is revealed by the input control, should be separated from suitable ones and marked. Work with the use of these materials, products and equipment should be suspended. The developer (customer) must be notified of the suspension of work and its reasons.

One of three decisions can be made in accordance with the law:

The supplier replaces non-conforming materials, products, equipment with appropriate ones;

Non-conforming products are finalized;

non-conforming materials, products can be used after mandatory agreement with the developer (customer), designer and state control (supervision) body within its competence.

7.1.6. By operational control, the person carrying out the construction checks:

compliance of the sequence and composition of the technological operations performed with the technological and regulatory documentation applicable to these technological operations;

Compliance with technological regimes established by technological maps and regulations;

compliance of the quality indicators of the performance of operations and their results with the requirements of the design and technological documentation, as well as the regulatory documentation applicable to these technological operations.

Places for performing control operations, their frequency, performers, methods and measuring instruments, forms for recording results, decision-making procedures in case of identifying non-compliance with established requirements must comply with the requirements of design, technological and regulatory documentation.

The results of operational control should be documented in work logs.

7.2. During the construction process, an assessment should be made of the work performed, the results of which affect the safety of the facility, but, in accordance with the accepted technology, become unavailable for control after the start of subsequent work, as well as the completed building structures and sections of engineering networks, the elimination of defects of which, identified by the control, is impossible without dismantling or damaging subsequent structures and sections of engineering networks. Representatives of the relevant bodies of state supervision, architectural supervision, as well as, if necessary, independent experts may participate in these control procedures. The person carrying out the construction, within the terms agreed, but no later than three working days, notifies the other participants of the terms of the specified procedures.

7.2.1. The results of the survey of work hidden by subsequent work, in accordance with the requirements of the design and regulatory documentation, are drawn up by certificates of survey of hidden work. The builder (customer) may require a re-examination after the elimination of the identified defects.

7.2.2. To the procedure for assessing the conformity of individual structures, tiers of structures (floors), the person carrying out the construction must submit certificates of examination of all hidden works that are part of these structures, geodetic executive schemes, as well as test reports for structures in cases provided for by the design documentation and (or) building contract. The developer (customer) can perform verification of the reliability of the executive geodetic schemes submitted by the contractor. For this purpose, the person carrying out the construction must keep the stakeout axes and installation landmarks fixed in kind until the acceptance is completed.

The results of the survey of individual structures should be documented in certificates of survey of critical structures.

7.2.3. Tests of sections of engineering networks and mounted engineering equipment are carried out in accordance with the requirements of the relevant regulatory documents and are drawn up by the relevant acts.

7.2.4. If, as a result of construction control, defects in works, structures, sections of engineering networks are found, the relevant acts should be drawn up only after the elimination of the identified defects.

In cases where subsequent work must begin after a break of more than six months from the moment the phased acceptance is completed, these procedures should be repeated before the resumption of work with the execution of the relevant acts.

7.3. Construction control of the customer performs:

Checking that the person carrying out the construction has quality documents (certificates in established cases) for the materials, products and equipment used by him, documented results of input control and laboratory tests;

monitoring compliance by the person carrying out construction with the rules for warehousing and storage of materials, products and equipment used; upon detection of violations of these rules, a representative of the construction control of the developer (customer) may prohibit the use of improperly stored and stored materials;

control of compliance of the operational control performed by the person carrying out the construction with the requirements of 7.1.6;

Control over the availability and correctness of maintenance by the person carrying out the construction of as-built documentation, including the assessment of the reliability of geodetic executive schemes of completed structures with selective control of the accuracy of the position of elements;

control over the elimination of defects in the design documentation identified during the construction process, documented return of defective documentation to the designer, control and documented acceptance of the corrected documentation, its transfer to the person carrying out the construction;

control over the execution by the person carrying out the construction of the instructions of state supervision bodies and local self-government;

Notification of state supervision authorities of all cases of emergency at the construction site;

assessment (together with the person carrying out the construction) of the compliance of the work performed, structures, sections of engineering networks, signing of bilateral acts confirming compliance; control over the fulfillment by the person carrying out the construction of the requirement on the inadmissibility of performing subsequent work before the signing of these acts;

The final assessment (together with the person carrying out the construction) of the compliance of the completed facility with the requirements of the legislation, design and regulatory documentation.

7.4. During the construction of hazardous production facilities, as well as especially dangerous technically complex and unique facilities, designer supervision is carried out. In other cases, it is carried out at the discretion of the developer (customer). The procedure for implementation and functions of architectural supervision are established by the relevant documents.

7.5. The comments of the representatives of the building control of the developer (customer) are documented in the general and special journals of work, the comments of the representatives of architectural supervision - in the journal of architectural supervision. The facts of elimination of defects according to the comments of these representatives are documented with their participation.

7.6. Author's supervision of an architect is carried out by the author-architect on an initiative basis, regardless of the decision of the developer (customer) and the existence of an agreement on author's supervision of the object. The territorial body for architecture and urban planning, at the request of the author, having verified his authorship, may issue an order to the developer (customer) to ensure the author's admission to the construction site, the possibility of making entries in the author's supervision journal. The claims of the author-architect regarding the implementation of architectural design solutions may be considered by the urban planning and architecture authority, whose decision is binding on the developer (customer).

7.7. State construction supervision is carried out in the cases provided for by the legislation on urban planning activities in accordance with the legislation of the Russian Federation on urban planning activities and other regulatory legal acts (Appendix A).

State construction supervision authorities assess the compliance of the construction process of a particular facility upon receipt of a notice from the developer (customer) about the start of construction work.

7.8. In order to limit the adverse impact of construction and installation works on the population and the territory in the zone of influence of ongoing construction, local governments or organizations authorized by them (administrative inspections, etc.) conduct administrative control over construction in accordance with the procedure established by current legislation.

Administrative control consists in preliminary setting the conditions for construction (the size of the construction site fence, temporary work schedule, garbage removal, maintaining order in the adjacent territory, etc.) and monitoring compliance with these conditions during construction. The builder is responsible to the local self-government body, unless otherwise provided by the contracts.

The conditions for conducting construction are established in the form of an order or other document issued by the local administration or organizations authorized by it in accordance with the regulatory legal acts of the constituent entities of the Russian Federation.

This set of rules applies to the construction of new, reconstruction and disposal of existing buildings and structures (hereinafter referred to as construction), to the overhaul of operated capital construction facilities.

During the construction of linear structures, power transmission lines, communications, pipelines and other technical infrastructure facilities, as well as in the right of way of railways, in the right of way of roads and other transport routes, the requirements of current regulatory documents must be additionally taken into account.

With regard to the objects of the military infrastructure of the Armed Forces of the Russian Federation, objects, information about which constitutes a state secret, objects of production, processing, storage of radioactive and explosive substances and materials, objects for the storage and destruction of chemical weapons and explosives, other objects for which requirements are established related to ensuring nuclear and radiation safety in the field of the use of atomic energy, the requirements established by state customers, federal executive bodies authorized in the field of ensuring the safety of these facilities, and state contracts (contracts) must be observed.

3. Terms and definitions

In this set of rules, the terms and definitions are mainly adopted according to the Federal Law of December 30, 2009 No. 384-FZ "Technical Regulations on the Safety of Buildings and Structures" and Federal Law of December 29, 2004 No. 190-FZ " Urban planning code Russian Federation".

4. General provisions

4.1. The construction of buildings and structures is carried out in the presence of a building permit obtained in accordance with the legislation on urban planning.

Lists of buildings and structures for the construction of which a building permit is not required are established by the legislation on urban planning.

4.2. The actions of the construction participants, the work performed during the construction process, their results, including buildings and structures completed by construction, must meet the requirements of the current legislation, design and working documentation, town planning plans for land plots.

4.3. The developer must ensure the performance of all functions specified in 4.4, 4.6 and not assigned by contracts to other participants in the construction.

4.4. The basic functions of the Developer are:

  • Obtaining a building permit
  • Obtaining the right to limited use of neighboring land plots (servitudes) for the duration of construction
  • Engagement of a contractor (general contractor) to perform work on the construction of a building or structure as a person carrying out construction, in case of performance of work under the contract
  • Providing construction with project documentation that has passed the examination and approved in the prescribed manner
  • Ensuring the stakeout of building regulation lines and the creation of a geodetic staking base
  • Involvement in accordance with 7.4 of the designer's supervision of the person who prepared the project documentation for the construction of the facility
  • Notice of the start of any work at the construction site of the state construction supervision body that controls this object
  • Ensuring construction control of the developer (customer)
  • Acceptance of the completed construction object in case of performance of work under the contract
  • Organization of adjustment and testing of equipment, trial production and other measures to prepare the facility for operation

4.5. In order to perform its functions, the developer may, in accordance with applicable law, engage a technical customer - an individual acting on a professional basis, or a legal entity.

The technical customer authorized by the developer, on his behalf, concludes agreements on the performance of engineering surveys, preparation of project documentation, construction, reconstruction, overhaul of capital construction facilities, prepares technical specifications for the performance of these types of work, approves project documentation, signs the documents necessary to obtain a permit to put the capital construction object into operation, performs other functions provided for by the current legislation.

4.6. When carrying out construction on the basis of a contract, the basic organizational functions of the contractor (general contractor) as a person carrying out construction are:

  • Execution of works, arrangement of structures, systems of engineering and technical support of the construction object in accordance with the design and working documentation
  • Development and application of organizational and technological documentation
  • Implementation of construction control of the person carrying out the construction, including control over the compliance of the building materials and products used with the requirements of technical regulations, design and working documentation
  • Maintaining executive documentation
  • Ensuring labor safety at the construction site, safety of construction work for the environment and the population
  • Construction site management, including ensuring the protection of the construction site and the safety of the facility until it is accepted by the developer (customer)
  • Fulfillment of the requirements of the local administration, acting within its competence, to maintain order in the territory adjacent to the construction site

4.7. The basic function of the person who prepared the project documentation (hereinafter referred to as the designer) during the construction process is to make changes to the design estimates and working documentation in the prescribed manner in the event of a change after the start of construction of the urban planning plan of the land plot or existing regulatory documents (performed as additional work ).

Additional organizational functions of the designer during the construction process, performed in accordance with agreements between construction participants, are:

  • Amendments to the design and estimate documentation due to the need to take into account the technological capabilities of the contractor
  • Development of additional design solutions in connection with the need to ensure production
  • Conducting architectural supervision under an agreement with the developer (customer), including in cases stipulated by the current legislation
  • Approval of the deviations from the working documentation, including the adoption of decisions on the possibility of using non-conforming products

4.8. Construction in accordance with the current legislation is carried out under the control of federal executive authorities, executive authorities of the constituent entities of the Russian Federation, local governments and state supervision. To ensure this possibility, the mentioned authorities must be notified in advance by the developer (customer) about the start of work at the construction site, about the suspension, conservation and (or) termination of construction, about the readiness of the facility for commissioning.

4.9. Upon completion of the construction of a building or structure, an assessment is made of its compliance with the requirements of the current legislation, technical regulations, design and working documentation, its acceptance during construction on the basis of a contract, as well as the commissioning of the completed building or structure.

4.10. Construction control carried out by construction participants must be carried out in accordance with the use of measuring instruments of an approved type that have been tested according to certified measurement procedures (methods) when necessary. Routine tests and measurements must be carried out by qualified personnel.

5. Preparation for construction

5.1. In order to carry out construction on the basis of a contract, the developer (technical customer) engages a contractor (general contractor) to perform work in accordance with the current legislation as a person carrying out construction.

5.2. Construction participants (legal entities) by their administrative documents (orders) appoint officials personally responsible for the construction:

  • Developer (technical customer) - responsible representative of the construction control of the developer (technical customer)
  • The person carrying out the construction (contractor, general contractor) - the responsible work producer
  • The person who prepared the design documentation (designer) is the responsible representative of architectural supervision in cases where architectural supervision is carried out

These officials must be qualified in accordance with the requirements of the current legislation.

During the construction of a building or structure by a legal entity performing the functions of a developer (technical customer) and a person carrying out construction (contractor), these officials are appointed by the head of this organization. At the same time, the combination of the functions of the responsible work foreman and the responsible representative of the construction control of the developer (technical customer) by one unit or official of this organization is unacceptable.

5.3. A person carrying out construction, in accordance with the current legislation, must have certificates issued by a self-regulatory organization on admission to the types of work that affect the safety of the building or structure being erected.

5.4. The design and working documentation is transmitted in two copies on electronic and paper media and must be accepted for work by the developer (technical customer) with the signature of the responsible person by putting a stamp on each sheet. The composition and content of sections of project documentation (including a construction organization project) transferred to a person carrying out construction must comply with the requirements established by the Government of the Russian Federation. The transferred project documentation must contain the designer's assurance that this documentation has been developed in accordance with the design assignment and the requirements of Federal Law No. 384-FZ of December 30, 2009 "Technical Regulations on the Safety of Buildings and Structures".

5.5. The person carrying out the construction performs the input control of the working documentation transferred to him for execution, transfers to the developer (customer) a list of the shortcomings identified in it, checks their elimination. The term for the implementation of the input control of project documentation is established in the contract.

At the same time, the person carrying out the construction can check the feasibility of implementing the project using known methods, determining, if necessary, the need to develop new technological methods and equipment, as well as the possibility of acquiring materials, products and equipment, the use of which is provided for by the project documentation, and the compliance of the actual location indicated in design documentation of places and conditions for connecting temporary engineering communications (networks) to external networks of engineering and technical support to provide the construction site with electricity, water, heat, steam.

It also checks for instructions on conducting construction control, including requirements for the actual accuracy of controlled parameters, tolerances for the dimensions of products and structures, their installation in the design position, instructions on methods and equipment for performing the necessary tests and changes with reference to regulatory documents.

5.6. Before starting work on the site, the construction contractor:

  • Concludes with the developer (technical customer) a construction contract) for the construction
  • Receives from the developer (technical customer) a notarized copy of the building permit
  • Receives from the developer (technical customer) design and working documentation for the entire facility or part of it, for certain types of work or a one-time amount of work
  • Accepts construction site
  • Coordinates the composition of subcontractors with the developer (technical customer), concludes contracts with them for the performance of various types of work and coordinates their activities
  • Concludes contracts for the supply of material and technical resources
  • Concludes contracts with accredited laboratories to perform types of tests that cannot be performed on their own
  • Draws up an act of admission on the possible combination of work during the reconstruction of the capital construction facility of an existing enterprise
  • Develops organizational and technological documentation

5.7. Design preparation of construction organization and development of organizational and technological documentation.

5.7.1. Solutions for the organization of construction for industrial and non-industrial facilities are developed in projects for the organization of construction and projects for the organization of work on the demolition or dismantling of capital construction projects. Solutions for the organization of construction for linear facilities are developed in projects for the organization of construction and projects for the organization of work on the demolition (dismantling) of a linear facility. Projects for the organization of construction, projects for the organization of work on the demolition or dismantling of capital construction projects, projects for the organization of work on the demolition (dismantling) of a linear facility (hereinafter referred to as construction organization projects, POS) are an integral and integral part of the project documentation. Construction organization projects are a mandatory document for the developer (customer), contractors, as well as organizations providing financing and logistics.

The choice of decisions on the organization of construction should be carried out on the basis of variant study with the wide use of criteria-based assessment methods, modeling methods and modern computer systems.

5.7.1.1. The construction organization must:

  • Ensure the efficiency of distribution of capital investments and volumes of construction and installation works by buildings, structures and construction periods
  • Exclude irrational consumption of energy resources
  • Provide modern production and sanitary services for those working directly at the facilities

5.7.2. Organizational and technological documentation includes projects for the production of work, schemes and instructions for the production of work, quality control schemes, flow schedules, basic provisions for the production of construction and installation works as part of the working documentation of standard projects for mass use, as well as other documents that contain decisions on the organization of construction production and the technology of construction and installation works, drawn up, agreed, approved and registered in accordance with the rules in force in organizations developing, approving and coordinating these documents.

6. Production of construction works

6.1. Construction work must be carried out by the person carrying out the construction, in accordance with applicable law, design, working and organizational and technological documentation.

6.2. Construction site organization.

6.2.1. The boundaries of the construction site, the location of permanent and under construction buildings, structures and temporary construction infrastructure are indicated on the construction general plan and situational plan, and for linear objects - in the situational plan and plan of the right of way.

6.2.2. In addition to the land plot owned by the developer, the construction site, if necessary, may additionally include the territories of other (including neighboring) land plots. In such cases, the developer, prior to obtaining a building permit, must obtain the consent of the owners of additional territories for their use, or the necessary easements must be established.

6.2.3. The protection of the construction site, compliance with the requirements for labor protection at the construction site, environmental protection, the safety of construction work for the surrounding territory and the population, as well as the fulfillment of various kinds of administrative requirements established by this set of rules, other applicable regulatory documents or the local self-government body, is ensured by developer. If construction is carried out on the basis of a contract during the entire construction period, the obligations provided for above in accordance with the work contract are performed by the contractor (general contractor).

6.2.4. Item excluded.

6.2.5. In the case of construction on the basis of a contract, the developer (technical customer) transfers the construction site to the contractor (general contractor) as the person carrying out the construction, according to the act. The area and condition of the construction site must comply with the terms of the contract. The developer (technical customer), in accordance with applicable law, in the cases and in the manner prescribed by the contract, must transfer to the contractor (general contractor) the buildings and structures necessary for the implementation of work, ensure the transportation of goods to his address, temporary supply of power supply networks, water and steam pipeline.

6.2.5.1. Placement of temporary construction infrastructure on the construction site should provide for:

  • Minimize temporary construction by maximizing the use of permanent buildings, roads and utility networks
  • Maximum use of mobile (inventory) buildings and structures to create normal production and living conditions for workers
  • The maximum possible laying of all types of temporary networks of engineering and technical support along permanent routes
  • Optimization of schemes for the delivery of material and technical resources with a minimum amount of reloading work

6.2.6. The person carrying out the construction must ensure the cleaning of the construction site and the five-meter adjacent area. Household and construction waste, as well as snow, must be removed in a timely manner, on time and in the manner established by the local government.

If it is necessary to temporarily use certain territories not included in the construction site for construction needs that do not pose a danger to the population and the environment, the mode of use, protection (if necessary) and cleaning of these territories is determined by an agreement with the owners of these territories (for public territories - with local government).

6.2.7. If necessary, at the request of the local self-government body, the person carrying out the construction must equip the construction site overlooking the city territory with cleaning or washing points for vehicle wheels at exits, as well as devices or bins for collecting garbage, and at linear objects - in places specified by the local government.

The suitability of washing points for operation is determined by its compliance with GOST R, and the sanitary and epidemiological conclusion of the Rospotrebnadzor, as well as the act of acceptance into operation at the stage of completion of the preparatory work.

6.2.8. The contractor carrying out the construction, prior to the commencement of any work, must protect the allocated territory of the construction site, the allocated separate territories for the accommodation of builders' camps, areas with dangerous and harmful production factors, areas with material assets of the construction organization (if necessary).

Dangerous zones for workers are allocated on the territory of the construction site with the installation of safety guards and safety signs.

6.2.8.1. At the entrance to the site, information boards should be installed indicating the name of the facility, the name of the developer (technical customer) of the performer of work (contractor, general contractor), names, positions and telephone numbers of the responsible foreman of work on the facility and a representative of the state construction supervision authority (in cases where supervision is carried out) or the local government in charge of construction, the start and end dates of work, the scheme of the facility.

The name and telephone number of the performer of the work are also applied on the inventory fencing panels of work places outside the construction site, mobile buildings and structures, large-sized equipment items, cable drums, etc.

At the entrance to the construction site, a fire protection stand is installed indicating the buildings and structures under construction, demolished and auxiliary buildings and structures, entrances, entrances, traffic patterns, location of water sources, fire extinguishing equipment.

6.2.9. If the operation of existing and abandoned buildings and structures at the construction site is terminated, the developer must take measures to prevent harm to the population and the environment (communications are turned off, existing containers are emptied, hazardous or toxic substances are removed, etc.). The person carrying out the construction must take measures to prevent unauthorized access to the building by people and animals.

6.2.10. On-site preparatory work should include the acceptance of a geodetic staking base for construction, the release of a construction site for construction and installation works (clearing the territory, demolition of buildings, etc.), territory planning, artificial lowering (if necessary) of the groundwater level, re-laying of existing and laying of new networks of engineering and technical support, arrangement of permanent and temporary roads, inventory temporary fences of the construction site with the organization, if necessary, of a checkpoint regime, placement of mobile (inventory) buildings and structures, arrangement of storage areas, organization of communications for operational dispatch control production of works, provision of the construction site with fire-fighting water supply and equipment, lighting and signaling facilities.

During the preparatory period, permanent buildings and structures for the needs of construction may be erected, or existing ones adapted for these purposes.

On-site preparatory work must be completed before the commencement of construction and installation works.

6.2.11. During the entire period of construction, the person carrying out the construction must provide access to the construction site and the building (structure) under construction for representatives of the construction control of the developer (customer), architectural supervision and state supervision bodies.

6.2.12. The performance of work must be carried out by methods (methods) that do not lead to the emergence of new and (or) intensification of existing hazardous natural processes and phenomena and exclude the threat of harm to human life or health, property of individuals or legal entities, state or municipal property, the environment, life and health of animals and plants.

6.2.13. The mechanization of construction, installation and special construction works during the construction of an object should be comprehensive and carried out with sets of construction machines, equipment, small-scale mechanization, necessary assembly equipment, inventory and fixtures.

The types, characteristics and number of leading and component machines should be adopted in the construction organization project and work production projects based on the design and space-planning solutions of the buildings and structures being erected, the scope of work, the pace and conditions of work (northern and southern regions, mountainous terrain, tightness of the site, etc.), taking into account the existing fleet of machines and the accepted mode of their work at the construction site.

Means of small-scale mechanization, including construction and finishing machines, equipment, tools, technological equipment necessary for the performance of concrete, assembly, stone, plastering, sanitary, waterproofing, painting, glass and other construction works, must be completed in standard sets in accordance with work technology.

The mechanization of construction and installation works during the reconstruction of existing enterprises in cramped conditions should be carried out by using construction machines that have small dimensions and high maneuverability, and in enclosed spaces - an additional electric drive.

6.3. Types of construction and reconstruction works that affect the safety of a capital construction facility should be carried out only by individual entrepreneurs or legal entities that have certificates of admission to such types of work issued by self-regulatory organizations.

6.4 The person carrying out the construction, reconstruction, organizes and coordinates the work, ensures compliance with the requirements of design and working documentation, technical regulations and safety precautions in the process of performing such work.

6.5 The developer (technical customer) is obliged, when carrying out construction, reconstruction, to ensure that buildings and structures comply with the requirements of energy efficiency and the requirements for equipping them with metering devices for the energy resources used.

6.6. Temporary buildings and structures

6.6.1. Temporary buildings and structures for the needs of construction are erected (installed) at the construction site or in the right of way of linear facilities by the person carrying out the construction, specifically to ensure the construction and after its completion are subject to liquidation. Temporary buildings and structures should basically be mobile (inventory).

Buildings, structures or premises used for the needs of construction, which are part of the construction object, do not belong to temporary ones.

6.6.2. If it is necessary to temporarily use certain territories not included in the construction site for the placement of temporary buildings and structures, the mode of use, protection (if necessary) and cleaning of these territories is determined by agreement with the owners of these territories (for public territories - with the local government).

6.6.3. Temporary buildings and structures, as well as separate premises in existing buildings; and structures adapted for use for construction needs must comply with the requirements of technical regulations and current construction, fire, sanitary and epidemiological norms and rules for domestic, industrial, administrative and residential buildings, structures and premises.

Residential camps of builders, walkways and places of rest for workers should be located outside the danger zones in compliance with the relevant sanitary norms and rules.

During the operation of residential camps, it is necessary to monitor the condition of structures and elements of buildings and utility networks, carry out their maintenance and repair, comply with safety and fire safety rules, as well as sanitary hygiene requirements.

During the heating season, the person carrying out the construction is obliged to carry out actions aimed at regulating the consumption of thermal energy in the construction camps, in mobile (inventory) buildings and structures in order to save it.

6.6.4. Temporary buildings and structures located on the construction site or on the territory used by the developer in agreement with its owner are put into operation by the decision of the person carrying out the construction. Commissioning is formalized by an act or an entry in the work log.

6.6.5. Responsibility for the safety of temporary buildings and structures, as well as individual premises in existing buildings and structures adapted for use for the needs of construction, for their technical operation shall be borne by the person carrying out the construction.

6.7. Temporary settlements created for the needs of the construction of the facility are located on the territory of the developer or on the territory used by the developer by agreement with its owner. The project of a temporary settlement should include a master plan tied to the area, the composition of temporary buildings, structures and (or) premises, schemes for electricity, water, heat supply and sewerage, a scheme of access roads for all types of transport used, solutions for ensuring communication. The project of a temporary settlement should also include its demolition, land reclamation, cost estimates for these works.

6.8. In cases where the developer provides for the subsequent transfer of temporary settlements, buildings and structures for permanent operation, projects of temporary settlements, buildings and structures are developed, agreed and approved in the manner established for the design of settlements, buildings and structures intended for permanent use for their intended purpose. The commissioning of such settlements, buildings and structures is carried out in accordance with the procedure established by the legislation on urban planning.

6.9. Utilization (demolition, dismantling) of buildings and structures.

6.9.1. Recycling (demolition, dismantling) of buildings and structures must be carried out in accordance with the project for the organization of demolition or dismantling, which includes a list of buildings and structures to be demolished, as well as the necessary technical demolition solutions that ensure the safety of builders, the public, the environment natural environment and engineering infrastructure, including existing underground utilities.

6.9.2 Recycled buildings and structures from the moment of their decommissioning until the moment of their disposal must be brought into a safe state, excluding accidental harm to the population and the environment (communications must be turned off, existing containers emptied, hazardous or toxic substances removed, fixed or collapsed unstable structures, etc.). Measures must be taken to prevent unauthorized access to these buildings (structures) of people and animals.

6.9.3. Everyone on the construction site, as well as the organization operating the adjacent territory, must be notified about the moment of explosion, burning or collapse of a demolished building or structure. If necessary, a cordon should be set up.

Prior to the demolition of the facility, technological and special equipment, instrumentation and automation, engineering systems, engineering equipment, sanitary networks, power supply, communications, radio and television systems, as well as finishing elements are dismantled

6.9.4. The fact of liquidation or demolition of a building or structure must be notified to the relevant accounting and administrative authorities. At the same time, the bodies - holders of territorial geofunds, in the manner established by them, must be notified of the communications, premises, structures and structures remaining in the land.

6.9.5. The person authorized to dispose of the object must:

  • Obtain permission from the technical customer to dispose of the object
  • Obtain from the technical customer documents certifying the disconnection of communications
  • Issue an order for the organization that determines the procedure for the production of work at the construction site in each shift
  • Appoint those responsible for the production of works, fire safety, electrical safety

A plate with the names of responsible persons is hung out at the construction site in a conspicuous place at the work site.

Corresponding orders must be issued by subcontractors involved in the performance of work.

6.9.6. Prior to the dismantling of buildings and structures, a survey of the technical condition of the structures of the facility is carried out to determine the risk of collapse of structures, the possibility of reusing structures, and safe dismantling.

6.10. Warehousing and storage of materials, products and structures used (purchased and manufactured on their own) in accordance with the requirements of standards and specifications for these materials, products and structures shall be provided by the person carrying out the construction.

If violations of the established rules for warehousing and storage are revealed, the person carrying out the construction must immediately eliminate them. The use of improperly stored and stored materials and products by the person carrying out the construction should be suspended until the issue of the possibility of their use without compromising the quality of construction by the developer (customer) is resolved, with the involvement, if necessary, of representatives of the designer and the state construction supervision body. This decision must be documented.

6.11. When carrying out work related to the arrangement of temporary excavations and other obstacles on the territory of the existing building, the person carrying out the construction ensures the passage of vehicles and access to the facilities by constructing bridges, footbridges with handrails, ladders in agreement with the owner of the territory. After completion of the work, these devices must be removed from the territory, and the landscaping of the territory must be restored.

Places of work must be fenced to prevent unauthorized entry of people and animals.

Places of work, as well as temporary passages and passages should be lit.

Organizational and technological solutions should be focused on minimizing the inconvenience caused by construction work to the population. To this end, the laying of communications in the urban area along the streets and roads should be carried out according to a schedule that takes into account their simultaneous laying; restoration of landscaping should be carried out on plots with a length, as a rule, no more than one block; restoration work should be carried out in two or three shifts; asphalt concrete waste, construction debris should be removed in a timely manner and in the manner prescribed by the local government.

6.12 Works at the locations of existing underground utilities

6.12.1. Work related to the opening of the surface at the locations of existing underground utilities and structures must be carried out in compliance with the special rules established by the ministries and departments operating these communications, as well as the following additional rules.

6.12.2. In accordance with the current rules for the protection of underground utilities, the responsible work foreman must, no later than three working days, call to the place of work representatives of organizations operating existing underground utilities and structures, and in their absence, representatives of organizations that have agreed on project documentation.

In the absence of communications and structures operated by them at the specified place of work, the relevant organizations are obliged to officially notify the person carrying out the construction about this.

6.12.3. Representatives of operating organizations arriving at the site are presented with design and working documentation and the axes or dimensions of the intended excavation made in nature. Together with the operating organization, the actual position of existing underground utilities and structures is determined on site (by drilling or otherwise), marked on the ground and applied to the working drawings. Representatives of the operating organizations shall hand over to the person carrying out the construction instructions on measures to ensure the safety of existing underground utilities and structures and on the need to call them to inspect hidden work and at the time of backfilling of the excavations.

Organizations that did not appear and did not notify of the absence of communications and facilities operated by them at the work site are called again a day in advance with simultaneous notification of local authorities, which decide on further actions in case of repeated failure of representatives of these organizations. No work can be started until a decision has been made.

The responsible work foreman is obliged to instruct the driver of the earth-moving machine on the procedure for excavation and to designate, with signs clearly visible from the cab, the boundaries of the zone within which mechanized excavation is allowed. The remaining mass of soil, directly adjacent to the underground structure, is developed manually.

6.13. The person carrying out the construction, in accordance with the legislation on urban planning activities, must maintain executive documentation:

  • Certificates of examination of the geodetic center base of the capital construction object
  • Acts of breakdown of the axes of the capital construction object on the ground
  • Certificates of examination of hidden works
  • Certificates of examination of critical structures
  • Certificates of survey of sections of engineering and technical support networks
  • A set of working drawings with inscriptions on the compliance of the work performed in kind with these drawings or on the changes made to them in agreement with the designer, made by persons responsible for the construction and installation works
  • Executive geodetic schemes and drawings
  • Executive schemes and profiles of sections of engineering networks
  • Acts of testing and testing of technical devices
  • The results of examinations, examinations, laboratory and other tests of the work performed, carried out in the process of building control
  • Documents confirming the quality control of the used building materials (products)
  • Other documents reflecting the actual execution of design decisions

Requirements for the preparation and maintenance of as-built documentation are established by the Federal Service for Environmental, Technological and Nuclear Supervision.

Executive documentation is subject to permanent storage with the developer (technical customer). At the time of the final inspection, the executive documentation is transferred to the state construction supervision body.

6.14. As soon as the works and structures are ready, the quality indicators of which affect the safety of the building (structure), and if, in accordance with the construction technology, these indicators cannot be controlled after the completion of subsequent works, the person carrying out the construction, within the agreed time, but no later than notifies the developer (customer), representatives of the state control (supervision) and architectural supervision bodies about the deadlines for the implementation of the relevant conformity assessment procedure within three working days.

The shortcomings identified by such a procedure must be eliminated with the preparation of appropriate acts.

Until the identified deficiencies are eliminated and the relevant acts are drawn up, further work is unacceptable.

6.15. Termination of construction and conservation of the facility

6.15.1. If it is necessary to stop work on the construction of the facility or suspend it for a period of more than 6 months. conservation of the object should be carried out - bringing the object and the territory used for construction to a state that ensures the strength, stability and safety of the main structures and the safety of the object for the population and the environment.

6.15.2. The decision to stop or suspend construction is made by the builder and notifies the person carrying out the construction (when construction is carried out on the basis of a contract), the local government body, as well as the relevant state supervision bodies of the decision. The developer is responsible for the safety of the facility, the construction of which has been terminated or suspended.

6.15.3. The fact of termination or suspension of construction within three days must be notified, if necessary, to the traffic police of the internal affairs bodies in order to cancel the previously imposed restrictions on the movement of vehicles and pedestrians, as well as the owners of the territories included in the territory of the construction site.

When carrying out construction on the basis of a contract, the developer (customer) and the person carrying out construction when carrying out construction on the basis of a contract, no later than a month later, draw up an act of acceptance of the completed part of the object with a description of the state of the object, indicating the volume and cost of work performed, a list of applied (mounted ) at the facility of equipment, materials and structures, a list of unused and subject to storage equipment, materials and structures, a list of works necessary for the safety of the facility and unused equipment, materials and structures.

6.15.4. If necessary, the designer, under an agreement with the developer (customer), develops working documentation and an estimate for the conservation of the facility, and the person carrying out the construction performs the work provided for by these working documentation and estimates.

6.15.5. The mothballed object and the construction site during the construction on the basis of the contract are transferred under the act to the developer (technical customer). The act is accompanied by as-built documentation, work logs, as well as documents on inspections, inspections, control tests, measurements carried out during construction, documents of suppliers confirming the compliance of materials, works, structures, process equipment and engineering systems of the facility with the project and the requirements of regulatory documents.

7. Construction control and construction supervision

7.1. Construction participants - a person carrying out construction, a developer (customer), a designer - must exercise construction control, provided for by the legislation of the Russian Federation on urban planning, in order to assess the compliance of construction and installation works, structures being erected, systems and networks of engineering and technical support for a building or structure requirements of technical regulations, design and working documentation.

The person carrying out construction, as part of construction control, performs:

  • Input control of project documentation provided by the developer (customer)
  • Survey of the geodetic center base of the capital construction object
  • Input control of applied building materials, products, structures and equipment
  • Operational control during and after completion of construction and installation operations
  • Examination of completed work, the results of which become unavailable for control after the start of subsequent work
  • Survey of critical building structures and sections of engineering and technical support systems
  • Testing and testing of technical devices.

Construction control of the developer (customer) in accordance with the current legislation is carried out in the form of control and supervision of the customer over the performance of work under a construction contract according to 7.3.

In the cases provided for in 7.4, as part of construction control, architectural supervision of the person who prepared the project documentation (designer) is carried out.

7.1.1. During the input control of project documentation, all submitted documentation, including the POS and working documentation, should be analyzed, while checking:

  • Its completeness
  • Availability of approvals and approvals
  • Correspondence of the design axial dimensions and the geodetic base
  • Availability of references to regulatory documents for materials and products
  • Compliance of the boundaries of the construction site on the construction general plan with the established easements
  • Availability of requirements for the actual accuracy of controlled parameters
  • Availability of instructions on methods of control and measurement, including in the form of links to relevant regulatory documents

If deficiencies are found, the relevant documentation is returned for revision within the time period specified in the contract.

7.1.2. The person carrying out the construction carries out the acceptance of the geodetic marking base provided to him by the developer (technical customer), checks its compliance with the established requirements for accuracy, reliability of fixing signs on the ground; for this purpose, it is possible to involve independent experts who have a certificate of admission issued by a self-regulatory organization to work on the creation of reference geodetic networks.

Acceptance of the geodetic staking base from the developer (technical customer) should be formalized by the relevant act.

7.1.3. The input control checks the compliance of the quality indicators of the purchased (received) materials, structural products and equipment with the requirements of the standards, specifications or technical certificates for them specified in the project documentation and (or) the contract.

At the same time, the presence and content of the supplier's (manufacturer's) accompanying documents confirming the quality of the specified materials, structural products and equipment are checked.

If necessary, control measurements and tests of the above indicators can be performed. Methods and means of these measurements and tests must comply with the requirements of national standards. The results of the input control must be documented in the logs of the input control and (or) laboratory tests.

7.1.4. In the case of inspection and testing by the involved laboratories, it is necessary to check the compliance of the methods of inspection and testing used by them with the established national standards.

7.1.5. Materials, structural products, equipment, the non-compliance of which with the established requirements is revealed by the input control, should be separated from suitable ones and marked. Works using these materials, structural products and equipment should be suspended. The developer (customer) must be notified of the suspension of work and its reasons.

One of three decisions can be made in accordance with the law:

  • The supplier replaces non-conforming materials, structural products, equipment with appropriate
  • Nonconforming products of structures are being finalized
  • Inappropriate materials, structural products can be used after mandatory agreement with the developer (customer), designer and state control (supervision) body within its competence

7.1.6. By operational control, the person carrying out the construction checks:

  • Compliance of the performed production operations with the organizational, technological and regulatory documentation applicable to these production operations
  • Compliance with technological regimes established by technological maps and regulations
  • Compliance of quality indicators of operations and their results with the requirements of design and organizational and technological documentation, as well as regulatory documentation applicable to these technological operations

Places for performing control operations, their frequency, performers, methods and measuring instruments, forms for recording results, decision-making procedures in case of identifying inconsistencies with established requirements must comply with the requirements of design, organizational, technological and regulatory documentation.

The results of operational control should be documented in work logs.

7.1.7. To perform operational quality control, documents containing:

  • The list of operations or processes that are subject to verification for quality indicators
  • Structural drawings indicating the tolerances in dimensions, the required measurement accuracy, as well as the materials used
  • Places of control, their frequency, methods, performers, measuring instruments and forms for recording results"

7.2. During the construction process, an assessment should be made of the work performed, the results of which affect the safety of the facility, but, in accordance with the accepted technology, become inaccessible for control after the start of the subsequent work, as well as the completed building structures and sections of engineering networks, the elimination of defects of which, identified control is impossible without dismantling or damaging subsequent structures and sections of utility networks. Representatives of the relevant bodies of state supervision, architectural supervision, as well as, if necessary, independent experts may participate in these control procedures. The person carrying out the construction, within the terms agreed, but no later than three working days, notifies the other participants of the terms of the specified procedures.

7.2.1. The results of the survey of work hidden by subsequent work, in accordance with the requirements of the design and regulatory documentation, are drawn up in certificates of survey of hidden work,. The developer (technical customer) may require a re-examination after the identified defects have been eliminated.

7.2.2. To the procedure for assessing the conformity of individual structures, tiers of structures (floors), the person carrying out the construction must submit certificates of examination of all hidden works that are part of these structures, geodetic executive schemes, as well as test reports for structures in cases provided for by the design documentation and (or) building contract. The developer (technical customer) can perform verification of the reliability of the executive geodetic schemes submitted by the contractor. For this purpose, the person carrying out the construction must keep the stakeout axes and installation landmarks fixed in kind until the acceptance is completed.

The results of the survey of individual structures should be documented in certificates of survey of critical structures.

7.2.3. Tests of sections of engineering networks and installed engineering equipment are carried out in accordance with the requirements of the relevant regulatory documents and are drawn up by the relevant acts.

7.2.4. If, as a result of construction control, defects in works, structures, sections of engineering and technical support networks are detected, the relevant acts should be drawn up only after the elimination of the identified defects.

In cases where subsequent work must begin after a break of more than six months from the moment the phased acceptance is completed, these procedures should be repeated before the resumption of work with the execution of the relevant acts.

7.3. Construction control of the customer performs:

  • Checking that the person carrying out the construction has quality documents (certificates in established cases) for the materials, structural products and equipment used by him, documented results of input control and laboratory tests
  • Monitoring compliance by the person carrying out the construction with the rules for warehousing and storage of materials used, structural products and equipment; if violations of these rules are detected, a representative of the construction control of the developer (customer) may prohibit the use of improperly stored and stored materials
  • Control of compliance of operational control performed by the person carrying out the construction with the requirements of 7.1.6
  • Control over the availability and correctness of maintenance by the person carrying out the construction of as-built documentation, including the assessment of the reliability of geodetic executive schemes of completed structures with selective control of the accuracy of the position of elements
  • Control over the elimination of defects in the design documentation identified during the construction process, documented return of defective documentation to the designer, control and documented acceptance of the corrected documentation, its transfer to the person carrying out the construction
  • Control over the execution by the person carrying out the construction of the instructions of state supervision bodies and local self-government
  • Notification of state supervision authorities about all cases of emergency at the construction site
  • Assessment (together with the person carrying out the construction) of the compliance of the work performed, structures, sections of engineering and technical support networks, signing of bilateral acts confirming compliance; control over the fulfillment by the person carrying out the construction of the requirement on the inadmissibility of performing subsequent work before the signing of these acts
  • The final assessment (together with the person carrying out the construction) of the compliance of the completed facility with the requirements of the legislation, design and regulatory documentation.

7.3.1. Mandatory assessment of the conformity of buildings and structures, as well as the processes of design (including surveys), construction, installation, adjustment and disposal (demolition, dismantling) related to buildings and structures, is carried out in the form of:

  • Declarations of Conformity of Design Documents
  • State expertise of the results of engineering surveys and project documentation
  • Building control
  • State Construction Supervision
  • Declarations of conformity of the constructed, reconstructed or repaired building or structures with the design documentation
  • Declarations of conformity of a constructed, reconstructed or renovated building or structure
  • Commissioning of the facility

7.4. During the construction of hazardous production facilities, as well as especially dangerous technically complex and unique facilities, designer supervision is carried out. In other cases, it is carried out at the discretion of the developer (customer). The procedure for implementation and functions of architectural supervision are established by SP 246.1325800.

7.5. The comments of the representatives of the building control of the developer (customer) are documented in the general and special journals of work, the comments of the representatives of architectural supervision - in the journal of architectural supervision. The facts of elimination of defects according to the comments of these representatives are documented with their participation.

7.6. Author's supervision of the architect is carried out by the author-architect on an initiative basis, regardless of the decision of the developer (technical customer) and the existence of a contract for architectural supervision of construction. The territorial authority for architecture and urban planning, at the request of the author, having verified his authorship, may issue an order to the developer (technical customer) to ensure the author's admission to the construction site, the possibility of making entries in the author's supervision journal. The claims of the author-architect regarding the implementation of architectural design solutions may be considered by the urban planning and architecture authority, whose decision is binding on the developer (technical customer).

7.7. State construction supervision is carried out in the cases provided for by the legislation on urban planning activities in accordance with the legislation of the Russian Federation on urban planning activities and other regulatory legal acts.

State construction supervision authorities assess the compliance of the construction process of a particular facility upon receipt of a notice from the developer (customer) about the start of construction work.

7.8. In order to limit the adverse impact of construction and installation works on the population and the territory in the zone of influence of ongoing construction, local governments or organizations authorized by them (administrative inspections, etc.) conduct administrative control over construction in accordance with the procedure established by current legislation.

Administrative control consists in preliminary setting the conditions for construction (the size of the construction site fence, temporary work schedule, garbage removal, maintaining order in the adjacent territory, etc.) and monitoring compliance with these conditions during construction. The builder is responsible to the local self-government body, unless otherwise provided by the contracts.

The conditions for conducting construction are established in the form of an order or other document issued by the local administration or organizations authorized by it in accordance with the regulatory legal acts of the constituent entities of the Russian Federation.
