The main document regulating urban planning activities in Russian Federation, is the Town Planning Code(Further - GrK). It defines all its legal aspects - from the procedure for conducting engineering surveys to putting the facility into operation. It also describes the procedure for developing, agreeing and approving project documentation for buildings, structures and linear objects.

All construction works are classified in a certain way, their misinterpretation can lead to financial losses or other undesirable consequences. One of the most controversial issues is the subject of discussion of this article.

So, consider the definitions of the concepts of overhaul and reconstruction:

Reconstruction of objects capital construction (Article 1, clause 14 of the GrK) - changing the parameters of an object or its parts (height, number of floors, area, volume), including a superstructure, restructuring, expansion, as well as replacement and (or) restoration of bearing building structures, except for the replacement of individual elements of such structures with similar or other elements that improve the performance of such structures and (or) the restoration of these elements;

The definition of the reconstruction of linear objects can be found in article 1, clause 14_1 of the GrK.

Capital repairs of capital construction facilities(Article 1, clause 14_2 of the GrK) - replacement and (or) restoration of building structures of an object or elements of such structures, with the exception of load-bearing building structures, replacement and (or) restoration of engineering support systems and engineering networks or their elements , as well as the replacement of individual elements of load-bearing building structures with similar or other elements that improve the performance of such structures and (or) the restoration of these elements.

What influences the assignment of works to a particular type?

The main feature of the reconstruction work is the need to develop a complete set of project documentation, which includes all the mandatory sections according to Decree of the Government of the Russian Federation No. 87.

Also, in most cases, it will be necessary to conduct its examination.

In addition, you will have to obtain a building permit, in the event that structural elements or other characteristics of the reliability and safety of the object are affected, as well as the maximum permissible construction parameters are exceeded during the performance of work (part 17.4 of Article 51 of the Civil Code).

If it is necessary to obtain a building permit, it is also necessary to put the facility into operation after completion of work.

The procedure for preparing documentation for reconstruction is in many ways similar to the development of such documentation for new construction.- You will have to go through the same steps. When carrying out a major overhaul, in accordance with paragraph 12_2 of article 48 of the GRC, it is necessary to develop only those sections of the project documentation that affect the work performed. In addition, in accordance with paragraph 2 of Article 51 of the Civil Code, in this case no building permit is required.

It also does not require commissioning of the facility upon completion of work.

Note that the attribution of works to one or another type is within the competence of the owner of the object or the person responsible for its operation. This also affects Accounting the specified person, but this is a topic for a completely different article and will not be considered here.

Carrying out reconstruction work without a building permit or under the guise of a major overhaul is punishable by law. In accordance with part 1 of article 95 of the Code on administrative offenses for these actions, legal entities are subject to a fine of 500,000 to 1 million rubles or an administrative suspension of activities for up to 90 days.

Signs characterizing the reconstruction of a capital construction object

To begin with, we note that at least one sign indicated in the definition of the concept of "reconstruction" is enough to classify works as this type.

For example, the following types of work will be classified as reconstruction:

  • 1) Changing the number of storeys of the building
    This implies a change in the number of floors. It should be borne in mind that not all parts of the building are floors, for example, an attic (unlike an attic) is not a floor. Accordingly, when equipping an attic in the attic space, the number of floors will change and become 1 more. At the same time, by general rule, a building permit is not required (provided that the roof configuration is preserved). If the roof is also undergoing reconstruction and its angle of inclination changes even slightly, then the building volume will increase or decrease, which is also a sign of reconstruction.
  • 2) Change in building volume
    In this case, a building permit is required, since part of the load-bearing structures is modified and structural reliability is changed.
  • 3) Replacement and (or) restoration of load-bearing building structures, excluding the restoration / replacement of their individual elements with similar or improved ones
    If at least one structural element remains during the demolition of the object, then all subsequent work will not relate to new construction, but to reconstruction, since part of the object is preserved. What designs and in what volume - it does not matter at all. Even if you completely demolish the building and erect a new one with the same characteristics, it will still be considered a reconstruction. And only in the case of the complete demolition of the old object and the construction of a new one, different from the one that existed at this place before, can the work be considered as new construction.

The line between reconstruction and overhaul

According to the definitions of these concepts, the difference lies in the number of structural elements to be replaced.

Overhaul - replacement of part of the supporting structures or their individual elements. De jure, when replacing 99% of the beams, we can say that this species work is a major overhaul. Thus, you do not need to develop a complete set of project documentation in accordance with Decree of the Government of the Russian Federation No. 87, obtain a building permit and put the facility into operation.

Briefly about the reconstruction and overhaul of linear facilities

Criteria that define the line between reconstruction and overhaul linear objects are: changes in the class, category, initially established indicators of the functioning of the object, changes in the boundaries of the right of way or security zones.

In this article, we will not consider in detail the nuances of the reconstruction and overhaul of linear facilities and will limit ourselves to giving one classic example: if you are going to build any facility next to a highway (gas station, car wash, etc.), then you will have to make entrances from it and ramps that are highly likely to affect throughput. Also, the right-of-way may change. Therefore, sometimes formally, legally, during the construction of such facilities, it is necessary to reconstruct a linear facility.

Period of overhaul. Reasonable time

The timing of the overhaul is either established by the parties, or established by regulatory legal acts(NPA). In the absence of an indication of the timing of the repair in the contract or normative act, it is carried out within a reasonable time.

The concept of "reasonable time" is traditional for civil law and is mentioned repeatedly in the norms of the Civil Code of the Russian Federation (see Article 314 of the Civil Code of the Russian Federation, in relation to pledge relations - clause 4 of Article 345, clause 1 of Article 358 of the Civil Code of the Russian Federation).

This list is formed on the basis of the updated lists of work on major repairs recommended by the above regulatory documents within the framework of the types of work on the overhaul of apartment buildings, defined by Article 15 of the Federal Law N 185-FZ. It is assumed, however, that the provisions of these guidelines apply to apartment buildings subject to major repairs without stopping their operation. As a result of the overhaul, all necessary work must be performed to bring the common property of an apartment building into a technically sound condition by restoring or replacing all parts of structures and engineering systems that have a shorter service life between regular (according to the standard service life) overhauls than bearing structures.

1. Repair or replacement of foundations.

1.1. Sealing and jointing of joints, seams, cracks in foundation elements. Protective layer device.

1.2. Elimination of local defects and deformations by strengthening the foundation.

Notes:

1. During the overhaul of structures and engineering systems as part of the common property of an apartment building, as determined by Federal Law 185-FZ, at least 50% of each structure and engineering system is replaced.

2. In-house heating systems as part of common property include: risers, heating elements in common areas, in residential premises - branches from risers to the first disconnecting device (if it is not available, to the point of interface with a heater, heating element), regulating and stop valves; collective (common house) heat energy meters, as well as other equipment located on these networks.

3. In the event that during the performance of work on the overhaul of structures and engineering systems as part of the common property of MD, due to the technological and design features of the repaired (replaced) structures and engineering systems, it is necessary to dismantle or destroy parts of the property that is not part of the common property of MD , work on its restoration is carried out at the expense of capital repairs, which should be provided for in the design and estimate documentation.

4. In the event that a heating system with a hidden laying of pipelines, which is not repairable (Appendix 2), is designed in an apartment building, it is allowed to re-install a heating system with open laying of pipelines and heating appliances, heating elements, including in residential premises.
