Get a home for a young family. How can a young family get an apartment. Grounds for recognizing the need to increase or acquire living space

Money to buy an apartment for a young family can be obtained from the state if you use a special federal program. The main condition is to meet the requirements, the most important of which is that either spouse must be under 35 years old. At present, the main provisions of the program, including the latest amendments, are set out in Government Decree No. 889 dated August 25, 2015.

The difficulty in this case is not even in the documents, the collection of which has to be dealt with ahead of time. For each subject of the federation, allocation limits are approved annually budget funds for the implementation of the program. If the number of applicants is higher than the established limit, then priority will be given to those who have been registered for longer, as well as to large families.

Acquisition of housing under the program "Young family - affordable housing"

It is possible to receive a subsidy for the purchase of housing for young families with the passage of a number of mandatory procedures. You should start them only after making sure that the requirements for participants are true. If both spouses are already over 35 years old, then they will no longer be able to use the state subsidy.

After the family submits an application and registers as a participant federal program she is issued a certificate. This document confirms the right to receive social benefits and is valid for 7 months from the date of its issue. The certificates are issued by the same municipal authorities that sign the decision to register the family in the program.

The certificate cannot be used in any other way than to hand it over to the bank that will service the sale and purchase transaction. The list of accredited banks is also presented by the local government. A current account is opened in the name of any of the family members, through which the amount of the subsidy will be transferred first from regional budget and then to the seller's account in payment of the price of housing.

It is not possible to receive cash grants. The mechanism described above is implemented in the same way in all regions without exception. At the same time, a single family has the right to exercise its right to funds from state budget only 1 time.

Membership requirements

Families can be both complete and incomplete (with 1 parent and a child / children), and with children, and without, as well as those in which one of the spouses is a foreigner. But there are mandatory requirements, namely:

  • When signing the decision, either spouse must be under 35 years of age.
  • The family needs housing and it is registered in the relevant register.
  • The spouses have money to pay off the balance of the price of the acquired property. It is best when the required amount lies on bank account or bank-approved mortgage loan.

In other words, the family repays part of the cost of the purchased housing with a subsidy, and pays the rest with their own money or a mortgage loan. If we are talking specifically about mortgages, then you need to start by entering the family in need of housing in the register (the grounds are set out in Article 51 of the LC RF), then apply for a mortgage loan, and only after that apply for participation in the federal program.

Priority is given to those families who were registered as needing housing before 03/01/2005, as well as those with 3 or more children.

What can the allocated funds be used for?

The conditions of the federal program strictly regulate the purposes for which the budget money provided to a young family can be spent. This list includes:

  1. Payment for the purchase of a home.
  2. Payment for housing construction.
  3. Payment of the balance to the account of the final share contribution.
  4. Mortgage down payment.
  5. Repayment of part of the cost of housing purchased by an authorized organization for a young family.
  6. Repayment of the main debt or interest on it under a mortgage issued before 01/01/2011 (fines and penalties for late current payments cannot be repaid).

The local self-government body supervises the fulfillment of the requirements of the program. If it is revealed that the money was spent for other purposes, then the family will be obliged to return all the funds back.

What is the amount of the subsidy?

The amount is assigned in proportion to the composition of the family. The rules are as follows:

  1. The subsidy is equal to 30% of the average price for living space in the region (within the normative minimum living space for each spouse in a childless marriage).
  2. Families with children receive 35% of the average housing price in the region.

When either spouse is a foreigner, only those who are citizens of the Russian Federation are taken into account. In other words, the calculation is performed as for an incomplete family.

The housing area used to calculate the subsidy is determined according to the rule:

  1. A family of 2 (spouse only or parent + child) is entitled to 42 sq.m.
  2. Family and 3 or more people - 18 sq.m. for everyone.

Czh \u003d N x Pzh,

  • Tzh - the price of housing;
  • N - normative value prices for 1 sq.m. housing in a given locality, which cannot be more than a similar value for this region approved by the Ministry of Construction;
  • Pzh is the area of housing.

The normative value can be clarified in the municipality, and the regional value is given in the Order of the Ministry of Construction and Housing and Communal Services 1691 / pr dated December 20, 2017. For example, for the Moscow Region H = 54479 rubles. per 1 sq.m.

Calculation example:

A family of two buys an apartment with a standard area of 42 sq.m. According to the terms of the program, the subsidy is 30% of the cost of housing (Zh). The apartment is located in the Moscow region.

Then Czh \u003d 42 x 54479 \u003d 2288118 (rubles).

The subsidy will be 2288118 x 0.3 = 686435.4 (rubles).

The calculation of the amount of the subsidy is carried out simultaneously with the issuance of a certificate of entitlement to receive it, and fits into it. Thereafter, the amount does not change.

What documents are needed?

You need to contact the municipality where you live. Together with the application in 2 copies for participation in the federal program (1 copy with a mark of acceptance remains with the applicant) are submitted:

  • Passports and certificates for all households.
  • Marriage certificate (incomplete families do not submit).
  • Certificate of registration for those in need of housing.
  • A document proving that the family has money to pay the remaining part of the price of housing.

The term for making a decision on the application accepted for consideration is not long - 10 days. The municipality then has 5 days to communicate the decision to the family in writing.

Grounds for refusal

Getting rejected for an application is unpleasant, but do not give up. The reasons for refusal, which may be guided by the municipality, are set out in the conditions of the program. These include:

  1. The family does not qualify for the grant.
  2. Not all documents included in the mandatory list have been submitted.
  3. The information provided in the documents, after verification, turned out to be unreliable.
  4. The family has already used social benefits or other state support to purchase housing (maternity capital is not taken into account).

If the refusal of the municipality contains another reason, it can be challenged. If the reason can be eliminated, then you can again try to submit an application, taking into account all the comments.

Lists of participants for the next year are formed before September 1. All whose applications have been submitted up to this time and approved will be included in the next year's list. If the deadline is missed, then it will be possible to apply only after the New Year, when the municipality starts work.

Documents accepted, what's next?

The executive authority of the subject of the federation accepts the generated lists of families for consideration. 10 days are given to notify municipalities about the limits allocated for the payment of subsidies. On whether the applicant family was included in the list for receiving a subsidy in this year it is notified by the municipality (within 5 days after receiving notification of the approved limits).

After that, certificates of eligibility for subsidies are issued. The program has a 30-day period for this. The family is notified that it is necessary to submit an application and documents to it. The received certificate is submitted to the bank (the period is 1 month after registration, otherwise the bank will not accept the certificate). Further, the bank forms a request and sends it through the official channel to the municipality for the transfer of funds.

Money can be spent, but only as permitted by the terms of the federal program. At the same time, the details of the certificate for the state subsidy are certainly listed in the contract certifying the fact of the transaction. The family deposits their money, delivers a document proving the fact of the transaction to the bank branch. After checking all the information, the bank asks the municipality to receive a subsidy, which it then transfers from the family's account to the second party to the transaction (only 5 days are allotted for this from the date the money was credited to the account).

The program is allowed to buy housing only within the subject in the municipality of which the subsidy was issued. In other words, you cannot use the subsidy to buy the property you like in another city.

Acquired (built) housing must be registered for all family members. This also applies to minor children. Everyone becomes a co-owner, which is confirmed by an extract from the USRR, as well as a document confirming the transaction.

If, for some reason, a family received a certificate, but did not use it for its intended purpose, it does not lose the right to use the subsidy. A certificate of account closure is submitted to the municipality. And then the whole procedure will have to go through from the very beginning.

For every young family, sooner or later, there comes a moment when you need to boldly face the terrifying "housing problem" and tackle it. At 20 years old, buying your own home seems like an unattainable dream, but the sooner you pull yourself together and start striving for it, the sooner it will come true. In this article, we will give advice on how to buy an apartment for a young family, and how to get on the waiting list for an apartment.

We list the available legal ways, for a young family with an average income: how to get in line to buy an apartment.

Method number 1. Inheritance or gift from parents.

The easiest and fastest way for a young couple to get their own living space - the help of parents and inheritance, unfortunately, is not available to everyone. Even if your parents are not able to present you with a new home, living with them or a little financial support will be a very tangible help in purchasing your apartment.

Method number 2. Mortgage.

A simple and popular way, it seems to many newlyweds the only way to buy an apartment, but how does it look in practice?

Problem mortgage lending for the borrower is simple - the apartments are very expensive. Apartments are so expensive that payments for them stretch for decades, and the annual percentage, even a small 10%, turns into large overpayments.

Let's take as an example the registration of a mortgage for a studio apartment (average area - 25 sq.m) Calculations are approximate.

Bottom line: monthly payment - 12 thousand rubles, total overpayment - 50% of the cost of housing.

Even in such an ideal system with a small percentage and a modest amount, the overpayment is significant, if you estimate more real numbers, the picture looks something like this:

Average apartment in a big city

Outcome: monthly payment 27 thousand rubles, overpayment - 112% of total cost, in total you have to pay 5,300,300 rubles. Not the best prices for a young family.

Fortunately, there is a good help - the Young Family program. If you fall under this program in all respects, the state will help pay mortgage percent by 30 (in some cases up to 35%).

How to get on the waiting list for housing for a young family and what is needed for this?

Conditions in different regions may vary slightly, but they are basically the same. In order to get on the waiting list for an apartment for a young family, you need to follow the conditions:

  • The age of spouses or a single parent is up to 35 years.
  • Need for improvement living conditions and a certificate confirming it.
  • Fixed income.
  • Registration of both spouses in the same living space.

If you provide all the relevant certificates, you will receive a response within 10 days, if you are denied due to insufficient income, you can apply again in the same year

For young childless families, there is another little "life hack" that is not suitable for everyone, but can make interest payments 20-30 easier. Rent an inexpensive room in a communal apartment, hostel, from the owner or an apartment in half with the same couple, and rent out your own, bought on credit. This method is also good because, for example, you can save on repairs, make an apartment habitable at no extra cost.

Method number 3. Savings.

This method is really good when it is possible to live calmly and without any hesitation with parents or other relatives. To live, work without much spending and slowly save up for your own housing is an ideal opportunity, alas, rarely available.

Combining savings with rental housing is more expensive, but with the right and economical approach, this option is more profitable than a mortgage.

Again, simple calculations:

Target: accumulate 1 million rubles.

Initial amount: 100 thousand rubles.

Deposit With annual rate at 10 o'clock%.

Term- 5 years.

Monthly top-ups- 12 thousand rubles.

Outcome: the same million rubles, for five, not ten years of payments with a smaller initial contribution.

The downside of this method is inflation, which in the same five years can tear off a decent chunk of your savings, so saving money "under the mattress" does not make sense, only good deposit in the bank.

If we need a larger amount:

Target: accumulate 2.5 million rubles.

Initial amount: 200 thousand rubles.

Deposit with an annual rate of 8%.

Term- 7 years.

Monthly top-ups- 21 thousand rubles.

Outcome: the same two and a half million rubles, twice as fast, with a smaller monthly payment and without overpayments.

When doing your own calculations, include in rent and utilities for the housing you rent, to be sure of the profitability of your decision.

This method is more promising and profitable than a mortgage, but requires a competent approach and stability of the financial market.

Method number 4. Life annuity agreement.

Life annuity and dependent maintenance is a very ambiguous and legally difficult option.

A life annuity contract is concluded with elderly people who have no one to take care of. According to this agreement, the pensioner is paid an initial amount of approximately one third of the cost of his housing, then fixed monthly payments (at least two living wages) in exchange for housing. The term of the contract is limited to the life of an elderly person, that is, in practice, lifelong provision of a poor pensioner comes out in exchange for his living space. Usually, the recipient of the rent continues to live in his house, but, by agreement and provision of another housing, he can move.

An agreement that includes maintenance with a dependent is preferable for the homeowner, but not very convenient for the rent payer, since it requires direct care and provision of the pensioner with everything necessary. The difficulty lies in the fact that it is quite difficult to agree on specific services and the provision of human needs. Also, the difficulty is the proof that the obligations of the payer have been fulfilled, if suddenly there are problems with the termination of the contract and litigation. The problem with this deal is to protect both parties.

The payer becomes the full owner only after the death of the recipient of the rent, therefore it is impossible to sell, rent, move into the premises without a special agreement with the landlord.

Communicate in advance with those who know the person with whom you are going to conclude an agreement - neighbors, acquaintances, a local postman, and so on. Find out if there are any relatives applying for this apartment, and if there will be any problems with them.

Conclusion

Acquisition of housing is a laborious, but quite real task. The main thing that is required from a young family to achieve this goal is competent planning and hard work. Analyze, count, ask your friends and relatives for advice and put maximum effort into your future, then you will succeed.

The Constitution of our country provides for the right to housing. The state, fulfilling this obligation, provides free housing to all those in need on a first-come, first-served basis. In addition, there are other ways to get an apartment. Unfortunately, it takes a very long time to wait for help from the state. Therefore, it is worth considering other ways to solve the problem. • belonging of family members to the poor category of citizens.

That is, citizens living in cramped housing conditions, having a small income, insufficient to purchase their own housing, can stand in line. It does not matter if the apartment is privatized or not. The priority parameter in this case will be the financial insolvency of citizens.

The new housing code has significantly reduced the number of people on the waiting list for free housing. But, despite this, there are still quite a lot of them.

It should be noted that those who have joined the queue for housing before the adoption of new amendments do not need to submit documents and prove the impossibility of acquiring new housing at the expense of personal Money. And how to get an apartment from the state for those who want to solve their problems? housing problems after 2005? They will have to prove that they belong to the low-income category.   • citizens living in emergency houses and affected by cataclysms and other emergencies;

Benefits for large families

Families with many children are the most vulnerable category of citizens in our country. The state is trying in every possible way to improve their financial and housing situation. Apart from maternity capital it offers assistance in a different form: a large family can be allocated a land plot free of charge. Its size is set in each region separately. In the birth certificate of the child, information about the father must either be absent or be recorded from the words of the mother. After consideration of the application, the queue for obtaining square meters is determined. The decision is issued in writing. In the course of distribution, this category receives apartments in the first place. Or they are reimbursed for the cost of the acquired housing. Until housing becomes the property of the family, according to the code of our country, the following transactions are not allowed with it:

  • sell;
  • exchange;
  • rent out;
  • bequeath;
  • make a gift.

Other opportunities to get an apartment for free

Since it is almost impossible for a young family to get an apartment from the state (the waiting period is 10 years at best), it is worth talking about other possibilities.

Ways to get an apartment:

  • Conclude a contract for a lifetime annuity. It is drawn up by a notary and registered with the Federal Registration Service. According to the contract, the apartment becomes the property of the renter, but its management is limited. Along with ownership comes responsibilities. They are written into the contract and without fail must be performed.
