The main document regulating urban planning activities in Russian Federation, is the Town Planning Code(Further - GrK). It defines all its legal aspects - from the procedure for conducting engineering surveys to putting the facility into operation. It also describes the procedure for developing, agreeing and approving project documentation for buildings, structures and linear objects.
All construction works are classified in a certain way, their misinterpretation can lead to financial losses or other undesirable consequences. One of the most controversial issues is the subject of discussion of this article.
So, let's look at the definitions of the concepts overhaul and reconstruction:
Reconstruction of objects capital construction (Article 1, Clause 14 of the GrK) - changing the parameters of an object or its parts (height, number of floors, area, volume), including a superstructure, rebuilding, expansion, as well as replacement and (or) restoration of load-bearing building structures, with the exception of replacement of individual elements of such structures with similar or other elements that improve the performance of such structures and (or) restoration of these elements;

Capital repairs of capital construction facilities(Article 1, clause 14_2 of the GrK) - replacement and (or) restoration of building structures of an object or elements of such structures, with the exception of load-bearing building structures, replacement and (or) restoration of engineering support systems and engineering networks or their elements , as well as the replacement of individual elements of load-bearing building structures with similar or other elements that improve the performance of such structures and (or) the restoration of these elements.

The main feature of the reconstruction work is the need to develop a complete set of project documentation, which includes all the mandatory sections according to Decree of the Government of the Russian Federation No. 87.
Also, in most cases, it will be necessary to conduct its examination.
In addition, you will have to obtain a building permit, in the event that structural elements or other characteristics of the reliability and safety of the object are affected, as well as the maximum permissible construction parameters are exceeded during the performance of work (part 17.4 of Article 51 of the Civil Code).
If it is necessary to obtain a building permit, it is also necessary to put the facility into operation after completion of work.

When carrying out a major overhaul, in accordance with paragraph 12_2 of article 48 of the GRC, it is necessary to develop only those sections of the project documentation that affect the work performed. In addition, in accordance with paragraph 2 of Article 51 of the Civil Code, in this case no building permit is required.
It also does not require commissioning of the facility upon completion of work.
Note that the attribution of works to one or another type is within the competence of the owner of the object or the person responsible for its operation. This also affects Accounting the specified person, but this is a topic for a completely different article and will not be considered here.
Carrying out reconstruction work without a building permit or under the guise of a major overhaul is punishable by law. In accordance with part 1 of article 95 of the Code on administrative offenses for these actions, legal entities are subject to a fine of 500,000 to 1 million rubles or an administrative suspension of activities for up to 90 days.
To begin with, we note that at least one sign indicated in the definition of the concept of "reconstruction" is enough to classify works as this type.

According to the definitions of these concepts, the difference lies in the number of structural elements to be replaced.
Overhaul - replacement of part of the supporting structures or their individual elements. De jure, when replacing 99% of the beams, we can say that this species work is a major overhaul. Thus, you do not need to develop a complete set of project documentation in accordance with Decree of the Government of the Russian Federation No. 87, obtain a building permit and put the facility into operation.
The criteria that determine the line between the reconstruction and overhaul of linear facilities are: changes in the class, category, initially established performance indicators of the facility, changes in the boundaries of the right of way or protected zones.

For the overhaul of buildings and structures include works on the restoration or replacement of individual parts of buildings (structures) or entire structures, parts and engineering equipment due to their physical wear and tear and destruction with more durable and economical ones that improve their performance ( Decree of the Gosstroy of Russia dated 03/05/2004 N 15/1 (as amended on 06/16/2014) "On approval and implementation of the Methodology for determining the cost construction products on the territory of the Russian Federation" (together with "MDS 81-35.2004...")).
Building overhaul- a set of construction and organizational and technical measures to eliminate physical and functional (moral) wear and tear that do not involve changes in the main technical and economic indicators of a building or structure, including, if necessary, the replacement of individual or all structural elements (except for non-replaceable) and engineering systems equipment with their modernization. Complete overhaul: replacement, restoration and (or) repair of the common property of an apartment building or its individual parts, carried out in relation to the majority of the common property of an apartment building ( "GOST R 51929-2014. National standard of the Russian Federation. Services of housing and communal services and management of apartment buildings. Terms and definitions" (approved and put into effect by Order of Rosstandart dated 11.06.2014 N 543-st)
Complex overhaul- covers all elements of the building, provides for the simultaneous restoration of all worn-out structural elements, engineering equipment and an increase in the degree of improvement of the building as a whole, eliminates physical and moral deterioration. The timing of the overhaul is either established by the parties, or established by regulatory legal acts(NPA). In the absence of an indication of the timing of the repair in the contract or normative act, it is carried out within a reasonable time.
The concept of "reasonable time" is traditional for civil law and is mentioned repeatedly in the norms of the Civil Code of the Russian Federation (see Article 314 of the Civil Code of the Russian Federation, in relation to pledge relations - clause 4 of Article 345, clause 1 of Article 358 of the Civil Code of the Russian Federation).

The list of works on the overhaul of apartment buildings to be included in the scope of works financed from the funds provided for by Federal Law N 185-FZ; Table 2.3 ( "Methodological recommendations for the formation of the scope of works for the overhaul of apartment buildings financed from the funds provided for by the Federal Law of July 21, 2007 N 185-FZ "On the Fund for Assistance to the Reform of the Housing and Communal Services" (approved by the State Corporation "Fund for Assistance to the Reform of Housing and Utilities" 15.02.2013)
This list is formed on the basis of the updated lists of work on major repairs recommended by the above regulatory documents within the framework of the types of work on the overhaul of apartment buildings, defined by Article 15 of the Federal Law N 185-FZ. It is assumed, however, that the provisions of these guidelines apply to apartment buildings subject to major repairs without stopping their operation. As a result of the overhaul, all necessary work must be performed to bring the common property of an apartment building into a technically sound condition by restoring or replacing all parts of structures and engineering systems that have more short time service between the next (according to the standard service life) overhauls than the supporting structures.
2.3.2. Consistent and methodical binding technological processes to the list of works given in Table 2.3 of these recommendations is contained in Section 3.

1. During the overhaul of structures and engineering systems as part of the common property of an apartment building, as determined by Federal Law 185-FZ, at least 50% of each structure and engineering system is replaced.
2. In-house heating systems as part of common property include: risers, heating elements in common areas, in residential premises - branches from risers to the first disconnecting device (if it is not available, to the point of interface with a heater, heating element), regulating and stop valves; collective (common house) heat energy meters, as well as other equipment located on these networks.
3. In the event that during the performance of work on the overhaul of structures and engineering systems as part of the common property of MD, due to the technological and design features of the repaired (replaced) structures and engineering systems, it is necessary to dismantle or destroy parts of the property that is not part of the common property of MD , work on its restoration is carried out at the expense of capital repairs, which should be provided for in the design and estimate documentation.
4. In the event that a heating system with a hidden laying of pipelines, which is not repairable (Appendix 2), is designed in an apartment building, it is allowed to re-install a heating system with open laying of pipelines and heating appliances, heating elements, including in residential premises.

I order:
1. Approve the attached List of types of work on engineering surveys, preparation of project documentation, construction, reconstruction, overhaul of capital construction facilities that affect the safety of capital construction facilities (hereinafter - the List).
2. Establish that the List does not include the types of work on the preparation of project documentation, on construction, reconstruction, major repairs in relation to objects for which the issuance of a building permit is not required in accordance with paragraphs 1-4, 5 of part 17 of Article 51 of the Town Planning Code of the Russian Federation (Collected Legislation of the Russian Federation, 2005, N 1, Art. 16; 2006, N 1, Art. 21; 2008, N 30, Art. 3616; 2009, N 48, Art. 5711; 2010, N 48, 6246; 2011, N 13, art. 1688; N 27, art. 3880; N 30, art. 4563, art. 4572, art. housing construction(detached residential buildings with no more than three floors, intended for no more than two families); residential buildings with no more than three floors, consisting of several blocks, the number of which does not exceed ten and each of which is intended for one family, has a common wall (common walls) without openings with the neighboring block or neighboring blocks, is located on a separate land plot and has access to the common area ( residential buildings blocked building); apartment buildings with no more than three floors, consisting of one or more block sections, the number of which does not exceed four, each of which contains several apartments and common areas and each of which has a separate entrance with access to the common area.

Types of work on the preparation of project documentation contained in the List can be performed individual entrepreneur independently (personally), and the types of work on engineering surveys, construction, reconstruction, overhaul - only with the involvement of employees in the manner prescribed by the legislation of the Russian Federation ).
3. Recognize invalid the order of the Ministry of Regional Development of the Russian Federation dated December 9, 2008 N 274 "On approval of the List of types of work on engineering surveys, on the preparation of project documentation, on the construction, reconstruction, overhaul of capital construction facilities that affect the safety of facilities capital construction" (registered with the Ministry of Justice of Russia on January 16, 2009 N 13086), as well as the order of the Ministry of Regional Development of the Russian Federation of October 21, 2009 N 480 "On Amendments to the Order of the Ministry of Regional Development of the Russian Federation of December 9, 2008 N 274" On approval of the List of types of work on engineering surveys, on the preparation of project documentation, on the construction, reconstruction, overhaul of capital construction facilities that affect the safety of capital construction facilities "(registered in the Ministry of Justice of Russia on December 22, 2009 N 15789) from the date of entry into force of this order.

Construction - a key term for the industry of the same name, denoting the process of erecting buildings and structures. This is a very broad concept that also includesoverhaul andrestoration . The main difference between construction and reconstruction lies not only in the scope of concepts. Usually, construction is understood as the construction of an object from scratch, which, accordingly, requires a lot of preparatory work- this is design, off-site and on-site work, specific approvals, etc. When developing, it is necessary to take into account such factors as geodetic conditions, the presence of adjacent buildings, features of urban zoning, and much more.
Reconstruction is carried out on an already finished object, therefore, during reconstruction, the characteristics of this particular object are taken into account in the first place. Construction ends with the commissioning of the constructed building or structure. The purpose of the reconstruction is to restore the object and often to adapt it to use in new conditions. As a result of the reconstruction, the main technical and economic characteristics of the building are changed.
The term "reconstruction" must also be distinguished from the term "overhaul". According to Urban Planning Code RF, major repairs, unlike reconstruction, do not change the main indicators of the object. After reconstruction in buildings and structures (including linear facilities), for example, the built-up area, building volume, number of floors, usable area may increase. It is believed that the terms of reconstruction and overhaul should coincide, however, in practice, reconstruction requires a larger number of approvals and permits that must be obtained from various authorities. A major overhaul changes a building only in the sense that it eliminates physical or moral wear and tear. As part of the overhaul, repairs of the internal communications of the building, repair of the foundation, basement, roof, walls, facades, elevators and elevator shafts can be performed. Also, the list of repairs can be expanded with such items as: facade insulation, installation of metering devices, arrangement of exits to the roof, etc. Another task of a major overhaul is not only to nullify the existing physical and moral deterioration, but also to bring the building or structure in line with modern standards.
Construction, reconstruction and overhaul works It is not always easy to distinguish between them. Considering that the construction industry is constantly enriched with new materials and technologies, disputes sometimes arise whether the characteristics of the building have changed as a result of the work carried out and whether they relate to reconstruction or overhaul (for example, replacing wooden floors with reinforced concrete). Legal literacy, especially in the field of capital construction, is required to prevent a stoppage of construction and solve problems associated with a different understanding of the concepts of reconstruction and overhaul.
