Case specifics

A criminal record of a citizen of the Russian Federation is an important condition that is an obstacle to leaving the country. In particular, the verdict, which has already entered into force. The end of the criminal record means the removal of the ban on traveling abroad. Specific deadlines are set out in Art. 86 of the Criminal Code of the Russian Federation. Exceptions are such cases:

  • if the citizen was pardoned or fell under an amnesty;
  • if the verdict of the court was canceled and the criminal case was closed;
  • the statute of limitations for the sentence expired, and the decision was not used due to circumstances.

Difficult situations

If a citizen of the Russian Federation is drafted into the army or is currently serving in the civil service, then he is automatically deprived of the right to travel abroad. The exception is the contractor. He must have with him the permission of the unit commander for unhindered travel outside the Russian Federation. Also an exception are those citizens who have been issued a deferment from military service or conscripted release.

If a citizen of the Russian Federation is an employee of the FSB, then under the contract he is forbidden to cross the border. In case of special need to travel abroad, it is necessary to submit a report on the temporary lifting of the restriction 3 months before the day of departure.

When providing deliberately false information when submitting documents for traveling abroad, a ban is imposed on a citizen for a period of 1 month. The basis in this case is the proven fact of submission of false information.

If a citizen has access to state secrets. A feature of this condition is the degree of secrecy of documents. There are three degrees: secret, top secret, documents of special importance. For example, if a citizen has access to documents classified as "secret", then this is not a basis for a ban on traveling abroad.

Steps to get banned

If you have several debts, then there will be difficulties at the border when checking documents. After all, the imposition of a ban is a lengthy procedure. It starts directly in court.

  1. Court. In the event of a prolonged non-payment of the loan amount, the lender files an application with the court. After that, the case is studied in detail and a verdict is pronounced. If, by decision of the court, payment is not received again, then the plaintiff is forced to turn to bailiffs. However, even after this stage, the process cannot be called final.
  2. Bailiff. First, the bailiffs should inform the defendant that he will have to voluntarily pay off the debt. If payment is received within 5 days, then the debtor will not have a ban on traveling abroad. Otherwise, the bailiff has every right to seize the debtor's property and impose restrictions.
  3. Border Service. The debtor must receive the relevant decision in triplicate. The same document must be received by the FMS and the border service. The bailiff has the authority to choose a measure of punishment if the debt is more than 10 thousand rubles.

Signing an application in court and transferring the decision to the border service is a lengthy process. It is worth considering that the ban is not a life sentence. It is valid until all payments have been made. debentures. Usually the restriction is valid for 6 months. In the event of the obstinacy of the debtor, the bailiff has the right to renew the ban on traveling abroad. However, this can take a very long time.

Whether enforcement proceedings have been initiated in my name: how to check?

Information about possible excitation should be checked immediately enforcement proceedings regarding you. You can do this in two ways:

  • on the official website of the FSSP RF online, you should find the section "Data Bank of Enforcement Proceedings";
  • personally visit the territorial FSSP department RF.

In the absence of enforcement proceedings, you can safely make plans for an upcoming trip abroad. And in the case of existing debts, you should go in the most optimal way and pay them off. Only the payment of all debts is the guarantor of unhindered travel abroad.

In order to obtain information about the existing debt in enforcement proceedings and the imposed restriction on traveling abroad of the Russian Federation, you must fill out the attached form on the relevant website. According to the data entered, you can see what debts you may not be allowed to leave the country.

How to check the ban on leaving the Russian Federation?

Usually a travel ban is imposed even because of an underpaid fine or a small long utility bill. According to unofficial statistics, mostly men who are in arrears in paying alimony are not allowed to go abroad. As mentioned above, a restriction can be imposed by a court with the help of bailiffs.

Therefore, if you are going to travel abroad soon, you need to check the ban on leaving the Russian Federation in advance.

  1. Official resource as well as the Federal Tax Service. It is on these sites that you can find information about whether you have debt. By the way, the option of paying the debt is available.
  2. On the official website of the traffic police, you can immediately check for an unpaid penalty. It is necessary to prepare the VIN number in advance.
  3. The ubiquitous website of public services, where you can immediately order a certificate of existing debts, including fines and penalties.
  4. It will be useful for citizens who have their own business to look at the website of the Prosecutor General's Office of the Russian Federation.

Ban on leaving the Russian Federation check online - this is a necessary procedure that should not be neglected. Approximately 30 days before the trip, you can order a certificate of payment of the debt on the website. In this case, you definitely will not have problems at the border.

Where to check the data

With the help of the Federal Migration Service of the Russian Federation, it is even easier to check the ban on leaving the Russian Federation. You must submit a request to this authority. After that, you will be able to receive a corresponding notification in your hands, which will contain the following data:

  • duration of the travel restriction;

  • the name and legal address of the organization that placed the travel ban.

In case of disagreement with the decision of restrictions on crossing the border, every citizen has the right to file a complaint with the court or apply to the FMS. Therefore, it is worth checking the ban on leaving the Russian Federation in advance.

Another way to self-check the ban on leaving the country

The Federal Migration Service will check the ban on leaving the Russian Federation when applying for a passport. In the event of an existing ban, you will be denied the issuance of a document.

There is no online service on the official website of the Main Department of Internal Affairs of the Ministry of Internal Affairs. Therefore, it is simply impossible to check the travel ban for citizens who have a passport.

Is there a way out?

If you are completely sure that you have a debt, and a long-awaited vacation awaits you, then you need to act. Being informed is only half the battle. The situation does not tolerate delays.

  1. First of all, you must immediately pay off the existing debt. Moreover, this can be done very simply by visiting any branch of the bank. Also, the operation can be performed on the website of the bailiffs.
  2. After that, you should contact the bailiff and show a receipt for payment.
  3. The bailiff draws up a decision to lift the ban and sends it to the border service. You must have a copy of this document in your hands, necessarily certified by the seal of the department.

How long does it take

It makes no sense to show paid receipts to border guards, because they act exactly according to internal sources.

The transfer of the decision and the updating of the databases may be delayed. Often this period is at least 14 working days. The main thing is that you worry in time and take the time to check for a ban on leaving the Russian Federation. Only after passing these stages will you be granted access to cross the border.

If you have any restrictions on leaving the country, then once again you should check your passport for a ban on leaving the Russian Federation. In this way, you will save yourself from unnecessary hassle and problems at customs or at the airport terminal.

By the way, if you were refused to cross the border of the country, then be sure that no one will return the money spent on the ticket.

As the old wise proverb says, it is better to measure seven times, and cut once. In our case, it is better to check the ban on leaving the Russian Federation a hundred times and calmly cross the border. Remember that the timely repayment of existing debts is a guarantee of unimpeded visits to other countries.

In a relationship Russian citizens a ban on the right to travel abroad may be imposed. This measure is taken by authorized bodies for various purposes, but the most common reason for establishing a ban is the debtors' evasion from fulfilling obligations. Many do not repay debts, forgetting about their existence, and therefore, before planning a trip abroad, everyone should check whether they are not subject to a ban on crossing the border of the Russian Federation. Unfortunately, not many are aware of how to find out if there is a ban on traveling abroad in 2019.

The head of the Ministry of Internal Affairs of Russia, Vladimir Kolokoltsev, approved the list of countries where employees of the Ministry of Internal Affairs are allowed to travel in 2019. The list lists 13 states that are considered safe for police officers. Among them: Vietnam, Cuba, China, Abkhazia, Azerbaijan, Armenia, Belarus, Kazakhstan, Kyrgyzstan, Tajikistan, Turkmenistan, Uzbekistan and South Ossetia. According to the approved list, civil servants can also go on vacation. I would like to recall the fact that Russian police officers were banned from going on vacation in the spring of 2014 due to the international political situation.

Grounds for a travel ban

current Russian legislation provides for a number of cases when residents of the country may be restricted from traveling abroad. This may be due to the person's belonging to special categories of citizens or the fact that the authorities suspect him of trying to avoid responsibility and obligations.

The restriction on travel abroad for debtors is temporary. Moreover, in the case of the presence of unfulfilled obligations, debts are important not only to the state, but also to legal entities and individuals.

Refusal to provide the opportunity to travel abroad may follow due to the lack of any important documents or indications of knowingly false information in them. It also implies compliance with certain requirements, in case of violation of which it will be impossible to leave the country.

Categories of persons subject to a ban on traveling abroad

The list of persons for whom travel abroad of the Russian Federation may be temporarily restricted is given in the text of the Federal Law of August 15, 1996 No. 114-FZ “On the Procedure for Departure from the Russian Federation and Entry into the Russian Federation”. Among those who are prohibited from traveling abroad are the following categories of citizens:

  • employees and employees of the FSB;
  • who knowingly provided false information about themselves when preparing documents for traveling abroad;
  • convicted of a crime;
  • suspected of committing a crime or involved as defendants in accordance with the criminal procedure legislation of the Russian Federation;
  • or sent to alternative civilian service;
  • admitted to top secret data and information of particular importance and concluded labor contract prohibiting temporary exit from Russia.

Let us consider each case in more detail and see what conditions must be met in order for the restriction of the right to leave to be imposed legally.

Officials and employees of the Federal Security Service

Persons who provided false information about themselves

If, when checking the documents required for traveling outside Russia, information is found that does not correspond to reality, a person is restricted in his rights to travel abroad for providing false information about himself. When drawing up papers, all citizens sign the authenticity of the data they reported, and therefore it is not possible to prove the absence of malicious intent.

Persons with debts and unfulfilled obligations

The most common reason why Russians cannot travel abroad is evasion of obligations imposed by the court. The procedure for imposing a temporary restriction on debtors traveling abroad is set out in the text of Article 67 of the Federal Law of October 2, 2007 No. 229-FZ “On Enforcement Proceedings”. Citizens may intentionally or inadvertently not repay debts for:

  • payment of alimony.

To get acquainted with the full list of debts with which they will not be released abroad, you can read our material: "".

A restriction on the departure of a person outside Russia may be imposed if the following conditions are simultaneously met:

  1. There is an executive document ( judicial act or a document issued on its basis) indicating the reasons for the restriction on exit.
  2. A copy of the decision was handed over to the debtor himself and to an employee of the border service and the territorial authority tax service not later than the next day from the date of the decision.
  3. The judicial act entered into force (the existing complaints were rejected, the deadlines for appealing expired).
  4. The writ of execution is not overdue: at the time when it was submitted for execution, it had not yet expired three year term from the date of entry into force of the judgment.
  5. The writ of execution does not imply the fulfillment of property obligations, or the amount of debt under this document exceeds 10,000 rubles.

If the recoverer decides to file an application, the restriction on the debtor's departure may be imposed at the same time as the commencement of enforcement proceedings, regardless of whether the second one fulfills its obligations or continues to evade them. The ruling may also be issued before the expiration of the time limit set for voluntary execution.

In such cases, the restriction on travel abroad will be lifted only when:

  • obligations will be fulfilled in full;
  • the parties reach an agreement;
  • enforcement proceedings will be terminated;
  • the proceedings on the case will be completed (if the end of the proceedings on the case is connected with its transfer to another division of bailiffs, the order not to leave the place may continue to be valid).

In all of the above cases, the bailiff issues a ruling according to which the citizen is no longer restricted from traveling outside the country. The document indicates that the obligations of the citizen were fulfilled; if they were not fulfilled, the reason will be indicated, which must be valid. The travel ban will be finally lifted on the day when the decision is received by the Border Control Department of the Border Guard Service of the Federal Security Service of the Russian Federation.

Take a sociological survey!

Suspected of committing a crime, involved as an accused, convicted

Citizens are suspected if one of the following occurs:

  • after the inquiry, a notification was received about the suspicion of a person in criminal acts;
  • preventive measures were applied;
  • the person was detained on suspicion of criminal acts;
  • a criminal case was initiated.

Citizens are recognized as accused if:

  • there is a decision to bring a person as a defendant in the case;
  • At the end of the inquiry, there is an indictment.

Convicts have the right to leave the Russian Federation only if they have been released from punishment for any of the legal grounds. Parole does not give the right to travel abroad, despite the fact that it was possible to avoid the punishment itself. The same applies to persons sentenced conditionally.

For more information on whether it is possible to travel abroad with a suspended sentence, see our material: "".

Conscripts and called up for alternative civilian service

Representatives of the male part of the population of Russia may be restricted from leaving the country from the date the draft board decides to call them up for military service or to send them to alternative civilian service.

If a person of draft age is not in the reserve, his call for service may occur in the periods from October 1 to December 31 and from April 1 to July 15. Cannot be restricted in leaving Russia:

  • men of military age who received a deferment or exemption from conscription;
  • contracted employees who have permission to leave from their command.

Persons admitted to state secrets

It is allowed to restrict travel abroad only to citizens who had access to state secrets of the degree of “special importance” and “top secret”. The third degree - "secret" - does not give the right to establish a requirement not to leave, if there are no other grounds for this.

Access to a secret should not be formal - a person should really be familiar with the composition of the secret. The fact of signing an employment contract or contract does not play a role - the law allows restriction of the citizen's right to leave even in the absence of these documents.

In order not to find out at the last moment whether border guards are closed to travel abroad, when everything is ready for the trip, it is better to use all accessible ways checking debts before planning to travel abroad, especially since citizens have the opportunity to check debts online for free.

Where and how can I find out if there is a ban on traveling abroad

Online verification of the ban on traveling abroad through the official website of the Ministry of Internal Affairs is not possible. It is possible to find out through this department about the presence or absence of a ban on crossing the country's border only if a person applies for. If the restriction was imposed, the document will not be issued to him at the Main Department of Internal Affairs of the Ministry of Internal Affairs (former FMS).

Checking for the presence of a surname in the list of persons restricted to travel abroad is offered by many commercial Internet resources, but entrepreneurs are not provided with access to the database of the Border Guard Service, and therefore information on unofficial sites cannot be trusted. You can check for free a ban on leaving Russia only through official sources.

People know about their belonging to special categories of citizens for whom travel abroad is limited. There remain citizens who doubt whether they have the opportunity to leave Russia because of unfulfilled obligations. In such cases, you can personally contact the nearest tax office and get information about debts to the state.

In the territorial office of the Federal Bailiff Service, you can find out whether a case has been initiated against the applied citizen. Even if the paperwork is ongoing, you can find out if the exit is allowed, since there may not be a protocol on the imposition of a temporary ban.

You can find out if the ban on leaving Russia has been lifted from you after you have paid off your debts and fulfilled other obligations, you can contact the Border Guard Service. Temporary restriction of the right to travel abroad is imposed by the bailiff. A copy of his decision will be received by the Border Guard Service of the FSB, after which the debtor's data will be entered into the database of “travel restricted” citizens.

When the obligations are fulfilled and there are no other grounds for restricting travel abroad, the bailiff closes and again sends the decision to the FSB, now to lift the ban. Only then the information is removed from the database and the citizen gets the opportunity to cross the Russian border.

To make sure that after paying the debts you were removed from the database, before planning a trip, you should contact the FSB:

  4. Click "Next".
  5. In the window that opens, you will be asked to enter the details of the taxpayer - TIN, last name, first name (patronymic - optional), and also select the region of residence from the drop-down list.

  8. You do not need to specify anything else - the search result will be presented on the page that opens. All data that does not constitute a tax secret will be displayed on the computer screen.

How long is the restriction

The terms during which citizens cannot travel abroad are established by the above law on the prohibition of travel abroad. They depend on the reason for the restriction.

In any case, the person will receive a notification from federal body executive power in the field of internal affairs (or its territorial body) indicating the grounds and time of restriction. The document will also contain the date and registration number of the decision to impose a travel ban, the name and legal address of the agency that initiated the restriction.

After the relevant decision on the cancellation of travel abroad is adopted, it is sent to the Border Guard Service. The ban will be finally lifted when the order is received, and on its basis the name of the debtor will be deleted from the database. The process may take 1-2 weeks.

In the case of debtors, the following events will occur during this period:

  • funds will go to the account of the FSS;
  • enforcement proceedings will be closed;
  • information about the repayment of the debt and the removal of the travel ban will be forwarded to the Border Guard Service;
  • the debtor's personal data will be deleted from the database.

Presenting payment receipts and any other supporting documents to border control officers will not help you leave Russia faster - the border guard is not authorized to accept such documents from individuals, and the citizen will still not be released abroad.

How can I get rid of the travel ban

With the restriction on the exit of special categories of citizens, there are no difficulties - the reasons for entering the “travel restrictions” into the database are clear. If the ban on traveling abroad applies to a person who has debts, you can leave the country at any time, as soon as the enforcement proceedings are closed.

The ban may be lifted on the following grounds:

  • the citizen's debt has been fully repaid;
  • the debtor has received an installment plan or a deferral of payment of the debt;
  • the debtor and the creditor have come to an amicable agreement;
  • the judicial act, after the adoption of which the enforcement proceedings were initiated, was canceled.

To be completely sure that the travel ban has been lifted, the following steps must be taken:

  • contact the bailiff, meet with him and present a photocopy of the receipt for payment of the debt;
  • take from the bailiff a photocopy of the decision to lift the ban on leaving Russia (it is necessary to certify it with the signature of the senior bailiff and the seal with the coat of arms);
  • request information about sending a copy of the decision to the Central Division of the Border Guard Service and the waiting time for the removal of the travel ban.

If a citizen is sure that he was undeservedly credited with debts and that he always paid his bills on time, he has the right to challenge the ban on leaving the country at the Main Department of Internal Affairs of the Ministry of Internal Affairs or in court. A complaint can be written to the prosecutor through the official website of the regional prosecutor's office.

If a refusal to issue a permit to cross the border was received by a person admitted to state secrets, he may file a claim with the court at the level of the constituent entity of the Russian Federation at the place where the negative decision was made. Military personnel who wish to challenge the decision of the command regarding the issuance of permission to travel abroad can apply to the military court.

Conclusion

In order not to spoil yourself and not to violate other plans related to traveling abroad, you should be careful about the timely fulfillment of obligations to government bodies, physical and legal entities. Debts to the state will be discussed in official letters from judicial and tax authorities.

Information can be clarified by using one of the Internet resources of public authorities for free. This is the only way to be sure that there are no unpaid bills. If payments were made, but there was no confirmation of payment, it is always possible to notify the interested authorities about the repayment of the debt.

An increasing number of people are trying to check the possibility of traveling abroad online. The relevance of this method is dictated by obtaining relevant data. Until the bailiff sends a copy of the decision, and the Russian Post delivers the letter to the address, it will take a lot of time, and no one has yet canceled last-minute vouchers. An online check will take a few minutes and as a result you will know if there is a travel ban or not?

Website of the State Services

It is always useful to find out how to find out if traveling abroad is allowed, having at hand only a link to the FSSP website? You can check for a "ban on leaving" according to the following instructions.

  1. Open the desired region (for example, Moscow).
  2. Enter your first name, last name and date of birth.
  3. Submit a request for processing.

The answer is information about current debts. It is possible that they will not allow you to travel abroad. Payment can be made directly on the FSSP website or through the State Services.

At the border guards

Often there is a situation when not bailiffs, but the border service issued a travel ban. This happens extremely rarely, but sometimes a ban is imposed. It’s worth mentioning right away that it’s unlikely that border guards will be able to check themselves for traveling abroad. The traveler is simply confronted with the fact that the border is closed for you. It is impossible to find out online about the ban from the border guards. There are options on how to do this, in the ways described above.

Terms of non-departure

Having found out that the prohibition is imposed exclusively by the court, and in individual cases senior bailiff, it must be said about the timing of the ban. Not to travel abroad is valid for six months from the date of issuance of the decision. If the situation with the debt does not change, the bailiffs can impose a ban again. And so an unlimited number of times.

It is impossible to automatically extend the 6-month ban on leaving the Russian Federation. This is successfully used by negligent payers. After waiting for the expiration date, they apply for a visa and fly abroad. It is not always possible to fight with an open "corridor".

How to remove the ban

You can cancel the ban on traveling abroad, but for this you need to fulfill one of the following conditions:

  • pay off or reduce debt;
  • issue an installment plan in the FSSP to pay off the debt;
  • provide evidence of the need for urgent travel abroad (official business, serious illness, death of a family member living abroad);
  • expiration of the writ of execution.

A hand-filled application for restricting the debtor's exit according to the model is submitted along with evidence. Here allocate medical certificates, bank statements, a statement from the recipient of alimony.

How to get compensation from bailiffs

Every year, the black list of those who do not travel abroad is replenished with new people, but is this always justified? Sometimes bailiffs impose a ban for minor reasons. Or the travel ban is maintained even after the debt is repaid. Negligence of people in uniform, alas, is not uncommon. Victims of the actions of bailiffs have the right to demand compensation for damages (expenses for last-minute trips abroad, moral compensation).

Justice can be achieved by statement of claim to court. Of course, it is more reasonable to confine ourselves to a complaint to the senior bailiff. But where are the guarantees that the FSSP will punish the bailiff and compensate for the damage? Therefore, it is better for victims to immediately go to court and point out the violated rights.

Other ways to cross the border

Considering the probable, it should be noted that the law does not set rigid limits. There are several ways to leave Russia. This is not prohibited by law, but the reasons for not leaving the Russian Federation will not disappear anywhere.

Urgent debt repayment

No need to try to deceive the FSSP. It is much more reasonable to pay off the debt and go on vacation abroad. The only thing you should be aware of is that the debt is repaid in advance. There is no mention of any urgent repayment. This is due to the bureaucratic procedure that starts with the bank and ends with the FSSP.

After receiving a receipt for repayment of the debt, the bailiff prepares documents for the cancellation of enforcement proceedings (the actual lifting of the ban). In parallel, the Border Guard Service is being informed. The latter will release you abroad only after the order of the bailiffs.

Departure through another state

The law that was once in force did not impose a ban on traveling abroad with debts through Belarus. But at the beginning of 2018, the so-called border zone was introduced. Border posts are equipped with electronic terminals with up-to-date databases. Now the registration is accompanied by a verification of the identity of the emigrant, including all his debts in the Russian Federation.

Holders of a Schengen visa can undertake an exit from Russia along the route Kaliningrad-Vilnius-Europe. Another option is to take advantage of Kazakhstan's openness. While these loopholes are available, but perhaps they will be covered as in the case of Belarus.

If you are going abroad, it will not be superfluous to find out in advance whether you have the right to do so. Citizens of the Russian Federation and foreigners are included in the lists of people not allowed to travel abroad for several reasons. One of them - unpaid debts- can affect everyone.

Overseas in debt

For debts of any size, it is impossible to put a person in prison;

There are not so many instruments of influence on the average citizen in this regard. One of the most effective is the deprivation of the right to travel abroad.

How is the limit set?

The fifth paragraph of the fifteenth article of Law No. 114-FZ establishes that the right of a person to go abroad of the Russian Federation bailiffs have the right temporarily restrict until he fulfills the tasks entrusted to him financial obligations or fail to negotiate with the creditor. The same is said in Art. 67 of Law No. 229-FZ. The bailiff service is obliged to send a person a notice of travel restrictions, which explains why and for how long the restrictions apply.

It should be noted that the mere existence of debt, unpaid loan is not a reason to restrict travel. For a restraining order, existence of enforcement proceedings for debt collection.

The very bank you owe can't restrict travel. To do this, the creditor must sue you, transfer the writ of execution to the SSP, and then require the bailiff to take such a measure.

Amounts of debt for non-departure

The amount of the debt for the adoption of a bailiff's decision to ban travel in one or more enforcement proceedings together must be at least 10,000 rubles.

Exceptions for admission abroad

Prohibition is a right, but not an obligation, of a bailiff. Whether it is worth applying such a measure to you, he decides on his own.

Since the bailiffs are very busy people, and the execution of the ban requires time and effort, they usually accept it only at the request of the exactor.

  1. Having a debt, even a big one, does not guarantee that you are blacklisted by the border guards;
  2. If it is very necessary and refusal does not threaten with large losses, try to drive, perhaps the bailiff did not reach your hands;
  3. If a very good reasons(death, serious illness of a relative), the management of the SSP department has the right to meet halfway and lift the travel ban;
  4. It should be remembered that revoke the ruling the bailiff has the right and without any reason. So it is always possible to include the human factor;
  5. Bailiffs have the right to restrict departure for no more than six months with one decision. When its validity expires, the bailiff writes a new one. But usually this is not done on the day, but after a couple of weeks. Is quite real slip through into this window. In any case, you will be allowed back to your homeland without any consequences;
  6. The most common way to bypass the ban is − leave through Belarus. The border between the Russian Federation is not guarded in any way, there are no posts there. Having left for a brotherly country, you have the right to go further wherever you wish. The border guards of the two countries do not have a common database on travel restrictions, and so far there are no legal grounds for its creation. If you are not on the international wanted list, everything will work out. And they don’t start an Interpol search for debts;
  7. If on hand , it 's easy to take a train ticket to and get off at ;
  8. When the purpose of the trip is the countries of Asia, choose the next one to another region of the Russian Federation through Kazakhstan. Get off at Petropavlovsk.

Departure from Russia foreign citizens regulated by N389-FZ, Art. 28. If a foreigner owes money in Russia, his departure is also entitled to be restricted.

How to earn a ban

But the very fact of having old debts does not mean that you will have trouble when checking documents at the border. Imposing a ban is a lengthy procedure, and it all starts in court.

Stage one - court

The decision in three copies is sent to the debtor himself, as well as to the Main Department of Internal Affairs of the Ministry of Internal Affairs and border guards. Important point: the bailiff has the right to choose such a measure only if the amount of the debt is equal to or more than ten thousand rubles.

As you can see, a lot of time can pass from the moment the application is written to the court to the transfer of the decision to the border guards. It must also be remembered that the ban is not for life, but lasts until you still pay your debts. Six months later, it loses its force, but if the debtor persists, the bailiff has the right to renew the ban, and so on ad infinitum.

Checking ourselves

How can I find out if travel abroad is closed? The bailiff must notify you of the injunction by mail. But the letter may get lost, especially if you do not live at the registration address. Therefore, it becomes necessary to check the restrictions on traveling abroad on your own.

Bailiffs

How to find out if there is a restriction on traveling abroad without leaving home, online? The first step is to use the website of the bailiff service.

And, finally, the most interesting thing is the restriction of travel abroad for debtors. It is about the status of the debtor that it is easiest to “forget” when going on another vacation abroad. The reason may be overdue loans, unpaid utility bills, alimony or fines from the traffic police. Any of these debts may threaten to restrict travel abroad in 2018, we recommend that you find out information about the presence of debt using a proven service not to fly.rf

AT special service enter your region and personal details.

If enforcement proceedings have been initiated against you, the search engine will find you, otherwise it will display a message that no information was found at the request.

You can, of course, use the advanced search located right on the main page of the site.

But there is no way to enter a date of birth in it, and you will become the proud owner of a list of enforcement proceedings established for your namesakes.

Note that even if the answer is positive, this only means that such a measure can be used.

But on the main page there is an interactive assistant.

With it, you can ask a question that interests you about enforcement proceedings or get a certificate of no debt.

How do I know for sure if there is a travel ban? You will most likely have to visit the local branch of this service, and then do not forget to take your passport. Whether it is worth looking for a personal meeting with the bailiff who is conducting your proceedings is up to you. However, your visit may well provoke a sanction if it has not yet been applied, and there are grounds for it.

Tax authorities

How can I find out if traveling abroad is allowed? Another resource that you can use is the tax service website. Here in your personal account you can find out if you have an underpayment of taxes. To do this, you first need to contact any branch of the tax service with an identity card and take a username and password.

public services

How to check the ban on traveling abroad from Russia online on the State Services website? This method is the most convenient. Especially if you already have an account on this resource. The fact is that the process of creating personal account takes some time.

But here you can find out not only about the presence of enforcement proceedings and tax debts, but also the number of unpaid fines from the traffic police.

All these services are among the most popular, they can be found right on the main page of the site.

At the border guards

Checking with border guards for a ban on traveling abroad is not a good idea. The border service is not authorized to give any information and explanations, so you can only encounter it directly when leaving the country. Thus, you can empirically find out that the restriction still exists.

However, this will cost you wasted money on tickets, visas and more. It is possible to return the losses incurred only through the court if you can prove that the FSSP employees did not properly inform you or that the ban was unreasonably issued to you.

By the way, earlier many debtors traveled abroad through Belarus: there is practically no border control between our countries, and Belarusian border guards had no information about the lists of Russian debtors. Now the situation has changed, because a corresponding agreement has been signed between our countries, and both border services can use a common database.

After that, contact the bailiff and show him the payment receipts. It is in your interest to act without delay. The bailiff must draw up another resolution canceling the ban, send it to the border service. A copy of the decision, certified by the seal of the department, is desirable to have for the former debtor.

In order to speed up the process, do not be lazy and check with the bailiff whether your documents have been sent to the border guards. It makes no sense to show paid receipts at the border, because border guards are guided solely by data from internal sources. It may take about two weeks to transfer communications between departments and update databases. And only after that the way to other countries will be open to you.
