1. Objects of cultural heritage, regardless of the category of their historical and cultural significance, may be in federal ownership, the property of subjects Russian Federation, municipal property, private property, as well as in other forms of property, unless a different procedure is established by federal law.

2. Features of the possession, use and disposal of a cultural heritage object included in the register and an identified cultural heritage object are determined by this Federal Law, the civil legislation of the Russian Federation, the urban planning legislation of the Russian Federation, and the land legislation of the Russian Federation.

5. The disposal of a cultural heritage object included in the register, an identified cultural heritage object, including their alienation or transfer of the rights of possession and (or) use of such objects, is carried out in accordance with the legislation of the Russian Federation, subject to the fulfillment of the requirements

6. The restrictions (encumbrances) established in accordance with this Federal Law on the rights to an object of cultural heritage included in the register, an identified object of cultural heritage, a land plot within the boundaries of which an object of archaeological heritage is located, shall be preserved upon transfer of ownership or other real rights to the specified objects to another person, including when foreclosing a cultural heritage object, a land plot within the boundaries of which an archaeological heritage object is located, for the obligations of the owner or other legal owner of such a cultural heritage object or the corresponding land plot, when selling a cultural heritage object or a corresponding of a land plot in the bankruptcy proceedings of a debtor - the owner or other legal owner of such an object of cultural heritage or the corresponding land plot, as well as in other cases of transfer of ownership provided for by federal laws or other real rights to a cultural heritage object, a land plot within the boundaries of the territory of a cultural heritage object or a land plot within the boundaries of which an archaeological heritage object is located.

7. If by the time of the conclusion of the agreement providing for the transfer of ownership of the object of cultural heritage included in the register, the land plot within which the object of archaeological heritage is located, or the right to own and (or) use such property, in relation to the specified object , a land plot, there is a security obligation provided for in Article 47.6 of this federal law, such an agreement must contain, as an essential condition, the obligation of the person who, on the basis of such an agreement, has the right of ownership to the specified property or the right to own and (or) use this property, to fulfill the requirements provided for by the relevant security obligation, the procedure and conditions for their implementation. In the absence of an essential condition provided for by this paragraph in the contract, the transaction is void.

A copy of the security obligation is an integral part of the contract specified in the first paragraph of this paragraph.

8. Prior to the approval, in accordance with the procedure established by Article 47.6 of this Federal Law, of a security obligation for a cultural heritage object included in the register, a land plot within whose boundaries the archaeological heritage object is located, other valid security documents: a security lease agreement, a security agreement or a security obligation in relation to a monument of history and culture, a security obligation of the owner of a cultural heritage object or a security obligation of a user of a cultural heritage object, as well as a passport of a cultural heritage object (if any).

9. In the event that by the time of the conclusion of the agreements specified in paragraph 7 of this article in relation to the object of cultural heritage included in the register, the land plot within the boundaries of which the object of archaeological heritage is located, which are the objects of the transaction, the documents of protection provided for in Article 47.6 of this of the Federal Law or paragraph 8 of this article, a person who, on the basis of these agreements, acquires the right of ownership of a cultural heritage object included in the register, a land plot within whose boundaries an object of archaeological heritage is located, or the right to own and (or) use such property, is obliged to comply with the requirements for a cultural heritage object included in the register, provided for in paragraphs 1 - 3 of Article 47.3 of this Federal Law, to comply with the requirements established by Article 5.1 of this Federal Law special treatment the use of a land plot within the boundaries of which an object of archaeological heritage is located, until such person is handed a security obligation under Article 47.6 of this Federal Law.

After receipt of the specified security obligation by the person to whom the cultural heritage object included in the register, the land plot within the boundaries of which the archaeological heritage object is located, belongs to the right of ownership or other real right, the specified person is obliged to ensure that and (or) the use of such an object, changes that provide as an essential condition for the obligation of the person in possession and (or) in whose use the said property is located, to fulfill the requirements provided for by the security obligation, as well as the procedure and conditions for their implementation.

This paragraph applies to cases of concluding agreements providing for the transfer of the rights of ownership and (or) use of a cultural heritage object included in the register, a land plot within the boundaries of which the archaeological heritage object is located, between persons who have acquired the specified right on the basis of agreements, and third parties. persons (sublease agreement and other agreements).

10. An agreement providing for the transfer of ownership of the identified object of cultural heritage, the rights of possession and (or) use of such an object, must contain, as an essential condition, the obligation of the person who, on the basis of such an agreement, has the right of ownership to such property or possession rights and ( or) the use of such property, to meet the requirements established by paragraphs 1 - 3 of Article 47.3 of this Federal Law in relation to such an object. In the absence of such an essential condition in such an agreement, the transaction is void.

11. A person to whom an object of cultural heritage included in the register, an identified object of cultural heritage, a land plot within the boundaries of which an object of archaeological heritage is located, was transferred into possession or use on the basis of an agreement, is obliged to comply with the requirements for such objects established by paragraphs 1 - 3 articles 47.3 of this Federal Law. The distribution of obligations for fulfilling the requirements provided for by Article 47.2 of this Federal Law between the parties to the agreement is established by the said agreement, unless otherwise provided by Article 47.6 of this Federal Law.

12. When transferring to third parties the rights of possession and (or) use of a cultural heritage object included in the register, an identified cultural heritage object, a land plot within the boundaries of which an archaeological heritage object is located, including those that are in state or municipal ownership, the owner or other the legal owner of an object of cultural heritage included in the register, an identified object of cultural heritage, a land plot within the boundaries of which an object of archaeological heritage is located, is not relieved of responsibility for fulfilling the requirements established in accordance with this Federal Law in relation to a cultural heritage object included in the register, identified object of cultural heritage, object of archaeological heritage.

Rent: long-term and benefits

According to Roman Bogdanov, Deputy Head of the Federal Property Management Agency, the Ruble per Sq. m ”works quite successfully to this day. Practical implementation

During the program, work was carried out on 9 cultural heritage sites. And the numbers are interesting. We are talking, for example, about a residential building of the second half of the 19th century in Pechatnikov Lane, known as the “House with Caryatids”, put up for auction in 2012. The initial price at the auction was exceeded by 9.1 times, and the restoration work was completed by a private investor in just a year! The volume of investments amounted to 56 million rubles, despite the fact that the object itself cost 10 million rubles.

In 2013, the “Large Orange Greenhouse” was put up for auction, which is also the former barracks on Hospital Square. The final price at the auction exceeded the starting price by 11 times. The object was bought for 63 million rubles, but 150 million rubles had to be invested in it, despite the fact that the restoration was also carried out in just a year.

There were also relatively inexpensive objects. Thus, the northern wing of the Lepekhins' city estate on Andronievskaya Square was sold in 2014 for only 5.4 million (with an excess of the price by 1.5 times).

For 16 million was put up for auction "E.A. von Berrens" in Gusyatnikov Lane, which was by no means in a "ruined" state (the price did not increase during the bidding process).

However, we are talking only about rent, albeit long-term. Well, what if the conditions of the program will ever change? The inability to obtain ownership of an object deters a number of potential investors.

Is it safer to own?

“In the 90s, we already had the experience of saving a cultural monument - Gostiny Dvor,” says Vadim Solovyov. — In 97-98 we sold a large number of areas, received money for it. The rental program is good for those cultural objects that are in a more or less satisfactory condition.

But about the ruins - it's difficult. Developers and investors rightly think: why should I invest in something that will never become my property? We won't save anything without privatization.

I think that it is necessary to identify what needs to be rescued urgently and make a list of what is not subject to privatization under any conditions.”

In 2013, at the auction of the Russian Auction House for 157 million rubles. a four-story mansion of the 19th century on Shkolnaya Street, which is part of the historical ensemble of the Rogozhskaya Yamskaya Sloboda, was sold. The auction was held on behalf of the Russian Ministry of Culture. The building has been restored in accordance with the obligations imposed by the Ministry of Culture. The project was successful and now it houses a hotel.

In the same year, the Hexagon pavilion was sold at the AH auction along with the adjacent two-story building. total cost two lots amounted to 433.4 million rubles. After that, the building was reconstructed exhibition area "Garage".

Currently, there are more than a hundred objects in the privatization program, about 30 more are expected to appear in the near future. At the same time, these are mainly objects whose condition is assessed as unsatisfactory.

The very same program of privatization of cultural heritage is stalled. The problem is in contradictions with the Land Code.

“According to the Land Code, a land plot can only be provided through auctions - alienation in the order of privatization of a real estate object that is in federal ownership or in the ownership of a subject, or municipal property, is possible only with the simultaneous alienation of a land plot,” explains Roman Bogdanov. - And the alienation of cultural heritage objects that are in an unsatisfactory condition is carried out on the basis of a competition. Now we are jointly solving this problem with the Ministry of Economic Development.

As soon as we develop a mechanism, the Ministry of Culture will be able to develop terms of reference for the restoration of the object and draft designs that will give a potential buyer an idea of ​​what level of investment is required for restoration. And although it takes 7 years to restore according to current standards, in my opinion, the timing should be worked out individually for each object. In parallel, we are jointly working on alternative ways with the Ministry of Culture, for the implementation of objects subordinate to this institution. Conditions are about the same.

What about investors?

So far, they are somewhat skeptical about the program.

“The program itself is very raw, and we did not find ourselves in it, although we were looking at a number of objects,” says Alexander Khrustalev, chairman of the board of directors of the NDV Group company. - The idea of ​​​​reconstruction in our country is somewhat blurry - often all sorts of "ceramomarazzi" and double-glazed windows are installed and it's ready. According to our calculations, the full restoration of one of the mansions would cost 10 times more than new construction.”

“If we are talking about replacing structures, then it will cost 2 times more than new construction,” the official supports the businessman. Vadim Solovyov. - And if we are talking about some interior work - then 6-10 times. In my opinion, if we are talking about investments of 1000 dollars / sq. m - this can be somehow justified. The rest is doubtful."

Expensive cherries on the cake

Now, within the framework of the privatization program, a tidbit of land in Moscow is being prepared for sale. The seller is the Government of Moscow, which received this territory from the Ministry of Defense.

The capital master plan has already been developed technical task for a plot of 11 hectares at the intersection of Moskvoretskaya embankment and Kitaygorodsky proezd. Previously, this territory belonged to the Academy of Strategic Missile Forces named after Peter the Great.

The total area of ​​five buildings belonging to cultural heritage is 128 thousand square meters. The Art Nouveau building was erected in 1903 by architect Erichson. Stone and bronze were used in the exterior decoration of the facade. And the house is in a very good condition.

This is one of the few wooden houses in the style of mature Moscow classicism, preserved after the fire of 1812. The house is one-story, with a basement. But perhaps the most significant novelty was the ability to rent cultural heritage objects that are in poor condition at a reduced price (Article 14.1 of the Federal Law of June 25, 2002 No. 73-FZ ""; hereinafter - Law No. 73-FZ) . We are talking, for example, about estates, mansions, architectural ensembles, etc. Both individuals and legal entities however, the lease term in any case cannot exceed 49 years.

The main goal of the innovations is to attract additional funding for the restoration of cultural values ​​through benefits.

Cultural heritage objects are real estate objects and other objects with territories historically associated with them, works of painting, sculpture, arts and crafts, objects of science and technology and other cultural objects that are of value in terms of history, archeology, architecture, urban planning, arts, science and technology, aesthetics, ethnology or anthropology and social culture ().

The territory of an object of cultural heritage is the territory directly occupied by this object and (or) connected with it historically and functionally ( land, forests, water bodies, etc.), the boundaries of which may not coincide with the boundaries of existing land plots. Moreover, they may include lands for which state cadastral registration has not been carried out ().

Preferential rent: grounds and conditions

The legislator has established a number of conditions under which a cultural heritage object can be rented at a reduced price (). This is possible if such an object:

  • not used;
  • included in the unified state register of cultural heritage objects, which is maintained by the Ministry of Culture of Russia - this register is not publicly available, however, an approximate list of cultural heritage objects can be found on the website of the department;
  • belongs to federal property;
  • is in poor condition.

However, even in the presence of all the above conditions, the final decision on the possibility of transferring an object of cultural heritage for rent is made by the Ministry of Culture of Russia.

The lease agreement for a cultural heritage object is concluded based on the results of the relevant tender. You can find out about it, for example, on the website of the Agency for the Management and Use of Monuments of Architecture and Art under the Ministry of Culture of Russia. In addition, the necessary information can be obtained on the official website for posting information on public procurement.

An essential condition of the contract is the obligation of the tenant to carry out work to preserve the cultural heritage object within a period not exceeding seven years from the date of transferring the specified object to him (). This period also includes the preparation and approval period. project documentation for the preservation of a cultural heritage object (no more than two years from the date of transfer of such an object for rent). If the tenant does not fulfill the specified condition, that is, does not restore the property within the specified period, the contract with him is terminated. The law does not define how and in what documents the conditions for the restoration of a cultural heritage object, its timing and content should be determined, however, it is logical to assume that these provisions will be included in the draft contract during the competition.

Preferential rent is established from the date of conclusion of the lease agreement based on the results of the auction ().

Alexander Raetsky, lawyer, member of the Moscow Bar Association "MOVE":

"The provision of the law on preferential rent, established from the moment of the conclusion of the lease agreement, and not from the date of delivery of repair and restoration work, seems disputable. On the one hand, the new version of the law will help attract more tenant investors. On the other hand, this may lead to an increase in the number of abuses by unscrupulous tenants who have entered into an agreement without the intention of restoring a cultural heritage site. So, it is quite possible that, having received the right to lease preferential terms, the tenant simply will not carry out its restoration or will carry it out only "on paper". And although the failure to fulfill the obligation to restore a cultural heritage site is the basis for terminating the lease, perhaps even with penalties, the effectiveness of the restoration of objects remains in doubt.

One of the ways to avoid abuse by tenants can be the introduction of a procedure for public control over the implementation of restoration work on a leased cultural heritage site.

However, the legislature prohibits tenants from:

  • sublease such object of cultural heritage;
  • transfer their rights and obligations under the lease agreement to another person;
  • provide an object of cultural heritage for free use;
  • pledge your lease rights and make them as a property contribution to commercial organizations or a share contribution to production cooperatives ().

At the same time, the article does not say anything about the possibility of making rental rights to an object as a property contribution to commercial firms. According to the rules of civil circulation, the parties to the contract have the right to act according to the rule "everything that is not prohibited is allowed," which means that theoretically such property contributions to commercial organizations are possible. Whether this is a gap in the novel under consideration or a conscious assumption of the legislator will become clear later, when the first law enforcement practice appears.

As for cultural heritage objects in poor condition, which belong to the property of the constituent entities of the Russian Federation or to municipal property, then in their respect preferential rent is established in accordance with regional laws and other regulatory legal acts(). Preferential rent of cultural heritage objects may be of interest to both businessmen (for example, entrepreneurs who want to place their office in a historic building and at the same time save on rent) and patrons. However, the novel also has its shortcomings.

Thus, the legislator obliged the tenant to provide access to citizens, foreign persons and stateless persons to a cultural heritage site (). This article is intended to make cultural heritage objects more accessible, and also, as conceived by the legislator, to promote the active use of such objects in scientific, cultural, educational, educational, tourist, sightseeing and (or) religious activities. At the same time, access to a cultural heritage object is established taking into account the requirements for the preservation of the specified object, its maintenance, as well as taking into account its physical condition and the nature of its modern use ().

The presence of these reservations raises concerns among experts. “If the “physical state” is less and less clear, then the “character of modern use” is not so simple. So, in new edition of the law states that access to a cultural heritage object should not interfere with the modern use by the owner of the cultural heritage object. In practice, there may be a conflict between the interests of "access" to a cultural heritage site and its "modern use" [for example, the tenant opened an office in the mansion building, and those who want to look at this monument create noise, crowd, park their cars, ask questions to the office staff or they even regularly lay gradually fading flowers near the building in tribute to the memory of the former owners of the mansion. - Ed.]. And, as you can see, priority is given to the use, which to some extent contradicts the one that establishes the right of everyone to have access to cultural property, "the lawyer, a member of the MOVE Moscow Bar Association, shared with the GARANT.RU portal. Therefore, to judge How positive this rule will turn out to be in practice is still too early.

There is another controversial provision in this article. If the interior of a cultural heritage object does not belong to the subject of protection, the tenant may not let those who wish to enter the internal premises of such an object (). But since at the moment there are no open sources with information of this kind, to understand whether access to interior spaces object, is possible only with the help of a request sent to the authorized body (for example, the Ministry of Culture of Russia).

Concerning options use of a cultural heritage site, the law provides for the possibility of conducting any activity on its territory economic activity provided that it does not contradict the requirements for ensuring the safety of this object and allows its functioning (). In practice, this means that the tenant can, for example, organize his own office in the building, if such intended use of the object is allowed by the authorized body and the building itself does not suffer.

If we consider these novels as a whole, it can be noted that they are of a positive nature and are designed to ensure the protection of cultural heritage sites. And over time, the practical significance of these innovations will become obvious.
