At the same time, in the process of selling products, it accepts orders from customers for a number of services (in particular, for packaging, delivery of goods sold, etc.). Let's assume that the revenue for the year from the sale of goods through individual retail facilities turned out to be less than 5 million rubles. At the same time, in general, for the distribution network (including revenues for services rendered), the amount of revenue is more than 40 million rubles. We believe that in such cases it is advisable to contact Rospotrebnadzor for clarification. At the moment, sellers (executors) are also obliged to provide buyers with the opportunity to pay with the Mir card.

However, this applies to those entities whose income from entrepreneurial activity for the previous calendar year exceeds 120 million rubles. (Clause 1, Article 16.1 of the Law of the Russian Federation of 07.02.1992 No. 2300-1 “On Protection of Consumer Rights”, Decree of the Government of the Russian Federation of 04.04.2016 No. 265).

Note that the penalties for non-compliance with this requirement have not changed. In accordance with Article 2.4, Part 4 of Article 14.8 of the Code of Administrative Offenses of the Russian Federation:

  • an individual entrepreneur and an official of an organization can be fined from 15 to 30 thousand rubles;
  • organization - in the amount of 30 to 50 thousand rubles.

Soon, credit institutions will be required to credit payments to individuals at the expense of budgetary funds only to bank accounts, transactions on which are carried out using the Mir card. The transition to such an order of payments is phased. It starts on 07/01/2017 and must end by 07/01/2020.

President of the Russian Federation Vladimir Putin signed a law on the mandatory use of national payment systems when paying budget funds to individuals. Such payments include salaries of state and municipal employees, scholarships and pensions. The law applies to payments both from the budget itself and from state funds. Banks will use the Mir national payment system to make settlements with state employees.

The bill now approved was submitted to the State Duma in December 2016 by several deputies headed by the chairman of the Duma Committee on financial market Anatoly Aksakov. The new rules do not apply to payments related to income tax deductions individuals. They also do not apply to irregular payments. The list of cases when the use of the Mir card is mandatory can be expanded by the government and the Central Bank.

Those citizens who open an account to receive budgetary payments on July 1, 2017 or later will receive a Mir card automatically. It was originally planned to introduce this practice from January 1, 2018, but later the deadlines were. Those citizens who already have an account for budget payments must acquire a Mir card by July 1, 2018. Pensioners can do this until July 1, 2020. In addition, free card maintenance is provided for pensioners. Citizens will be able to receive the budget money due to them without a card - in cash or to a "cardless" bank account.

Putin obliges banks to use Mir for payments to state employees

Banks should ensure that from July 1, 2017 their ATMs and other devices will be able to accept Mir cards. The card processing fee should be no more than when using other payment systems. In addition, all merchants with an annual revenue of more than p40 million are required to start accepting Mir cards from October 1, 2017. Individual banks have been using this system for a long time. In particular, in September 2016, on the completion of work on integration with the national payment system and the start of servicing Mir cards in ATMs and in the Sberbank trade and service network.

Among other things, the law signed by the president changed the composition of the participants in the national payment system - now they include foreign banks, including central as well as international financial institutions. In the future, Vnesheconombank is planned to be added to this list. These measures should contribute to the expansion of the service area for Mir cards, as well as to make it possible to issue them abroad.

National payment system

The law signed by Putin amends the rules of the National Payment Card System. The new rules state that 50% of the authorized capital of the system plus 1 voting share must belong to the Bank of Russia. In addition, the company operating the national payment system cannot sell more than 5% of its shares to one person. Previously, this maximum was 10%.

According to the new law, the operating company must notify the Bank of Russia of tariff changes 30 days before they come into force. Previously, this period was 120 days. A justification for the change must be submitted with the notification.

The domestic payment system "Mir" is a Russian analogue of such systems as Visa, Mastercard, etc. The authors of the project initially conceived the "Mir" card not as a purely Russian one, but as a universal one, therefore it is compatible with all technological standards that allow ATMs to read cards various payment systems around the world.

The first issue of cards for work in the Mir payment system in December 2015. Mir is operated by joint-stock company The National Payment Card System (NSPK), created in July 2014 in the wake of the sanctions imposed against Russia. The structure was designed to ensure the technological independence of the country's banking system.

From July 1, new employees and those whose old cards have expired began to receive new bank cards Russian system WORLD. The remaining employees must receive new cards by June 30, 2018. Not all funds are credited to the MIR payment card, but only those indicated in a limited list.

  • pensions and other social payments from the PFR.

Perhaps in the future, officials will expand this list in agreement with the Central Bank of the Russian Federation. This is stated in subparagraphs. "h", "and" paragraph 6 of Article 2 of Law No. 88-FZ.

The card is not needed for those who receive remuneration under a civil law contract with a state institution.

What you need to do to switch to a new payment system

In fact, the actions of an accountant when switching to a MIR card are the same as when opening cards of an international payment system. Employees are then notified of the transition to the new payment system. To do this, the manager issues an order, and the accounting department issues notifications to employees. The order indicates the name of the bank on behalf of which the card will be issued, the timing of the transition and issuance of cards. Next, you should contact the bank with which the institution has an agreement on a salary project, and conclude an additional agreement with it. It sets tariffs for servicing MIR cards.

The next step is that the accounting department compiles a register of employees for issuing payment cards. It can be generated in your accounting program. For example, in 1C "Salary and personnel" required document located in the section "Payments" - "Documents of exchange with the bank". For each employee, you need to check personal information: passport data, address, last name, first name, patronymic. The finished register should be unloaded and transferred to the bank. If an institution uses a client-bank to exchange documents with credit institution, the registry can be transferred through it. When the cards are issued, it is necessary to agree with the bank's specialists at what time and in what order the cards will be issued to the staff. For example, this will be done during the working week on the territory of the institution. If one of the employees fails to receive the card on time, he will be able to pick it up at the bank branch on his own.

It is necessary to collect statements from employees that they are asking to transfer all payments from the institution to the specified personal account(see sample). This will avoid further disagreements about the method of transferring payments. It is also desirable that in the collective agreement of the institution or in labor contracts with employees it should be indicated that the wages are transferred by the employer precisely in non-cash form. Due to the new cards, personal accounts of employees will change. The accountant will have to change the settings in the program, create new personal accounts for all employees. When employees switch to MIR cards, it will be easier for an accountant to make applications for salary transfers. Indeed, when making payments to international bank accounts, it is necessary to indicate the details of the recipient bank: its name, BIC, correspondent account and customer account numbers. Direct payments to MIR cards allow you to make a payment using only one requisite - the number of the payment card.

What happens if you do not issue a card on time

The employer is obliged to pay wages in full on the days that are fixed in the labor and collective agreements. But if one of the employees does not transfer to the MIR card, the money that the institution transfers to another card, the bank will take into account as unexplained receipts. Therefore, the accountant will need to withdraw money from the personal account and issue a salary through the cashier.

If an employee does not receive a paycheck within the due date, the unpaid amount will have to be deposited on the last payday.

An employee can complain (on the website onlineinspection.rf) to an employer who strongly recommends switching to salary project specific bank. Some banks offer cards with free service. For example, RNKB offers to open and maintain a card for free. Sberbank turned out to be not so generous: the cost of servicing in the first year will be 750 rubles, in subsequent years - 450 rubles.

Among the shortcomings of the card, one can single out the fact that it can only be in rubles and is valid only on the territory of Russia. Although some banks already issue co-badged cards together with international payment systems, which work as cards of two payment systems. These are MIR - Maestro and MIR - JCB cards.
